There being no further business on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the meeting adjourn- ed to 7 :30 o'clock P. y?. on Monday, May 12, 1930. Approved, May 12th, 1930. City Clerk. City Hall, Newport Beach, May 12, 1930. The City Council of the City of Newport Beach met in regular adjourned session at 7 :30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read, City Engineer Patterson reported that the old sidewalk at Palm and Bcy Front was undoubtedly on private property, and the City could quit -claim it back to them, but they should give the City an easement to the present walk. The matter was considered and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the City Attorney and City Engineer were instructed to draw up the necessary papers covering the easement and deed. Councilman Claire reported that the boats on the westerly side of the '.7ashington Street pier were tied to a private pier and nothing could be done. He would investigate the easterly side also. On motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the regular order of business was suspended for a hearing on the matter of application of Geo. Carandanis for license to operate a lunch room at 104 Main Street, Balboa; Attorney 0. A. Jacobs of Santa Ana representing, Geo. Carandanis. The petition filed against the issuance of the license sign- ed by 21 merchants of Balboa was read, and City Attorney Thompson requested that it be filed as evidence in the case. Fire Chief Crocker, Chief of Police Hodgkinson, Health Officer Dr. G. M. Grundy, Fred W.'Young and Geo. Carandanis were sworn and testified in the matter. No other witnesses being present, the Council proceeded to consider the matter, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the license was denied. On motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the regular order of business was resumed. The communications were read and acted upon as follows: On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the request of Severin Anderson and Jack Wright for transfer of their Contractors license to Jack Wright only, was granted. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the application of D. W. Humason for '.icense to operate an electric flasher at 118 Main Street, Balboa, Was granted subject to;the approval of the Chief of Police. On motion of Councilman Ellsworth seconded by Councilman Claire and carried, the application of H. S. Bardsley for license to `operate a ,::iniature Golf Course was laid over for another week. The resignat on of H. L. Sherman and L. W. BriC,rs as members of the Planning Commission were considered, and on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the resignations were accepted and the Clerk instructed to .rite a letter 212' of regret at their action, and expressing appreciation for their efforts while a member of the Planning Commission. A petition signed by E8 residents of Corona Del I•:ar asking that the beach front in front of Block B be bought or condemned, was consider- ed, anc on motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the City Attorney was instructed to quiet title to this frontage. On motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the Street Superintendent was instructed to provide three drinking fountains for the stairways leading down to the beach on Corona Del Mar. That part of the petition asking for some toilet facilities on the beach on Corona Del :.:ar was considered, and Health Officer Grundy thought temporary toilets should be provided, and on motion of Council- , man Ellsworth seconded by Councilman Claire and carried, the matter was referred to the Sewer Committee with the City Engineer and Health Officer to make an estimate of the cost for temporary toilets on Corona Del Mar. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the request of E. H. Day for permission to construct a pier in front of Lot 1, B1ock.109,'Section B, Newport Beach, was re- ferred to'the City Engineer for the customary two weeks. The application of I ,arguerite Dickinson to change her Minia- ture Golf.Course frofa Lots 8 & 9, Block 7, Balboa Tract to Lots 8, 9 and 10, Block 4, Balboa Tract was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the application was laid on the table for one week. On motion of Councilman Claire seconded by Councilman Garfield and carried, the request of Dan O'Hanlon for license to operate a small Obstacle Golf Course on Lots 27 and 28, Block 15, Section B, was allowed. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication from the 17est Coast Steel Co, in regard to their iiaintenance Broom, was referred to the Street Superintendent. The communication from the Fire Chief asking permission to install an oxygen refillinS, pump, was considered, and Councilman Gar- field stated the Committee would recommend that it be allowed. On motion of Councilman Ellsworth seconded by Councilman Hilmer and carried, the recommendation of the Committee was accepted and the purchase author- ized. The communication from the Slest Newport Association asking that certain specified 7ork be done as soon as possible around the pool in West Newport was considered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication was referred to Assistant Street-Superintendent Siegel to prepare` a plan and an estimate of the work outlined. BUSI`IESS ORDINANCE ISO. 381, entitled: AN ORDINANCE AMENDING SECTION 3 OF ORDINANCE NO. 307 OF THE CITY OF NEWPORT BEACH. came up for final passage, was read, considered and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth,-Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. ORDINANCE NO. 382, concerning sewer connections outside the City limits of the City of Newport Beach, came up for final passage, was read, considered, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None, ABSENT, Councilmen None. , NEW BUSINESS Councilman Ellsworth introduced an Ordinance amending Ordinance No. 310 of the City of Newport Beach. The Ordinance was read, considered, designated Ordinance No: 384, and on motion of Councilman Ellsworth second- ed by Councilman Hilmer and carried, the Ordinance was passed to the second reading. Mayor Johnson asked to be excused from the meeting and retired. On motion of Councilman Claire seconded by Councilman Garfield and carried, Councilman ElLs^rorth was elected temporary chairman. 213 On motion of Councilman Hilmer seconded by Councilman Garfield and carried, the de:,Pnd of Louis Dixon covering two weeks vacation as signed by the Finance Committee was allowed. There being no further business on motion of Councilman Claire seconded by Councilman Garfield and carried, the meeting adjourned to 7 :30 o'clock P. M. on Monday, May 19, 1930. IJ.ayor Johnson not being present on motion of Councilman Ellsworth seconded by.Council- man Garfield and carried, Councilman Claire was elected temporary chairman, who called the meeting to order, The roll was called showing all members present except Mayor Johnson who came in later. The ,ninutes of the previous meeting were read and approved as read. Councilman Hilmer brought up the matter of a pier on Balboa Island being so constructed that it projected across an adjoining lot instead of according to the plan submitted, which he thought should not be allowed. The matter was discussed and on motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the Street Superintendent was instructed to see that the ordinance regulating the construction of piers be rigidly enforced and he would be held responsible for any changes allowed to be made. City Engineer Patterson reported that the toilets the Committee would recommend for Corona Del 1:ar would cost approximately $478.00. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the matter was referred to the Finance Committee to make a report at the next meeting. On motion-of Councilman Claire seconded by Councilman Ellsworth and carried, the regular order of business was sus ended to take up the matter of assessments for the improvement of Tract 948. The assess *6ient diagram prepared by the City Engineer for the improvement of Seville Avenue and other streets as contemplated by Resolution of Intention No. 543, was presented for the approval of the Council. Councilman Ellsworth moved that said diagram be so approved; seconded by Councilman Garfield and carried. The Clerk advised the Council that this was the time and place fixed pursuant to statute and notice given for the hearing in the matter of the assessment for the improvement of Seville Avenue and other streets as contemplated by Resolution of Intention No. 543, adopted on the 12th day of November, 1929, the Clerk also informed the Council that affidavits of the posting and publication of the Notice of Filing Assessment were on file in his office and that no written appeals or objections had been filed in his office prior to the day set for the hearing. The uayor asked if there were any interested persons - present desiring to be heard in the matter. No one responded. All interested persons having been given full opportunity to show cause vzhy the said assessment should not be confirmed, all objections presented having been heard and fully considered and the Council being satisfied with the correctness of the assessment, there- upon Councilman Ellsworth moved that the said assessment be confirmed and approved, -!hick motion, seconded by Councilman Garfield was carried by the following vote, to -wit:
