HomeMy WebLinkAbout06/02/1930 - Regular Meeting216 City Hall, Newport Beach, June 2, 1930 The City Council of the City of Newport Beach met in regular session at 7;30 o'clock P. 11. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. The reports of the heads of the departments were read and on motion of Councilman Ellsworth seconded by Councilman Garfield'and carried, the reports were accepted and filed. Councilman Kilmer reported that the Newport Beach co. :fort station was paid for by an assessment district, and he understood the others were paid for out of the general treasury, but some thought differently and he was granted additional time to go into it further. Councilman Claire teported that he thought there should be a pile marker in the entrance channel to replace the one taken out which would cost about $50.00. On his motion seconded by Councilman Ellsworth and carried, the Harbor Master was authorized to install the marker. Councilman Ellsworth reported that the improvement of the streets in '. "est Newport was very much needed, but he did not think it advisable to use the 1915 bond act for same. The Committee was grant- ed additional time for further investigation. Councilman Ellsworth reported that he thought the City should set a good example at the Tournament of Lights, and would recommend that the City enter a float in the Oommercial Section. On his motion seconded by Councilman Garfield and carried, the float was authorized. The communicc.tions were read and acted upon as follows; The application of E. H. Day for permission to construct a pier on Lot 1, Block 109, Section B was presented, and on motion of Councilman Garfield seconded by Councilman Ellsworth and carried, the application was allowed subject to the will of the Council, and to be under the direction of the City Engineer. The application-of W. H. Green for license to operate a .dnia- ture Golf Course on Lots 8, 9, 10 and 11, Block 16, Balboa Eastside Addition was considered, and on motion of Councilman Ellsworth second- ed by Councilman Claire and carried, the license was granted. subject to the zoning ordinance and approval of the electrical inspector. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the application of Lido Baby Golf Course for license to operate a Miniature Golf Course on Lots 1161 to 1166 inclusive, Tract 907, was granted subject to the zoning ordinance and the approval of the electrical inspector. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the request of Florence E. Ghatten for transfer of her restaurant license at 2116 Ocean front to Millie M. McClain, was granted. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of H. R. 'Iilken for license to operate an electric Flasher at 110 Palm Street, was allowed subject to the approval of the Chief of Police. On motion of Councilman Claire seconded by Councilman Ellsworth and carried,,the application from Guy R. Faul °ner for license to operate a table Tango game in the Balboa Hotel, was allowed subject to the approval of the Chief of Police. The request of ;?alter C. Eastluck for transfer of his drug store license at 2108 Ocean Avenue to Joe C. Elliott, was granted.. The application of Geo. Car,.nuanis for license to run an eating house at 104 Main Street, Balboa was again presented he having enlarged his quarters, and City Attorney Thompson stated it would be all right to grant the license if approved by the Health Officer. The matter was considered and on motion of Councilman-GasfiBld seconded by Councilman Ellsworth and caf'ried, the license was granted subject to the approval of the Health Officer. A petition signed by the Ocean Front property owners protest- ing against opening Ocean Avenue from 23d to 26th Street, was consider- ed, and Mayor Johnson reported that the Committee appointed at the last meeting would not recommend opening Ocean Avenue only as far as 24th Street, on account of the narrowness of that street. On motion of Councilman Claire seconded by Councilman Hilmar and carried, the report was accepted and the petition filed. dC T l 2_ On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the communication from the Secretary of the Orenge County Councils asking that a representative be at their meeting in Santa Ana City Hall, June 12th to decide on the division of the gas tax money, was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the communication was filed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the several communications in regard to the swim.:_ ing pool in west Newport were filed for future use. On motion of Councilman Claire seconded by Councilman Hilmar ' and carried, the communication from the Secretary of the west Newport Improvement Association