HomeMy WebLinkAbout06/27/1927 - Adjourned Regular Meeting445 WHEREAS; said contract provides for the repair and construc- tion of said present west jetty and the construction of revetments along the west side of the entrance channel and along the shor6 line of the Pacific Ocean westerly of and adjacent to said west jetty; and WHEREAS, the construction of said work as provided in said contract will protect said channel, making it safe for navigation and protect private and public property: NOW, THEREFORD, BE IT RESOLVED, that the work provided in said.eontract is of an extraordinary emergency and that in order to safeguard the lives of those using said entrance channel and to protect private and public property, it is necessary that said Contractor, the Hauser Construction Company, be permitted to employ ' any laborer, workman or mechanic more than eight hours and he is hereby permitted to employ said laborers, workmen and mechanics as many hours in any calendar day as may be necessary and required to prosecute and complete said, work as the supply of materials and equipment will.permit,.to the end that said work will be completed as speedily as possible. I, 1d City Clerk of the City of Newport Beach, do hereby certify that the foregoing Resolution was passed at a special called meeting of the Board of Trustees of said City held on the 20th day of June, 1927, and that the same was adopted by the following vote, to -wit: AYES, Trustees F.B.Modjeska, Fred W.Young, Conrad Richter. City Marshal Winn presented a request to have a section of the parking ordinance No. 322 amended and to add one new section to the ordinance.. The same was discussed and on motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and carried, the changes were authorized. ' There being no-further business on motion of Trustee Fred W. Young seconded by Trustee F. B. City Hall, Newport Beach, June 27, 1927• The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roll was called showing the full Board present. The minutes of the regular meeting of June 6th were read and approved. ' The minutes of the-special meetings of June 10, 17 and 20th were read and approved as read. Trustee L. S. Wilkinson presented a Resolution entitled: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH CONFIRMING THE ASSESSMENT FOR THE IMPROVE+- MENT OF CERTAIN PORTIONS OF BAY AVENUE OF SAID CITY. The Resolution was read, considered, designated RESOLUTION N0. 432, and upon call of the roll passed by the following vote: AYES, Trustees L.S.Wilkinson, F.B.Modjeska, Fred W.Young, H. H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. Trustee H. H. Williamson presented a Map of Tract 846 of the Peninsula Tract from the Planning Commission for tentative approval. The same was considered and on motion *of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the Map was to be approved with the exception of Lots 1 and 8 in Block 4, 9 in Block 7 and 4 and 1 in Block 3, which should have the corners rounded. Trustee H. H. Williamson also presented a map of Tract 712 on Costa Mesa, and on motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the Map was.approved. A Map of Tract No. 647 was also presented and discussed, and on motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the Map was referred back to have the lots made not less than 30 feet wide and the alley along Lot 25 to be 15 feet wide. On motion of Trustee H. H. Williamson seconded by Trustee Fred W. Young and carried, the Clerk was instructed to notify the subdivider of Tract 846 that before the Board can approve the Map it will.be necessary that the 1915 act assessments against the property which will become streets, will have to be absorbed by the lots in the new subdi- vision. The Street Committee reported that they would not recommend, allowing R. F. Brooks to construct a covered platform in front of his CI' � .' store on Balboa Island, and on motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the Clerk was instructed to notify Mr. Brooks that his application was denied. The communications were read and acted upon as follows: The request of some of the property owners on Corona Del Mar for a parking ordinance over there was considered, and on motion of Trustee H. H. Williamson seconded by Trustee F. Be Modjeska and oarried, the matter was referred to the Parking Committee for report at the next meeting. On motion of Trustee L. Be Wilkinson seconded by Trustee F. Be Modjeska and carried, the application of Arthur G. Lyons for permission to construct a pier near the County wharf,'was referred to the City Engineer for a recommendation. On motion of Trustee L. Be Wilkinson seconded by