On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the request of 'dater Superintendent Patterson for
transfer of $904.63 from various accounts to other accounts in his
budget, was granted.
U14FINISHED BUSINESS.
The contracts with the Newport Beach Boat Builders, Inc. for
dredging approximately 20,000 cubic yards of sand from the harbor
entrance, were presented by City Engineer Patterson and on motion of
' Councilman Ellsworth seconded by Councilman Claire and carried, the
City Attorney was given one week's time to check over the contracts.
NEW BUSINESS.
The regaest of City Treasurer Gant for transfer of accruals
on seven different assessments to the 1915 act assessment fund was
considered, and on motion of Councilman Claire seconded by Councilman
Hilmer and carried, the transfers were allowed.
On motion of Councilman Williamson seconded by Councilman
Claire and carried, the demands as signed and approved by the Finance
Committee were allowed and warrants to be drawn for same.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, that part of the office of Chief of Police making him the
head of the Life Guard Service was declared vacant.
On motion of Councilman Claire seconded by Councilman Ellsworth
and carried, Fire Chief Crocker was appointed head of the Life Guard
Service at an additional salary of $5.00 per month.
There being no further business on motion of Councilman Claire
seconded by Councilman Williamson and carried, the meeting adjourned to
7;30 o'clock P. M. on Monday, May 13, 1929.

City Hall, Newport Beach, May 13, 1929.
The City Council of the City of Newport Beach met in regular
adjourned session at 7;30 o'clock P. M. on above date. The meeting was
called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved as
read.
The Building Inspector was not ready to report. on the Uniform
Building Code and was granted additional time.
' City Attorney Thompson reported that the only ordinance he
could find in regard to Dance Halls was the one prohibiting the playing
of any musical instruments between the hours of 1 and 6 o'clock A. M.,
and on motion of Councilman Ellsworth seconded by Councilman Claire and
carried, the report was accepted and filed.
The contracts with the Newport Beach Boat Builders for doing
dredging in the harbor entrance accompanied by the Labor and Material and
faithful performance bonds were considered, and on motion of Councilman
Ellsworth seconded by Councilman Claire and carried, the contracts were
accepted and the Mayor of the City was authorized to sign the same on
behalf of the City.

The matter of allowing the application of Lou Schneider
to rent ponies and goats at Palm and Ocean Front, Balboa was con-
sidered, and on motion of Councilman Ellsworth seconded by Council-

the Public Administration Short Course of the University of Southern
California were considered and on motion of Councilman Williamson
seconded by Councilman Claire and carried, the communications were
filed.
On motion of Councilman Ellsworth seconded by Councilman '
Hilmer and carried, the communication from Sawyers White Garage
describing the White Truck, was referred to the Street Committee
for consideration.
On motion of Councilman Claire seconded by Councilman
Williamson and carried, the communication from the Boulder Dam
Association calling attention to their sixth annual meeting at Long
Beach, May 18th, was filed.
On motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the two communications from E. B. Tozier and
Edwin L. Kirkpatrick in regard to band music for the summer, was
referred to the Chamber of Commerce for consideration.
The communication from the Balboa Yacht Club asking per-
mission to install marine ways at their club property at the east
end of Balboa Island was considered at length, but on motion of
Councilman Claire seconded by Councilman Hilmer and carried, the
request was denied.
The communication from-Mrs. Frances C. Goepper protesting
against the dirting and oiling of Bay Avenue between Main Street and
A Street, Balboa, was considered, but as it was necessary to relieve
congestion on motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the Street Superintendent was instructed to
proceed with the work as soon as convenient.
The communication from the W. C. T. U. asking that an
ordinance be passed prohibiting the sale of Wine Tonic, and enclosing
a copy of the Long Beach Ordinance and Court Decree on same was '
considered, and on motion of Councilman Ellsworth seconded by Council-
man Williamson and carried, the matter was referred to the City
Attorney for a report.
On motion of Councilman Claire seconded by Councilman Ells-
worth and carried, the application of Ralph E. Devine and G. H.
Shomaker for permission to rent beach umbrellas and chairs on the
beach, was denidd.
On motion of Councilman Hilmer seconded by Councilman Claire
and carried, the demand of Herbert Grensted for refund of taxes on
Lot 8, Block 109, Section B, not being approved by the City Attorney,
was not allowed.
The communication from L. E. Willer, ;Mayor of Anaheim,
inviting the Board to a meeting there on May 16th was considered, and
on motion of Councilman Hilmer seconded by Councilman Claire and
carried, the Clerk was instructed to notify him that as many as
possible would be present.
On motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the communication from Chas. A. Whitmore,
Private Secretary to the Governor, acknowledging receipt of the
letter sent the Governor, was filed.
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the application of B. P. Newman for license'
to operate an electric flasher next to Hormens Fish Market was granted.
The communications from the Chamber of Commerce and R. H.
Peck in regard to the improvement of the alley in West Newport from '
37th Street to the City limits was considered, and on motion of
Councilman Williamson seconded by Councilman Hilmer and carried, the
matter was referred to the City Attorney and City Engineer for prompt
action of some kind, and to make a report on same at the next meeting.
The communication from the Chamber of Commercd suggesting
soliciting aid from neighboring cities and organizations interested
in securing an engineer to make a report on the effect of -the proposed
Orange County Flood Control on our water supply was considered, and
on motion of Councilman Ellsworth seconded by Councilman Claire and
carried, the City Engineer and Mr. Macleod and H. L. Sherman were
appointed to work in conjunction with the Chamber of Commerce
Committee in the employment of a competent engineer at an expense
not exceeding ;500.00, to make a report on the effect of the proposed
flood control would have on our water supply system.

