Williamson introduced an Ordinance entitled as follows: AN ORDINANCE OF THE CITY OF NEWPORT BEACH PROVIDING FOR THE ORGANIZATION, CONTROL AND GOVERNMENT OF A VOLUNTEER FIRE DEPARTMENT IN•AND FOR THE CITY OF NEWPORT 3R4CH, DETERMINING THE NUMBER THEREOF, DESIGNATING AND PRESCRIBING THE DUTIES OF ITS OFFICERS, PROVIDING FOR THE APPOINTMENT OF CERTAIN OFFICERS BY THE BOARD OF TRUSTEES AND THE COMPENSATION TO BE PAID SUCH OFFICERS. The ordinance was read, considered, designated Ordinance No- 315 and referred to the City Attorney. There being no further business on motion of Trustee Fred W. Young ' seconded by Trustee Felix B. Modjeska and carried, the meeting adjourned to 7 :30 o'clock P. M. on Monday, March 28, 1927- Approved March 28, 1927- Q � • President Board of Trustees City Clerk. City Hall,- Newport Beach, March 28, 1927. The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roll was called showing the full Board present. The minutes of the previous meeting were read and approved as read. Trustee Young gave -a verbal report of the parking committee, and on ' motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried, the Clerk was asked to have the report typewritten for consideration of the Board at the next meeting. . The report of the committee on boat landing was read, and on motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the report was filed until such time as the Board wishes to take up the matter of purchase. The report of the committee with additional plans for a fire hall was read, and on motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the report was referred to the Committee of the Whole for consider - ation.with the other plans. The communication from Dr. G. M. Grundy, Health Officer, declaring the sewers and outside toilets on Corona del- Mar.nuisances, was referred to the City Marshal to serve notice on them to -abate the nuisance. The communications were read and acted upon as follows: On motion of- Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the President of the Board and Clerk were instructed to sign the card authorizing the City Treasurer to rent a safety deposit box in the Merchants National Trust & Savings Bank of Los Angeles in which to keep the Liberty Loan Bonds for jetty construction. On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the communication from Kathryn L. Schmidt of Peoria, Illinois in regard to payment of the Me Fadden Place assessment, was referred to the City Attorney for report as to whether they could compel her to pay the penalty. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. ' Modjeska and carried, the application of William Noonan for a license to run a lunch and soft drink stand in Block A -34 Corona del Mar, was allowed. The communication from the Balboa Angling Club to not allow any fishermen on either of the piers to use more than two rods or poles at a time was discussed, and on motion of Trustee Fred W. Young seconded by Trustee Felix B. Modjeska and carried, the matter was referred to the City Attorney to prepare an ordinance. On motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the communications from Lew H. Wallace and Sadie M. Irwin protesting against the removal of the pavilion on the ocean front, was referred to the Committee of the Whole with the parking committees report. t 417 On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the communications from Hugh Mc Millar and J. K. Smith in regard to the boat landing on the wharf, and the communication from Geo. Du Bourdieu asking a license for two live bait boats, was referred to the Committee of the Whole. On motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and upon call of the roll carried by the following vote: AYES, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young, Harry-H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. It was ordered that all permits hereafter granted by the City of Newport Beach for the erection of piers by private persons which extend into the waters of Newport Bay, shall be in the following form: OFFICE OF THE CLERK - CITY OF.NEWPORT BEACH. Application for permission to erect a wharf having been received, approved by the Engineer, duly considered, and on motion of Trustee seconded by Trustee , and upon call of the roll duly carried, at a meeting of the Board of Trustees of the City of Newport Beach held on the day of ___, 19_, was given permission to erect a pleasure wharf extending into the waters of Newport Bay from or in front of that certain real property, located in the City of Newport Beach, County of Orange, State of California, described as: Lot , Block Tract as per map recorded in Book , Page of Maps, Records of Orange County. The wharf to be approximately feet in length and feet in width, built of and shall be neatly constructed, panted, and kept in good order and repair, and not extending beyond the pier head line now or hereafter established. The wharf shall be used exclusively for pleasure and as far as is convenient for the use only of The City of Newport Beach shall never be held liable or obligated for any injury or damage resulting to either person or property through the erection, use, or possession of said wharf. The wharf shall not be constructed or maintained so as to obstruct, Interfere with or prevent the free use or passage of any sidewalk, street, highway, alley, or other public place in the City of Newport Beach. The right given for the erection and maintenance of the wharf is permissive only, and by the acceptance of