Trustee Fred •W. Young and carried, the request-of Arthur G. Lyons to lease some City tidelands on the upper bay was filed temporarily, and the Clerk instructed to notify him that it woulf be taken up for consideration soon after the City comes into possession of it. On motion of Trustee Fred W. Young seconded by Trustee L. Be Wilkinson and carried, the request of U. V. and W. E. Jones for permission to use Block Q in Tract 518 for a Bowling Green, was referred to the Committee of the Whole. On motion of Trustee L. S. Wilkinson seconded by Trustee F.B. Modjeska and carried, the request of Scoutmaster A. J. Twist for some help for the Boy Scouts, was referred to the Committee of the, Whole. On.motion of Trustee He H. Williamson seconded by Trustee Fred W. Young and carried, the two communications from C. A. Uestgate offering to sell the City some grater bearing land, was referred to the Water Superintendent for a recommendation. On motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the communication from 17m. Rabe for employment •in-degeloping the harbor was to-be acknowledged and filed. On motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, the-communication from S. A. Meyer in regard to "Western Advertising° was filed and the Clerk to thank Mr. Meyer ' for same. On motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the communication from Dr. H Hilmer in regard to the trial of the Bouthland Gailing ®lub was filed. City Attorney Bishop explained fully in.regard to the trial against the Southland Sailing.Club and that there was-no evidence presented to show a violation of the City Ordinance. President Richter expressed the full confidence of the Board in the way the City Attorney handles the City matters. The ap ropriations asked for by the Newport Harbor Chamber of Commerce of 11080.00 to July 15th were considered, and on motion oY Trustee Fred W. Young seconded by Trustee F. B. Modjeska, the amounts named were set aside out of the advertising fund by the following vote: AYES, Trustees L.S.Wilkinson, F.B.Modjeska, Fred W.Young, H: H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. On motion of Trustee Fred W. Young seconded by Trustee H. H. Williamson and carried, the communication from the Newport Harbor Chamber of Commerce thanking the Board for assistance given the jetty celebration was filed. The communication from J. D. Arthur, Jr. of the U. S.Engineers Office calling a hearing in regard to dredging-and the building of a ' bridge by the Title Insurance & Trust Co. was considered, and on motion of Trustee H. H. Williamson seconded by Trustee Fred W. Young and carried, the Clerk was instructed to notify Mr. Arthur that the City Ball was at his disposal for the-hearing. On motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the request of Ben Cope for permission-to construct piers for Dr. Harvey in front of Lot 2, Block 2, Section 5, Balboa Island; Dr. F. A. Remington in front of Lot 150, Block A, East Newport, and one for A. M. Gibbs in front of Lot 5, Block 26, East Side Addition, were allowed subject to the usual restrictions. On motion of Trustee L. S.-Wilkinson seconded by Trustee Fred. W. Young and carried, the communication from G. W. Ritzmiller in regard to bulkhead and bridge on Balboa Island was referred to the Street Committee and Street Superintendent for a recommendation. /; L '�+ The communication from Capt. J. A. Winn with the resignation of Harry Higgs as Motorcycle Officer which he had aocepted, was considered and on motion of Trustee L. S. Wilkinson seconded by Trustee F. Be Modjeska and carried, the request of the Newport Beach Lumber Co. asking that 28th Street be opened up for traffic, was referred to the Street Superintendent and City Engineer to take up with the Pacific Electric Railway Co. On motion of Trustee L. S. Wilkinson seconded by Trustee H. H. Williamson and carried, the application of Ernest 14c Cormack for license to have some ponies on the beach for children to ride was referred to the City Marshal for investigation and report. On motion of Trustee F. B. Modjeska seconded by Trustee H. H. Williamson and carried, the application of Lee Uright for license to operate a merchandise wheel at Balboa, was allowed. On motion of Trustee Fred W. Young seconded by Trustee H. H. Williamson and carried, the application of S. L. Hoke for license . to sell fireworks at 15th Street, was allowed. On motion of Trustee H. H. Williamson seconded by Trustee F. Be Modjeska and carried, the application of A. G. Van Horn for license to operate a merchandise wheel at Balboa Pavilion, was allowed. On motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, the