Home My WebLink About05/20/1929 - Adjourned Regular Meeting106 The Zoning Map and Ordinance was taken up and discussed, but inasmuch as there were anumber of discrepancies in both the Map and Ordinance, on motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the Map and Ordinance were referred to the City Engineer to take up with Mr. Whitnall and have it put in proper shape for presentation to this Board at the regular meeting on July 1st, 1929. There being no further business on motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the meeting adjourned to 7 :30 o'clock P. M. on Monday, May 20, 1929. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. Councilman Ellsworth reported that the Street Committee , would recommend that Bay Avenue between Main and A Streets, Balboa, be dirted and oiled not to exceed 20 feet in width and to be for one way traffic only and no parking to be allowed on same. No action was taken at this time as the Street Superintendent had previously been instructed to go ahead with the work. City Engineer Patterson asked for more time to report on the alley situation in !`'est Newport as he had arranged a date to take up the matter again :Jith D. W. Pontius this week, which was granted. The communications were read and acted upon as follows: On motion of Councilman Williamson seconded by Councilman Hilmer and carried, the communication in regard to the Panning and Zoning meeting of the Public Administration Short Course of U. S. C. was referred to the Chairman of the Planning Commitsion for investi- gation and filing. On motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the communication in regard to Chemistry and Testing of the U. S. C. Short Course, was referred to the Health Officer for investigation and filing. The application of 1:icholson &'Turck for license to operate a wholesale and retail fresh fish market and also to preserve fish, was considered, and on motion of Councilman Ellsworth seconded by Councilman Williamson and carried, the application was granted subject to the same being revoked within 30 days after a hearing is made and ' sustained. The communication from Ralph S. Baverstock in defense of the Garnet'Street pier on Balboa Island was discussed, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the communication was filed. On motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the communication from Faulkner, Oakes & Faulkner in regard to auditing the City books was filed. C; s 1.07 On motion of Councilman Ellsworth seconded by Councilman Williamson and carried, the communication from the Women's Civic League asking that the sale of Wine Tonic be prohibited in the City was referred to the City Attorney. On motion of Councilman Claire seconded by Councilman Williamson and carried, the application of John Fallert for transfer of his busin =.ss license to I. A. Smith was Granted. The communication from ;vary M. George asking for a loading zone in front of her an_artments at 201 East Central Avenue was con- sidered, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the matter was referred to the Police Committee and Chief of Police with power to act. On motion of Councilman Claire seconded by Councilman Williamson and carried, the application of F. A. Stewart for license to operate a Pocket Billiard Game in the Balboa Pavilion was granted. On motion of Councilman Williamson seconded by Councilman Claire and carried, the application of Fairfield & Ireland for license to operate -a lunch counter in the Ocean Front Bathhouse was granted. On motion of Councilman Williamson seconded by Councilman Claire and carried, the application of C. W. Hutchings for license to operate an electric flasher at 107 Main Street, Balboa, was granted. On motion of CouncilmanEllsworth seconded by Councilman Williamson and carried, the communication from the Chamber of Commerce asking that the harbor bond election be called some time during July was filed. The communication from the Chamber of Commerce asking that the City accept the lease of the Pacific Electric Rail,;iay Company covering two 4 foot strips from 19th to Alvarado Streets was considered, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the matter was referred to the City Attorney as to our liability in case of acceptance. UNFINISHED BUSINESS: This being the time fixed by Resolution of Intention No. 503 passed on the 29th day of April, 1929, for hearing protests in the tfiatt of the improvement therein described, and no written protests having been filed with the City Clerk in said matter and no persons present desiring to be heard in the matter of said protests, whereupon Coun (bil- man Hilmer moved that Resolution No. 505 ordering the work, be adopted, which motion was seconded by Councilman Claire and carried by the following vote, to -wit: AYES; Councilmen Hilmer, Claire, Ellsworth, Williamson,Jnhnson NOES, Councilmen None. Ellsworth introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DIRECTING CERTAIN WORK OR IMPROVEMENT TO BE DONE UNDER THE DIRECTION OF THE CITY ENGINEER OF SAID CITY. The Ordinance was read, considered, designated ORDINANCE NO. 360 and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the Ordinance was passed to the second reading. A Deed of Easement to the Southern Counties Gas Company to lay and maintain gas pipes on city property at East Newport was con- sidered, and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the Mayor of the City was instructed to sign the Deed. Councilman Harry H. Williamson introduced an ordinance pro- viding a license for the various businesses carried on in the City of Newport Beach. The ordinance was read, considered, designated Ordinance No. 361 and on motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the ordinance was passed to the second reading. A deed dated the 4th day of January, 1929, from the TITLE INSURANCE AND TRUST COMPANY, a corporation, to the City of Newport Beach, a municipal corporation, granting in fee to said City of Newport Beach, by Corporation Grant Deed, all that certain real property situated in the County of Orange, State of California, and more particularly described as follows, to -wit: Lots A, B, C, D, E, F, G, H, I, J, g, L, M, Y, 0, P, in Tract No. 907, in the City of Newport Beach, Orange County, California, being a subdivision of a portion of Parkinson Island, lying within_ the'boundaries of Sections 27, 28, 33, and 34, and Lots 3 and 6, of said Section 28, all in Township 6 South, Range 10 West, S. B. B. & M., known as LIDO ISLE, Newport Bay. SUBJECT to easements, conditions, restrictions and rights - of -way of record. SUBJECT ALSO to any unpaid taxes for the fiscal year 1928 -29. was presented to the City Council of the City of Newport Beach, California. WHEREUPON, Councilman Ellsworth made a motion, duly seconded by Councilman Claire, and carried, that said deed be accepted by said City of Newport Beach, and the clerk instructed to record the same forthwith with the County Recorder of the County of Orange, State of California. Hyde and others filed in the office of the City Clerk for the creation of a municipal improvement district in the City of Newport Beach, was taken up for action. Witnesses were sworn and testified and from affidavits on file it appears and the City Council finds; 1st. The petition is in writing and is signed by 58 persons each of whom is a qualified elector of the City of Newport Beach and resides within the proposed municipal improvement district, and they collectively constitute more than 10 % of the qualified electors residing therein. 2d. The signatures to the petition are the genuine signatures of the qualified electors signing the petition, and the same were signed on the date therein shown, and the signers reside at the place designated. 3d. The petition contains an accurate description of the exterior boundaries of the proposed district and the same is a part of and within the boundaries of the City of Newport Beach. 4th. The petition sets forth a general description of the public improvement to be acquired and constructed and is such as the City of Newport Beach is authorized by law to acquire and construct. 5th. The said improvementsto be acquired and constructed are necessary and the district described in the petition is benefitted by the said improvements; Thereupon Councilman
