HomeMy WebLinkAbout07-16-1928 - Special Meeting41 City Hall, Newport Beach, July 16, 1928. The City Council of the City of Newport Beach met in regular adjourned session at 7:30 otclock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing.all members present except Councilman Ellsworth. The minutes of the previous meeting were read and approved. Councilman Hilmer reported on the application of E. D. Burge to construct a 14 foot extension on the Washington Street Wharf, that one of the property owners adjoining intends to build a pier in front of his property which could not be done if the Burge request were granted. Therefore on motion of Councilman Hilmer seconded by Councilman Claire and carried, the application of 1r. Burge was denied. The communication of the Citizens Harbor Committee recommending that all pipe crossings to Lido Isle be confined to the area between 4th and 9th Streets, East Newport, was considered, and on motion of Councilman Hilmer.seconded by Councilman Claire and carried, the recommendation of the Harbor Committee was accepted., and permission granted to the Southern Calif. Edison Co. on the basis named. The communication from Mr. Frost, District Manager of the Southern Calif. Edison Co. expressing their willingness to raise their wires leading to Balboa Island across the channel was considered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, temporary permission was granted to Southern Calif. Edison Co. to raise the wires leading to Balboa Island. The communications were read and acted upon as follows: A number of complaints and protests to the way the speed and motor boats were allowed to operate on the bay were considered•carefully and those present expressing themselves were opposed to them. After,due consideration on motion of Councilman Hilmer seconded by Councilman Claire and carried, the Chief of Police was instructed to enforce the harbor regulation ordinances and especially Section 3 of Ordinance # 234. On motion of Councilman Hilmer seconded by Councilman Claire and.carried, the communication from Lee Pfau was returned to E. C. Kersey ' to whom it was addressed. On motion of Councilman Claire seconded by Councilman Williamson and carried, the application of J. H. Long for license to smoke and sell fish at 515 - 30th Street was allowed. On motion of Councilman Hilmer seconded by Councilman Williamson and carried, the application of G. K. Huber for license to operate an ice cream wagon was denied. The communication from R. F. Goudey complaining of the odor from our septic tank was considered, and on motion of Councilman Wiliamson seconded by Councilman Hilmer and carried, the matter was referred to the City Engineer and Health Officer. The communication from the Realty Investigation Syndicate in regard to their suit to quiet title to Lots 1 and 2 in Tideland Location No. 267 was considered, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the communication was referred to the City Attorney for any action he thinks best or advisable. On motion of Councilman Williamson seconded by Councilman Claire and carried, the request of the Palisades Club on Corona Del Mar to place a float in front of their boathouse on Corona Del Mar, was referred to the City Engineer for report in the customary two weeks. On motion of Councilman Claire seconded by Councilman Williamson and carried, the communication of the Balboa Island Improvement Assn. in regard to mosquitos was filed. The communication from the Parent Teachers association asking that the first unit of the new library building be constructed this summer was considered, and on motion of Councilman Hilmer seconded by Councilman Williamson and carried, the communication was referred to the Library Committee. On motion of Councilman Williamson seconded by Councilman Claire and carried, the communication from Jos. A. Bodman in regard to a defective sidewalk on 33d Street, was referred to the Street Committee and Street Superintendent for attention.. On motion of Councilman-Williamson seconded by Councilman Claire and carried, the communication from the Boulder Dam Association in regard to the meeting at Long Beach July 21st, was filed. 42 On motion of Councilman Williamson seconded by Councilman Claire C and carried., the communication from the Calif. Water Resources Assn. in regard. to Assembly Constitutional Amendment No. 27, was filed. On motion of Councilman Williamson seconded by Councilman Claire and carried, the request of ;silo D.