Trustee L. S. Wilkinson stated that the people in West Newport were desirous of having street crossing aoross the Pacific Electric and Southern Pacific tracks on Orange Street, and on his motion seconded by Trustee Fred W. Young and oarried,•the Clerk.was instructed to correspond with the Pacific Electric and Southern Pacific Co. in regard to obtaining a crossing there. On motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and oarried, the demands No. 1902 to 1310 inclusive, ' having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of Trustee L. 8s Wilkinson seconded by Trustee Fred W. Young and oarried,.the City Marshal was instructed to investi- gate the report of a canvas tent being erected on the back of a lot on 3oth Street which is in the fire zone. There being no further business on motion of Trustee Fred W. Young seconded by Trustee L. S: Wilkinson and oarried, the meeting adjourned to 7:30 o'clock P. M. on Monday, April 2 27. City Hall, Newport Beach, April 25, 1927- ' The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roll was called showing the full Board present. The minutes of the previous meeting were read and approved as read. The report of the Fire Committee on the purchase and sale of material for -the Fire Department was read, and on motion of Trustee L. S. Wilkinson seconded by Trustee F. B. Modjeska and carried, the report was accepted and the purchase of the material reported upon favorably, and the selling of junk and printing of district cards was authorized. The communications were read and acted upon as follows: On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and oarried, the protest in regard to shaling Sey Avenue from Main to A Street, Balboa, was referred to the Committee having the parking -matter in charge. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the application of J. R. Mc Ray for license to run a bathhouse and lunch stand was granted. On-motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and oarried; the application of Mrs. Nellie Maohem for license to operate a lunch, soft drink and toe cream stand on Lot 12, Block 116, Tract 234,.was granted. On-motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the application of S. M. Blassman for license to smoke, piokle, salt and sell fresh fish in the old Newport cannery building was- referred -to the City Marshal for report and recommendation. The application of Sol Miller for monthly license to peddle hoisery was discussed, and on motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and oarried, the Clerk was instructed to notify him that the Ordinance provided a daily license only for that business. On-motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the application of C. A. Bachman for license to operate-a merchandise wheel was referred to the City Marebal for a report and recommendation. Im The communication from N. Robotham in regard to distribution of circulars and hand bills was discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the Clerk was instructed to furnish data to the City Attorney to draw up an Ordinance prohibiting the promiscuous distribution of circulars and hand bills. On motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and carried, the request of Theodore Robins for permission to move his gasoline pump and also the transfer of his business license from Balboa to 22d Street and Central Avenue, Newport Beach, was granted-: The communication from Harry A. biller, Inc. in regard to lease on some bay frontage between 17th and 18th Streete, Section B, was discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the matter was referred to the City Attorney to take up directly with Mr. Miller in regard to .the lease desired. The two communications from the Realty Investigation Syndicate in regard to tidelands olaimed by them, were•taken up for discussion, and the City Attorney gave it as his opinion that they had no rights there whatever, the State granted the tidelands to the City on April 12th 1927s and we should have the say of what will be done with it. On motion of Trustee L. S. Wilkinson seconded by Trustee F. B. Modjeska and carried, the communications were referred to the City Attorney and he was authorised to answer them the way he considers prmper from the standpoint of the City. On motion of Trustee Fred W. Young seconded by Trustee F. B. Modjeska and oarried, the request of H. B. Tudor for permission to construct a parking pier at the end of Palm Street on the ocean front$ was referred to the Planning Commission for investigation and report. The communication from Harbor Master Tom 0. Jay in regard to boats running with mufflers open and fast and dangerous driving, was filed as the ordinance gives him authority to stop it. On motion of Trustee L.. S. Wilkinson seconded by Trustee F. B. Modjeska and carried, the communication from K. L. Howell asking compensation from the.City for a broken window, was referred to the Street Superintendent for investigation and report. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the application of Paul Claire for a position in the Fire Department was filed pending a vacancy. On motion of Trustee Harry H. Williamson seconded by Trustee L. S. Wilkinson and carried, the application of H. R. Dorbandt for a position on the police force, was referred to the Police Committee. and Chief of Police for investigation. This being the time fixed for opening bids for repair of the present west jetty and the construction of a new jetty approximately 1000 feet long on the east side of the entrance to Newport Bay, the Board in open session publicly opened, examined and declared all sealed -bide received for said work, which bids were as follows: C 'i 1 Killer & Zug. Be Modjeska and carried, the bids were referred to the Committee of the Whole with the City Engineer to report on next Monday night, May 2, 1927- UNFINISHED BUSINESS City Attorney Bishop presented Fire Ordinance No. 310 for consideration, the. same was discussed and referred to the. Planning Commission to get in shape.for final passage, .ORDINANCE N0. 