application of Airs. E. Grosgau for license to sell popcorn on the street, was denied. On motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the application of Ring S. Beardsley for license to operate two football amusement games at Balboa was allowed. On motion of Trustee H. H. Williamson seconded by Trustee, Fred W. Young and carried, the license for the football amusement game was placed at $25.00 per annum for each game. On motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, the application of C. V. Hutchings for license to operate a merchandise wheel, was allowed. On motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and carried, the application of Arthur G. Lyons for license to do boat building and repairing in Tract 444,.was allowed. On motlon,of.Trustee Fred W. Young seconded by Trustee F. B. Modjeska and carried, the application of Mrs. C. C. Maloney.for license to sell Sandwiches, cold drinks, etc. at 804 Serf Avenue, was allowed. ,On motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, the application of Ce P. Berges to sell horoscopes at Balboa was referred to the City Marshal for investigation and report. The request of 18 business men of Newport Beach asking that Cveorge Hiner be allowed to tap the lighting circuit on the wharf for .a spot light to aid in oatching.bait, was considered and on motion of Trustee Fred W. Young seconded by Trustee F. Be Modjeska and carried, the request was allowed by his paying for the electricity used. On motion of Trustee Fred W. Young seconded by Trustee H. H. Williamson and carried,.the application of Ben Cope for permission to construct piers for T. L. Tally, R. N. Fricke and Louis Cass, were referred to the City Engineer. . The communication from City Auditor Brhggs giving su ggestions of what the yearly audit by outside Auditors should cover, was-con- sidered, and on motion of Trustee H. H. Williamson seconded by Trustee Fred W. Young and carried, the Clerk Was instructed to notify the Albin E. Johnson Co. to make their audit along the lines suggested_ by Mr. Briggs. City Engineer Kressly reported that Walker & Martin of Fullerton were the lowest responsible bidders for the work to be performed under Resolution of Intention No. 427, and thereupon Trustee H. H. Williamson presented and moved the adaption of RESOLUTION NO. 433 entitled: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH AWARDING THE CONTRACT FOR CERTAIN WORK ON CERTAIN PORTIONS OF COAST BOULEVARD AND CERTAIN OTHER STREETS WITHIN SAID CITY, ''Y7 41119 Which motion was seconded by Trustee L. Young introduced a Resolution entitled: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH APPOINTING A TIME AND PLACE FOR HEARING PROTESTS IN RELATION TO THE PROPOSED IMPROVEMENTS .CONTEMPLATED UNDER RESOLUTION OF INTENTION NO. 429 of THE BOARD OF TRUSTEES OF SAID CITY, PASSED ON MAY 31, 1927- The Resolution was read, considered, designated RESOLUTION NO. 434 and upon call of the roll passed by the following vote: AYES, Trustees L.S.Wilkinson, F.B.Modjeska, Fred W.Young, H. H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. UNFINISHED BUSINESS ORDINANCE N0. 323, entitled: AN ORDINANCE AMENDING SECTION 14 AND ADDING A NEW SECTION TO ORDINANCE N0. 322 OF THE CITY OF NEWPORT BEACH came up for final passage, was read and considered and upon call of the roll passed by the following vote: AYES, Trustees L.S.Wilkinson, F.B.Modjeska, Fred W.Young, H. H. Williamson, Conrad Richter. NOES, Trustees None. ABSENT, Trustees None. Trustee F. Be Modjeska introduced an Ordinance as follows: AN ORDINANCE OF THE CITY OF NEWPORT BEACH PRESCRIBING UNIFORM DEEDS FOR GRANTING TO SAID CITY, LANDS SOLD TO IT FOR NON- PAYMENT OF TAXES AND PRESCRIBING THE PROCEDURE FOR THE SALE OF SUCH LANDS BY THE CITY OF NEWPORT BEACH. The Ordinance was read, considered, designated Ordinance No. 324 and referred to the City Attorney. On motion of Trustee H. H. Williamson seconded by Trustee Fred W. Young and Carried, the City Attorney was allowed one months leave of absence. On motion of Trustee H. H. Williamson seconded by Trustee F. Be Modjeska and oarried, the Board allowed not to exceed $1,000.00 for the purchase of $19,0000O.worth of bonds with premium for the gas fund. The Bap of Tract No. 847 was brought up for reconsideration, and on motion of Trustee H. H. Williamson seconded by Trustee Fred W. Young and carried, the-Map was to be approved when the alley was widened 2J feet along Lot 25. On motion of Trustee L. Be Wilkinson seconded by Trustee H. H. Williamson and carried, the Chairman of the Library Board was authorized to inorease the insurance on the Library and books from $1600.00 to $3v000.00.