advising.of the action taken at a recent meet- ing, .was filed. On motion of Councilman Claire seconded by Councilman Ells - worth and carried, the eommunicaiion from the Association of Pacific and Far East Ports in regard to dues was filed as we are not now a member of.the Assn. .On motion of Councilman Claire seconded by Councilman Garfield and carried, the request of B. P. Newman for transfer of his Flasher license in the Irwin- Racker Building, to C. J. Keegan, was granted. The communication from the Newport Harbor Chamber of Commerce asking to.transfer f nr.s from various accounts to accounts No. 361 and 363,was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the transfers were allowed. On motion of Councilman Claire seconded by Councilman Kilmer and carried, the communication from the Calif. Real Estate Association in regard to advertising with them, was referred to the Chamber of Commerce. The communication from H. C. Parker asking to have some dredging done on the north side of the Bay by Collins Isle, was consid- ered, and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the City Engineer was instructed to give one or more estimates on the cost of dredging the location asked for at the next meeting. ' The communication from the Salvation Army to City Attorney Thompson in regard to licensing outside agencies coming here to solicit money, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the matter was laid on the table until next meeting. A protest signed by 18 property owners of Balboa Island - against the speed boats through the Grand Canal, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the matter was referred to the Chief of Police for his in- formation. On motion of Councilman Hilmer seconded by Councilman Garfield and carried, the communication from H. C. Parker was filed. UNFINISHED BUSINESS None. NEW BUSINESS A Yap of Tract No. 626 being a Subdivision of a portion of Lot 4, Section 34, Township 6 South, Range 10 West, recently sold by the Pacific Electric Land Co, was presented, and on motion of Council- man Claire seconded by Councilman Ellsworth and carried, the map was tentatively approved. Mr. wildey asked to have a portion of the Camp Groun6 removed on account of the new subdivision, but it iva; decided not to make any change until after the summer season. This being the first regular meeting of the City Council of the City of .Newport Beach next after filing with the Clerk of said City of the returns of the election held in said City on the 28th day of May, 1930, and said City Council opened and proceeded to canvass said returns, and upon the canvass thereof found and ordered the follo-ing report to be made and entered upon its minutes of said meeting: The election was held as provided by law for the purpose of determining whether or not certain new and uninhabited territory 218 contiguous:to the City of Newport Beach, and which territory at the time of the filing of the petition for its annexation was city owned property, should be annexed to the City of Newport Beach. For the purpose of said election the City of Newport Beach was divided into five (5) voting precincts and at the election votes for annexation and against annexation were cast as follows: For annexation. 35 votes, Precinct No. 1. 31 votes, Precinct No. 2. 65 votes, Precinct No. 3. 36 votes, Precinct No. 4. 46 votes, Precinct No. 5. Against annexation 3 votes, 3 votes, 0 votes, 0 votes, 1 vote. Total votes cast "For annexation, " - - Total votes cast "Against annexation, Total number of votes cast, - -.- - - The election was held on the 28th day of the returns was made by the City Council of Beach at•the City Hall thereof in said City at P. M. of Monday, the 2nd day of June, 1930. - - 213 votes. "- - - 7 votes. - - 220 votes. of May, 1930; the canvass the City of Newport the hour of 7 :30 o'clock The result of the canbass was "For annexation" 213 votes, "Against annexation" 7 votes. The Clerk of the City of Newport Beach was ordered to certify under the seal of the City of Newport Beach and transmit to the Secretary of State and to the Board of Supervisors of the County of Orange, a copy of said report together with the foregoing statement, and that from and after the date of the filing of said document in the office of the Secretary of State, the annexation of said territory should be deemed and be complete, and thenceforth such annexed terri- tory should be a part of the City of Newport Beach for all intents and purposes, except only that no part of such annexed territory shall ever be taxed to pay any portion of any indebtedness or liability of the City of Newport Beach prior to or existing at the time of such annexa- tion. The territory