316, entitled as follows: AN ORDINANCE OF THE CITY OF NEWPORT BEACH CONCERNING THE USE OF FISHING LINES OR TACKLE UPON PUBLIC DOCKS IN SAIB CITY, AND PROVIDING A PENALTY.FOR ALL VIOLATIONS THEREOF.. came up for final passage, was read, considered, and upon call of-the roll passed by the following vote: AYES, Trustees L. City Attorney Bishop presented notices to the Laguna Beach County Uater District and The Irvine Company in regard to our water system, and on motion of Trustee Harry H. Williamson seconded by Trustee Fred We Young and upon call of the roll, it was ordered that the President of the Board and the .Clerk of the City of Newport Beach be. authorized to sign on behalf of .the said City, and deliver one oopy of each notice to the Laguna Beach County Water District and one copy of each to The Irvine Company, a notice to respect the City's rights in the Santa Ana Costal Plane by the following vote: AYES, Trustees L. S. Wilkinson, F. B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. On motion of Trustee L. S.. Wilkinson seconded by Trustee F. B. Modjeska and carried, the City Attorney was instructed to draw an amendment to the license ordinance concerning laundries, making it an annual license of $200.00 per year. The matter of a new.fire house was discussed and on motion of Trustee Fred We Young seconded by Trustee F.. B. Modjeska and carried, the building of a new fire house was authorized, according to plans and specifications prepared by Building Inspector Fenelon. On motion of Trustee Harry. H. Williamson seconded by Trustee F. Be Modjeska, all bids.for the fire house received at the last meeting were rejected, and the City was to employ the labor and buy the material on the open market, and proceed to build the fire house .themselves under the direction of the Building Inspector, by the following vote: AYES, Trustees L. S. Wilkinson, F. B. Modjeska, Fred We Young, Harry H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. 426 c On motion of Trustee Barry H. Williamson seconded by Trustee Cm. Fred W. Young and carried, the offer of temporary shelter for the old 'Z] fire truck on Balboa Island was accepted, and Paul Olaire was appointed Assistant Vi re Chien to look after the Balboa Island truck and Corona Del Mar hose reel at a salary of $150.00 per month from May 1, 1927; he being under the direction of the Fire Chief. There being no further business on motion of Trustee L. Be Wilkinson seconded by Trustee F. Be Modjeska and carried, the meeting adjourned Sine Die.- Approved May 2, 1927- President Board of Trustees. City.Clerk. City Hall, Newport Beach, May 29 1927- The Board of Trustees of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roil.was called showing the full Board present. The minutes of the previous meeting were read and approved. The reports of the heads of the departments were read, and on motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and carried, the reports were accepted and filed. On motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, the report of the parking committee was.referred to the Committee of the Whole. On motion of Trustee F. Be Modjeska seconded by Trustee ' Fred W. Young and carried, the request of the Planning Commission for another weeks time on the Tudor Pier and the Fire Ordinance, was granted. The communications were ,read and acted upon as follows: The report of the License Committee was read and on motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the recommendations were turned over to the City Attorney to formulate into an ordinance for the next meeting. On motion of Trustee Fred W. Young seconded by Trustee F. B. Modjeska and carried, the request of Cullinan & Patton for a refund of $10.00 paid for a license which was not used, was referred to the Clerk to notify them to present their claim on a regular demand. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and oarried, the communication from Roy Chapin in regard to trophies for the Wrigley race, was referred to the Newport Harbor Chamber of Commerce-for a recommendation. On motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and carried, the request of D. D. Driggers for transfer of the business license of Way & Driggers to Chas. H. Way, was granted. The petition signed by 47 citizens asking that Capt. Olaf Olsen be given permission to use the landings on newport wharf was discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried; the Clerk was instructed to notify Capt. Olsen that our lease with Smith & Mo Farland will not allow us to grant such a request at,this time. The communication from A. U. Jackson in regard to his telephone 'r bill was taken up and on motion of Trustee L. Be Wilkinson seoonded•by Trustee F. Be Modjeska and carried, the Clerk was instructed to get a written statement from the Telephone Company in regard to dame. On motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, $3500.00 was transferred from the unappropriated water-fund to account No. 102 —B. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and oarried, the request of A. M. Honard for a lease on some City property along the bay for a fish stand, was referred to the City Marshal to report on the exact location of same.