On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the Clerk was instructed to prepare a letter for the
Mayor's signature notifying Laguna Beach, Iiuntington Beach, Costa
:.esa, Fairview Farms Water Company and Newport Heights Irrigation
District, that the City of Newport Beach had appropriated $500.00
towards the expense of employing an experienced engineer to make a
report as to the effect the proposed flood control would have on the
water supply in this district, and asking them to join us in same.
On motion of Councilman Hilmer seconded by CouncilmanClaire
and carried, the communication from the Chamber of Commerce favoring
the City retaining ownership of streets, promenades and water front
property was filed.
On motion of Councilman Hilmer seconded by Councilman Claire
and carried, the resolution of the City Planning Commission favoring
the abandonment of Bay Avenue between Main and A Streets, Balboa, was
filed.
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the application of Singleton Smith for permission
to construct a pier in front of Lots 1 and 2, Block 6, Section 1,
Balboa Island was granted.
The communication from N. T. Edwards asking for some infor-
mation in regard to the tideland bill sent him by CityAttorney Thompson
was considered, and on motion of Councilman Williamson seconded by
Councilman Claire and carried, the Mayor and City Attorney were instruct
ad to give him the information desired.
NEW BUSINESS
A deed dated the 27th day of April, 1929, from the LA HABRA
VALLEY LAND AND WATER COMPANY, a corporation, to the CITY OF NEWPORT
BEACH, a municipal corporation, granting in fee to said City of Newport
Beach by grant deed all that certain real property situated and beirg
in the City of Newport Beach, County of Orange, State of California,
and more particularly described as follows, to -wit:
Lot "B", Lot "C" and Lot "E" of "Tract No. 919 ", as
shown on a map recorded in Book 29, pages 31 -34 of
' Miscellaneous Maps, Records of Orange, County,
California,
was presented to the City Council of the City of Newport Beach, Calif-
ornia,
WHEREUPON, Trustee Ellsworth made a motion, duly seconded by
Trustee Williamson, and carried, that said deed by accepted by said City
Of Newport Beach, and the Clerk instructed to record the same forthwith
with the County Recorder of the County of Orange, State of California.
That said motion was carried by the following vote, to -wit:
AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson,Johnson,
NOES, Countilmen None.
ABSENT,.Councilmen None.
I hereby certify the foregoing to be a true extract from the
minutes of the City Council of the City of Newport Beach, at aregular
meeting held on the 13th day of May, 1929.

Councilman Harry H. Williamson introduced a Resolution
entitled:
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH TERMINATING THAT CERTAIN LEASE AADE AND ENTERED
INTO BETWEEN SAID CITY.AND WILLIAM HOWARD, THE 16th
DAY OF JULY, 1928.
' The Resolution was read, considered, designated RESOLUTION NO.
504 and upon call of the roll passed by the following vote, to -wit:
AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson,Johnson.
NOES, Councilmen None.
ABSNET, Councilmen None.
The lease of E. G. and H. u:. Greeley covering the Newport
Beach City Dump Ground was considered and on motion of Councilman Willi -
son seconded by Councilman Ellsworth and carried, the least was accepted
and the Mayor of the City Authorized to sign the same on behalf of the
City of Newport Beach.

The Zoning Yap and Ordinance was taken up and discussed,
but inasmuch as there were anumber of discrepancies in both the Map
and Ordinance, on motion of Councilman Williamson seconded by
Councilman Ellsworth and carried, the Map and Ordinance were
referred to the City Engineer to take up with Mr. Whitnall and have
it out in proper shape for presentation to this Board at the regular
meeting on July 1st, 1929.
There being no further business on motion of Councilman
Williamson seconded by Councilman Ellsworth and carried, the meeting
adjourned to 7 :30 o'clock P. M. on Monday, May 20, 1929.

The City Council of the City of Newport Beach met in
regular adjourned session at 7:30 o'clock P. M. on-above date. The
meeting was called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved '
as read.
Councilman Ellsworth reported that the Street Committee
would recommend that Bay Avenue between Main and A Streets, Balboa,
be dirted and oiled not to exceed 20 feet in width and to be for
one way traffic only and no parking to be allowed on same. No
action was taken at this time as the Street Superintendent had
previously been instructed to go ahead with the work.
City Engineer Patterson asked for more time to report on
the alley situation in West Newport as he had arranged a date to
take up the matter again -:with D. W. Pontius this week, which was
granted.
The communications were read and acted upon as follows:
On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the communication in regard to the Panning and
Zoning meeting of the Public Administration Short Course of U. S. C.
was referred to the Chairman of the Planning Commitsion for investi-
gation and filing.
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the communication in regard to Chemistry and `
Testing of the U. S. C. Short Course, was referred to the Health
Officer for investigation and filing.
The application of Ficholson & Turck for license to operate
a wholesale and retail fresh fish market and also to nreserve fish,
was considered, and on motion of Councilman Ellsworth seconded by
Councilman Williamson and carried, the application was granted subject '
to the same being revoked within 30 days after a hearing is made and
sustained.
The communication from Ralph S. Baverstock in defense of
the Garnet Street vier on Balboa Island was discussed, and on motion
of Councilman Claire seconded by Councilman Williamson and carried,
the communication was filed.
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the communication from Faulkner, Oakes &
Faulkner in regard to auditing the City books was filed.