proposed to be annexed to the City of Newport Beach is described as follows: PARCEL 1 Beginning at a point in the present City Boundary line of Newport Beach, which point is the northeast corner of Lot "R!', Tract 919, as recorded in Miscellaneous Maps, Book 29, pages 31 to 34 inclusive, records of Orange County, California, which point is also the southwest corner of the 80 foot strip of the State Highway right of way as deeded by Deed recorded in Deed Book 506, page 334, Records of said County, running thence along the State Highway right of way as deeded by deed recorded in Deed Book 338, page 314, Official Records of said County, south- easterly on the arc of a curve concave to the northeast having a radius of 906.33 feet (a radial line at the point of beginning bearing north 470 33' 25" East) a distance of 504.85 feet; thence continuing along the last mentioned southerly line of said State Highway right of way, tangent south 740 21' 30" East-1252.22 feet; thence continuing along the.last mentioned right of way line along a curve concave to the north having a radius of 1550 feet, a dis- tance of 379.64 feet; thence continuing a18ng the last mentioned right of way line tangett south 880 23' 300 east, a distance of 201.35 feet to a point in the southeasterly line of the parcel of land as deeded to the City of Newport Beach by deed recorded in Deed Book 249, page 423, records of said County; thence south 290 00' west along the last mentioned southeasterly line and the southwesterly prolongation thereof a distance of 970.81 feet to an intersection with the present City boundary line; thence north 610 00' west along the present City boundary line a distance of 2340.98 feet to an angle point in the present City boundary line; thence continuing along the present City boundary line north 7" fl 219 390 44' 50" East, a distance of 488.29 feet to the point of beginning._ PARCEL II. -Beginning at an angle point in the present City Boundary line, which point is north 460 37' east, a distance of 172.81 feet from Station 150 in the U. S. Government Bulkhead line as laid out and shown upon a map of Newport Beach showing Harbor lines, approved by the War Department January 18, 1917, and ' on file in the office of the District Engineer in Los Angeles, California; thence north 380 23' 201' East a distance of 255.16 feet to a point in the U. S. Gov't. Bulkhead -line between Station 100 and Station 101, as shown upon said map of Newport Beach showing Harbor lines; which point is the southwesterly cor- ner of the parcel of land as deeded to-the City of Newport Beach by deed recorded in Deed Book 249, page 424, Records of Orange County, California; thence north 39 48' west along the south- westerly line of said parcel of land a distance of 351.34 feet; thence north 230 57' 30" east along the northwesterly line of said parcel of land a distance of 317.57 feet; thence south 710 54' east along the northerly line of said parcel of land a distance of 290.24 feet; thence continuing along the northerly line of said parcel of land south 850 43' east a distance of 1378.16 feet to the northeast corner of said parcel of land; thence south along the east line and the southerly prolongation thereof of the said parcel of land a distance of 567.01 feet to an intersection with the present City boundary line; thence west along the present City boundary-line a distance of 1712.71 feet to the point of beginning. All in Section 350 Township 6 South, Range 10 West, San Bernardino Base and Meridian, Orange County, California. Councilman Claire introduced a Resolution declaring result of special election. The Resolution was read, considered, designated RESOLUTION NO. 611, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilman None. Councilman Claire introduced a Resolution entitled as follows: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING THE RESULT OF A SPECIAL ELECTION HELD IN SAID CITY ON ORDINANCE NO. 380, BEING AN ORDINANCE OF THE CITY COUNCIL AND BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH, PROVIDING FOR THE LEVY'AND COLLECTION FOR EACH FISCAL YEAR OF A TAX OF THREE CENTS ($.03) ON EACH ONE HUNDRED DOLLARS ($100.00) OF ASSESSED VALUATION FOR TAX PURPOSES: PROVIDING THE MANNER OF USING SUCH TAX, AND THE TIME OF COLLECTION THEREOF, AND ORDERING THE SUBMISSION OF THIS ORDINANCE TO THE ELECTORS OF THE CITY OF NEWPORT BEACH AT A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY OF NEWPORT BEACH ON THE 28TH DAY OF MAY, 1930. The Resolution was read, considered, designated RESOLUTION NO. 612, and upon call of the roll passed by the following Vote, to -wit; AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. A Grant Deed dated the 2d day of April, 19300 from