S. Wilkinson, Fred W. Young, H. H. Williamson, Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilman F. B. Modjeska. The matter of the proposed. tideland suits was taken up, and ' the City Engineer presented maps and a report of the location of mean high tide of the Pacific Ocean in Newport Bay. After a full consid- eration of the report and examination of the maps presented, Councilman Fred W. Young introduced RESOLUTION NO. 446 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT .BEACH ACCEPTING AND APPROVING THE REPORT-OF-THE CITY ENGINEER OF SAID CITY, AND ORDERING AND DIRECTING SAID ENGINEER.TO FURNISH THE CITY ATTORNEY OF SAID CITY WITH A DESCRIPTION`AND MAPS OF THE.LINE OF MEAN HIGH TIDE OF THE PACIFIC OCEAN IN NEWPORT BAY, IN ACCORDANCE WITH THE REPORT MADE BY THE-SAID CITY ENGINEER TO THE CITY COUNCIL, AND ORDERING AND DIRECTING THE CITY ATTORNEY TO FILE SUCH ACTION OR ACTIONS IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA, IN AND-FOR THE COUNTY OF ORANGE, FOR THE PURPOSE OF DETERMINING SAID MEAN HIGH TIDE LINE, THUS OFFICIALLY ESTABLISHING THE BOUNDARY LINE BETWEEN LANDS IN PRIVATE OWNERSHIP AND BETWEEN LANDS IN PUBLIC OWNERSHIP. The Resolution was read, considered and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen L. S. Wilkinson, Fred W. Young, H. H. Williamson,.Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilman F..B..Modjeska. The contracts with Gordon Whitnall for zoning the Cijy were considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the President of the Board and City Clerk were instructed to sign the contracts. There being no further business on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Willi and carried, the meeting adjourned. Appr &ved February 6, 1925. Mayori Ci y of Newport Beach. City Clerk. City Hall, Newport Beach, February 6, 1925. The City Council of the City.of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Conrad Richter. The moll was called showing all members present except 1 Councilman F. B. Modjeska. The minutes of the previous regular meeting of January 9th and of the special meeting of January 25, 1925 were read and approved as read. The reports of the heads of departments were read and on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the reports were accepted and filed. _ Chairman J. A. Beek made a report of the activities-of the Citizens Committee of 15, and.pf'esented a resolution asking for an appropriation of $5,000.00 to start a subscription to do some dredging in the harbor entrance. The matter was fully considered by the Board and a number of those in the audience expressed themselves on the matter. 492 On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, $1,000.00.was set aside to start the subscription for opening the entrance to the harbor, and the Committee was instructed to get as much more as possible. Councilman H. H. Williamson reported that J. K. Smith stated he was going to stand on his contract as .originally made for his fishing barge. The communications were read-and acted upon as follows: The petition for-annexation of a triangular strip in Boulevard Addition to Newport Heights to the City of Newport Beach was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the matter was referred to the City Attorney with instructions to take the necessary steps to call an election for the residents of the district,to vote on the annexation. The communication from C. A. Bachman asking the Council to lease him the camp ground site was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the Chair was instructed to appoint a special committee to investigate same and report at the next meeting. The Committee appointed is Councilmen L. S. Wilkinson,; H. H. Williamson and City Engineer Kressly. On motion..of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the report of the Fire Chief on the fire at West Newport, was accepted and filed. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the communication from Harry E. Blake in regard to water supply problems, was filed. The communication from Mr. Hilburn for King C. Gillette asking that the Council rent him the triangular piece of ground on the south side of his property near the jetty for a period of 20 years to be used as a yard, was considered, and on motion-of Councilman Fred W. Young seconded by Councilman H. H. Williamson and carried, the matter was referred to the above special committee for report. On motion of Councilman H.-H. Williamson seconded by Councilman Fred W. Young and carried, the communication from the Pacific Electric Railway Co. thanking the Council for their cooperation in regard to the traffic buttons, was filed. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the communication from Weil, Roth & Irving in regard to buying city bonds was filed. On motion of Councilman Fred W. Young seconded by Councilman H. H. Williamson and carried, the communication from Edmund ®. Eastman asking to be employed in mapping out the future of Newport Beach, was to be acknowledged with thanks and filed. The second application of Rodger Brothers to lease 500 feet of bay frontage on the north side of the bay, and offering an increase in rental of 50¢ per front foot, was considered, and same was referred to the special committee for investigation and report. The communication from Fred J. Crosier asking the City to vacate a portion of the alley in Block 435 and Black G, Corona Del Mar was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the communication was referred to the special committee for investigation and report. On motion of Councilman Fred W. Young seconded by Councilman H. H. Williamson and carried, the request of the Newport Harbor Chamber of Commerce for an appropriation of 8515.00 for advertising from Feb. 15th to March 15th was allowed. The notice of complaint against the refinery in West Newport signed by 15 residents of West Newport was discussed, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the Clerk was instructed to reply that the city was now boing zoned for business and this matter would probably be taken care of in same. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the request of Ivon Parker, Secretary of the Viking Yacht Club for permission to construct a landing on the north side of-the bay, was referred to the City Engineer for report on same. On motion of Councilman H. H. Williamson seconded by Councilman L. S. Wilkinson and carried, the communication from the Municipal Assessment Spreading Co. was filed. On motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the communication from R. Arnold for more playground equipment and tables, was referred to the Street Superintendent for a report. 