•Eames for permission to construct a pier in front of Lot 26, Block 1, Section 5, Balboa Island was allowed subject to the will of the Council. The communication from the Newport Harbor Chamber of- Commerce in regard to the Deraga Weather Station was considered, and on motion of Councilman Williamson seconded by Councilman Hilmer and carried, the matter was referred to the Committee appointed at the last meeting, Councilman Ellsworth, for report at the next meeting. UNFINISHED BUSINESS. City Attorney Thompson brought up the matter of a condemnation suit which was filed several years ago to condemn a 10 foot right -of -way across the Rancho Los Balsas for a water pipe line, and which suit was settled. out of court but the suit was never dismissed. The matter was considered and Councilman Hilmer introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ABANDONING ALL PROCEEDINGS TAKER? UNDER ORDINANCE N0._ OF SAID CITY OF NEWPORT BEACH, AND AUTHORIZING AND DIRECTING THE CITY ATTORNEY OF SAID CITY OF NEWPORT BEACH TO DIS&ISS CERTAIN CONDEMNATION PROCEEDINGS TAKEN UNDER SAID ORDINANCE NO. AS AFORESAID, BEING CASE NO. 13707 IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF ORANGE. The Resolution was read, considered, designated RESOLUTION r10. 465 and upon call of the roll passed by the following vote: AYES, Councilman Hilmer, Claire, FJilliamson, Johnson, NOES, Councilmen None. The lease with John Loth for the live bait concession on Balboa pier inras• presented, and Councilman Claire introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL-OF THE CITY OF idE'.'i'PORT BEACH GRANTING A WRITTEN LEASE TO JOHN LOTH OF NEF,PORT BEACH, ' GRANTING HIM THE EXCLUSIVE PIER RIGHTS TO HAVE AND TO SELL LIVE BAIT ON THAT CERTAIN PIER OWNED BY THE CITY OF NEkJPORT BEACH, BEING THAT PIER I "JHICH EXTENDS INTO AND OVER THE PACIFIC OCEAN FROM THE SOUTHERLY END OF MAIN STREET, BALBOA, BEING THE WHARF ERECTED BY THE FUNDS OF MUNICIPAL IMPROVEMENT DISTRICT NO. 1 OF THE CITY OF NEWPORT BEACH, FOR A PERIOD OF THREE YEARS, UPON CERTAIN CONDITIONS SET FORTH IN A 'CRITTEN CONTRACT THIS DAY PRESENTED TO THE CITY COUNCIL, AND AUTHORIZING THE MAYOR OF SAID CITY AND THE CITY CLERK OF SAID CITY TO EXECUTE SAID CONTRACT FOR SAID CITY. The contract with Foster & Kleiser Co. for the erection of a 50 x 75 foot sign board for Lido Isle was presented, and Councilman Williamson introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NE }PPORT BEACH GRANTING TO FOSTER & KLEISER CO. A CERTAIN FRANCIISE OR LICENSE TO ERECT, CONSTRUCT AND MAINTAIN A BILLBOARD FOR CERTAIN SPECIFIED ADVERTISING ON CITY OMNED PROPERTY, AND AUTHORIZING THE MAYOR OF SAID CITY AND THE CLERK OF SAID ' CITY TO EXECUTE SAID CONTRACT IN THE NAME OF THE CITY OF NEWPORT BEACH. The Resolution was read, considered, designated RESOLUTION NO. 467 and upon call- of the roll passed by the following vote: AYES, Councilmen Hilmer, Claire, Williamson, Johnson. NOES, Councilmen None: ABSENT, Councilman Ellsworth. The lease of George C. Hiner covering the live bait concession on the Newport pier, was considered, and Councilman Hilmer introduced a Resolution entitled: A RESOLUTION OF THE CITY COUiiCIL OF THE CITY OF NEWPORT BEACH GRANTING A 'iRITTEN LICENSE TO GEORGE C. HINER, GRANTING HIM THE EXCLUSIVE PIER RIGHTS TO HAVE AND SELL LIVE BAIT ON THAT CERTAIN PIER OPINED BY THE CITY OF NEWPORT BEACH, BEING THE STRUCT➢IRE ACgUIRED FROK THE SOUTHERN PACIFIC RAILROAD CO;iPANY, BY THE FUNDS OF MUNICIPAL IMPROVEMENT DISTRICT NO- 2 OF THE CITY OF NEWPORT BEACH, FOR A PERIOD OF THREE YEARS, UPON CERTAIN CONDITIONS SET FORTH IN A VIRITTENI CONTRACT THIS DAY PRESENTED TO THE CITY COUNCIL, AND AUTHORIZING THE MAYOR OF SAID CITY AND THE CITY CLERK OF SAID CITY TO EXECUTE SAID CONTRACT FOR SAID CITY. The lease of William Howard covering the Newport City Dump Ground was considered, and Councilman Williamson introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH GRANTING A WRITTEN LICENSE TO 1rILLIAD! HOWARD OF NEWPORT BEACH, TO OPERATE THE CITY DUMP GROUNDS FOR A PERIOD OF ONE YEAR, UPON CERTAIN CONDITIONS SET FORTH IN A nITTEN CONTRACT, THIS DAY PRESENTED TO THE CITY COUNCIL, AND AUTHORIZING THE MAYOR OF SAID CITY AND THE CITY CLERK OF SAID CITY TO EXECUTE SAID CONTRACT FOR SAID CITY. The Resolution was read, considered, designated RESOLUTION NO. 469 and upon call of the roll passed by the following vote: AYES, Councilmen Hilmer, Claire, Williamson) Johnson. NOES, Councilmen None. Jordan referred to nails stEcking up in the board. cidc,;alk on the ocean front between Main and Palm Streets, on which a lady fell and injured her wrists, and the Street Department were instructed to investigate and remedy it. There being no further business on motion of Councilman Hilmer seconded by Councilman Williamson and carried, the meeting adjourned Sine Die. n Approved August 62 1925. City Clerk. The reports of the heads of the departments were read and on motion of Councilman Claire seconded by Councilman Ellsworth and carried the reports were accepted and filed. -The matter of discontinuing the weather station on Corona Del Mar was considered, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the Chair was instructed to appoint a committee of one to investigate the matter of City owned property at the weather station and report at the next meeting. Councilman Hilmer was appointed as the Committee. Councilman Hilmer referred to a number of gasoline stations having been installed in the parkways or on the sidewalk in different