Florence Schoeffel Henry and Charles C. Henry, wife and husband, to the City of Newport Beach, a municipal corporation, wherein the said Florence Schoeffel Henry and Charles C. Henry, grant to the City of Newport Beach, a municipal corporation, all that certain real property situated in the City of Newport Beach, County of Orange, State of California, and more particularly described as follows: All that portion of Section One (1), Township Seven (7) South, Range Ten (10) West, S. B. B. & M., described as follows, to -wit: Beginning at an angle point in theWest line of that certain 25 foot alley Westerly of Lot Fifteen (15) of Tract No. 948, as shown on a Map recorded in Book 30, 220 pages 6 and 7 of Miscellaneous Maps, records of Orange County, California, which point is also East 211 feet and South 621.94 feet from the Northwest corner of said Section One; running thence South along the prolongation of the said West line of that certain 25 oot alley a distance of 20.76 feet; thence South 730 33+ lif East a distance of 20.85 feet to the most Northerly corner of Lot Twenty -one (21) of said Tract No. 948; thence North 360 52' 22" West along the Southwest line of the aforementioned alley a distance "of 33.33 feet to the point of beginning, was presented to the City Council of the City of Newport Beach, Calif- ornia. WHEREUPON, Councilman Lloyd Claire made a motion, duly second- ed by Councilman A. J. Garfield and carried, that said Grant. Deed be accepted by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of the County of Orange, State of California. That said motion was carried by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen.None. ABSENT, Councilmen None. Councilman Lloyd Claire introduced a Resolution directing the City Attorney to make application to the Railroad Commission for permission to construct a grade corssing at 28th Street in the City of Newport Beach. The Resolution was read, considered, designated RESOLUTION NO. 613, and upon call of the roll passed by the following vote, to -wit: AYES, "Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. The matter of acceptance of the deed to Tideland Location No. 268 as offered by Mr. Shattuck of the N.'H. Yacht Club at the last meeting, was considered, and City Attorney Thompson stated he would advise accepting it if it was a grant deed in fee simple, and on . motion of Councilman Claire seconded by Councilman Garfield and carried, the deed was accepted on the conditions stated. On motion of Councilman Claire seconded by Councilman Garfield and carried,'the Street Department were instructed to make the contemplated improvements around the pool in West Newport, according to the plans presented by Assistant Street Supt. Siegel. On motion of Councilman Claire seconded by Councilman Garfield and carried, the seciage disposal investigation report of Currie Engineer- ing Co. N'ap ordered filed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the demands having been signed and approved by the Finance Committee were allowed and warrants to be drawn for same. City Attorney Thompson stated he thought there should be some changes made in the license Ordinance and would like to have the Council as a whole meet and go over the license ordinance. On motion of Council- man Ellsworth seconded by Councilman Garfield and carried, it was decided to meet at the City Attorney's office at 3 o'clock P. M. on Wednesday, June 4, 1930. There being no further business on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the meeting adjourned to 7:30 o'clock P. M. on Monday, June 16, 1930. This being the first Honday in June and the Tax Collector having delivered to the City Council by filing the same ^ith the Clerk, a complete list of all persons and property owing taxes and assessments, and at the same time returned the assessment rolls. In the delinquent list so delivered there was set down in numerical order -.11 matters and things contained in the assessment books relating to delinquent persons and property. The City Council having carefully compared said delinquent list with the assessment rolls, and being satisfied that it contained a full and true statement of all taxes and assessments due and unpaid, the ' max Collector was duly credited with all taxes and assessments charged against him on the assessment rolls, the amount of Thich was $529,054.35 and in turn the City Council directed the Clerk to charge the Tax Col- lector 1th the amount of tares and assessments due on the delinquent lists together with all penalties due thereon, and an acditional sum of Fifty Cents advertising fee on each lot, parcel or tract of land assessed separately, and each assessment of personal property so delinquent. 1