this permit and the erection of said wharf shall be corslusively presumed to have agreed and does agree upon revocation hereof to remove said wharf and every part thereof within thirty, days after recei•fing written notice of the revocation of this permit, which notice may be persohally served or mailed to the last known address of or posted in a conspicuous place upon said wharf. Full.right, power, and authority to revoke this permit is hereby reserved to the Board of Trustees of the City of Newport Beach and in the event fails to revoke said wharf within the time specified, then the Superintendent of Streets of the City of Newport Beach shall have the right to immediately remove the same wholly at the cost and expense of , which cost and expense shall .constitute a debt in favor of the City.of Newport Beach and may be collected and enforced as any other ordinary debt. This permit is not transferrable. Witness the signature of the Clerk of the City of Newport Beach and dated the day of lj_. Clerk - City of Newport Beach. The foregoing permit and all of the provisions thereof are hereby accepted. Trustee Felix B. Modjeska introduced a Resolution entitled: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NE67PORT BEACH ADOPTING PLANS AIM SPECIFICATIONS FOR CONSTRUCTION OF JETTIES AND DIRLCTING THE CITY CLERK TO ADVERTISE FOR BIDS. The Resolution was read, considered, designated RESOLUTION NO. 420, and upon call of the roll passed by the following vote: AYES, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. young, Harry H. Williamson, Conrad Richter. NOES, Trustees None. ( ABSENT, Trustees None. ORDINANCE NO. 315, entitled; AN ORDINANCE OF THE CITY OF NEWPORT BEACH PROVIDING FOR THE ORGANIZATION, CONTROL AND GOVERNMENT OF A VOLUNTEER FIRE DEPART1TNT IN AND FOR THE CITY OF NEWPORT BEACH, DETERMINING THE NCMER THEREOF, DESIGNATING AND PRESCRIBING THE DUTIES OF ITS OFFICERS, PROVIDING FOR THE APPOINTMENT OF CERTAIN OFFICERS BY THE BOARD OF TRUSTEES AID THE COMPENSATION TO BE PAID SUCH OFFICERS, was taken up for final consideration, was read, considered, and upon call of the roll passed by the following vote; . . AYES, Trustees L. S. Wilkinson, Felix.B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. NOES, Trustees NoAe. ABSENT, Trustees None. The quit claim deeds of the East Newport Town Co. covering five blocks of ocean frontage in East Newport were presented, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and upon call of the roll duly carried, it was resolved by the Board of Trustees of the City of Newport Beach that the quit claim deeds of the East Newport Town Co. and the real property therein described be and is hereby accepted by the City of Newport Beach, subject to the covenants and conditions therein, and that a certified copy of this Resolution be recorded with said quit claim deeds, and that all taxes heretofore assessed by the City and now unpaid be cancelled. NEW BUSINESS. On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the request of A. E. Bergman for a four months lease on Lots 14, 15 and 16 in Block 117'of Section B belonging to the City for a skating rink, was referred to the City Marshal for a recommendation. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, a recess was taken for the Committee of the Whole to meet. After the recess President Richter called the meeting to order, and on motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the Clerk was instructed to notify all the heads.of the departments at once that no change in the personnel of any of the departments would be allowed without first consulting the committee having that special department in charge, and they to take it up with the Board of Trustees for ratification. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the President of the Board was authorized to sign the contracts for the purchase of 2000 feet of 212" hose and 5P0 feet of 12° Fire Hose on rental basis. On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the President of the Board and City Clerk were authorized to sign the lease contract accepting the new La France 750 gallon Pumper. The Cleric was instructed to notify City Auditor Briggs to have the new engine insured at once. The additional report of the Committee on a new fire hall was read estimating that a stucco house could be built as per sketch attached at not to exceed $2300.00- The same was discussed and on motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried, Building Inspector Fenelon was instructed to draw up plans and specifications for a stucco fire house according to the sketch submitted and present it at the next meeting so that we can advertise for bids. Several letters in regard to licensing live bail boats were presented and discussed, and on motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the letters were referred to the City Attorney to draw up an ordinance covering live bait boats. On motion of Trustee Fred W. Young seconded by Trustee Felix B. Modjeska and carried, the office of Fire Chief was declared vacant. On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, Frank W. Crocker of Balboa was appointed Fire Chief at a salary of $200.00 per month, and C. E. Dickey of Orange was appointed engine man at a salary of $150.00 per month, and the Clerk was instructed to notify them by telephone to report for duty at once. There being no further business on motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and carried, the meeting adjourned Sine Die. QL Approved April 4, 1527.