493 On motion of Councilman H. H. Williamson seconded by Councilman L. S. Wilkinson and carried, the communication of Lew H. Wallace in regard to straightening out some property in Seashore Colony Tract, was referred to the City Attorney and City Engineer for consideration and report. On motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the communication from Wm. R. Staats Co. in regard to bonds was filed. The communication from the League of California Municipalities suggesting that the Council instruct the publisher of our official newspaper to send two copies of all printed ordinances to the League, was discussed, and Oouncilman L. S. Wilkinson presented a Resolution entitled: A RESOLUTION PROVIDING THAT TWO PRINTED COPIES OF ALL ORDINANCES SHALL BE SENT TO THE LEAGUE OF CALIFORNIA MUNICIPALITIES. The Resolution was read, considered, designated RESOLUTION NO. 447 and upon call of the roll passed by the following vote: AYES, Councilmen L. S. Wilkinson, Fred W. Young, H. H. Williamson, Mayor Conrad Richter.. NOES, Councilmen None. ABSENT, Councilman F.-B. Modjeska. . . On motion of Councilman Fred W. Young seconded by Councilman A. H. Williamson and carried,. the request of Virginia R. Leffingwell for permission to construct a pier in front of Lots 1 and 2, Block 25, Balboa East Side Division, was referred to the-City Engineer for Deport. On motion of Councilman Fred W. Young seconded by Councilman H. H. Williamson and carried, the communication from George Bauer in, regard to automobiles parking in front of the entrance to his apartments for a considerable length of time,.was referred to the Chief of Police for investigation. On motion of Councilman Fred W. Young seconded by Councilman L. S. Wilkinson and carried, the request of Harry H. Williamson for transfer of his real estate license from 1915 West Central to 127 30th Street, was allowed. The communication from Frank L. Mathews asking to lease a strip of property at the westerly end of Bay Avenue for.selling boats, was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the communication was referred to the special committee for report. On motion of Councilman Fred W. Young seconded by Councilman L. S. Wilkinson and carried, the application of I. A. Smith for a license to sell lunches, candy, etc. at 800 Surf Avenue, was granted. On motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the application of J. S. Peterson for license on a gum vending machine, was allowed by his paying the regular license fee for vending machines. The communication from A. M. Gibbs asking the abandonment of Bay Avenue from F to L. Streets and widening the alley between the -same streets ten feet, accompanied by a tracing of same, was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the matter was referred to the special committee with the addition of Street Superintendent Rinegart to the committee. The recall petition signed by 431 residents, 332 of which were verified by the Clerk, was presented for consideration, and on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the petition was referred to the City Attorney to report on at the next meeting. UNFINISHED BUSINESS. ORDINANCE NO. 329, entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH PRESCRIBING A LICENSE FOR THE OPERATION OF CERTAIN KINDS OF BOATS IN THE CITY OF NEWPORT BEACH, AND PRESCRIBING A PENALTY FOR ALL VIOLATIONS THEREOF, came up for final passage, the Ordinance was read, considered, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen L. S. Wilkinson, Fred W. Young, H. H. Williamson, Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilman F. B. Modjeska. M', t, City Attorney Fdeat stated that as near as he could determine in consultation with Gordon Whitnall, the Park Board should be a part of the Planning Commitsions work, and he would suggest delaying the matter until the zoning of the City was completed, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the report was accepted and the recommendation to be acted upon. NEW BUSINESS. Councilman L. S. Wilkinson introduced an ordinance fixing the compensation of the City Clerk. The ordinance was read, considered, designated Ordinance No. 330 and referred to the City Attorndy. .Councilman H. H. Williamson introduced an ordinance repealing ordinances No. 327 and 328 of the City of Newport Beach and all proceedings had thereunder. The ordinance was read, considered, designated Ordinance No. '331 and referred to the City Attorney. It was reported that the City Electrician was a little careless in inspecting some of the new buildings and which jeopardized the insurance. On motion of Councilman Fred W. Young seconded by Councilman L. S..Wilkinson and carried, the Clerk was.instructed to notify him that all work must be inspected according to Section 8 of Ordinance No. 63. The demands of the Fire Department which were raised from $5.00 to $10.00 were considered., and on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, that in this instance where extraordinary service was rendered, the demands were allowed at $10.00. On motion of Councilman L. S.. Wilkinson seconded by Councilman H. H. Williamson and carried, $90.87 was transferred from the current expense unappropriated fund to account No. 328 city owned property. on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the two demands of the Life Saving Department were to be allowed after proper endorsement by the head of the department. on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the demand of Le Uoyne Ellis was to be allowed and warrantvdrawn and delivered upon receipt of an explanation of the charge. No action was necessary on the demand of Bob McWhorter as it had been previously denied. On motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the demands which were in proper form and approved by the Finance Committee, were allowed and warrants to be drawn for same. Miss U. Vertrees objected.to the assessment district as made for the construction of a foot bridge on Corona Del Mar. No action was taken at this time as the matter was to be called to the attention of the City Engineer. There being no further business on motion of Councilman Fred W. Young seconded by Councilman H. The special committee appointed at the last meeting reported on the several matters referred to them, and on motion of Councilman Fred W. Young seconded by Councilman F. S. Modgeska and carried, the report was accepted and the Committee discharged.
