Approved September 1st, 1930 GG�1,GGf:� Ma or, City o e ort Beach City Clerk City Hall, Newport Beach, Sept. 1, 1930 The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P.M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. The reports of the heads of the departments were read and on motion of Councilman Claire seconded by Councilman Ellsworth and carried the reports were accepted and filed.- Councilman Hilmer reported that the Telephone Co;,inany might be given permission to lay a cable across the channel entrance from N Street to Pacific Drive providing they take out the cable to Balboa Island. The Committee did not enter a protest at the War Department-hearing as they found out the City had jurisdiction over it. No action was taken at this time. City Attorney Thompson stated he had not prepared an ordinance requiring the Buildirg Inspector to inspect all buildings before they are moved into the-City as asked for by the Builders Exchange as he had not received any instructions to do so from:.the Council. On motion of Councilman Claire seconded by Councilman Garfield and carried, the City Attorney was instructed to prepare an Ordinance along the lines suggested by the Builders Exchange. City Engineer Patterson stated the drain pipe complained of by John Sherrod-Harris would be taken care of before the winter rains started. The communications were read and acted upon as follows: A petition containing 102 signatures asking that the Council form an assessment district for the overhead crossing at the Arches was considered, but inasmuch as the amount of property represented by the signatures was not stated, on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the petition was laid on the table until next meeting and the Clerk instructed to check the petition} as to the number of lots represented. The communication from Ralph P. Maskey laid over from last meet= f� -C ing asking the abandonment of a portion of 54th Street , was again taken up, and on motion of Councilman Claire seconded by Councilman Garfield and , carried, the City Attorney was instructed to prepare the necessary papers for abandonment upon poomr description furnished by the City En- gineer. On motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the communication from H.;. :.Davis in regard to a ravelled walk along the bluff on Corona del Mar, was laid on the table until the regular meeting in January. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of Marcus C. Smith for permit to construct a Dier in front of Lot 7, Bay Island, was allowed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the communication from the President of the Los Angeles 241 County Conservation Association calling a meeting for September 10th was filed. The request of Geo. Foltz, City Electrician, for two weeks vacation from Sept. 8th was presented, and on motion of Councilman Hilmer seconded by Councilman Claire and carried, the request was granted. On motion of Councilman Claire seconded by*Councilman Hilmer and carried, the communication from Lee R. Minton commending Police Officer No. 5, Ray Shannon , for the courtesies shown him, was refer- red to the Chief of Police. On motion of Councilman Ellsworth seconded by Councilman Claire and carried, the communication from Leon S. Heseman, Commodore ' of the N.H.Yacht Club, thanking the Council for the permission to construct a yard arm flagpole on Balboa pier, was filed. The copy of a communication sent to the District Attorney by B.B.Mason complaining of an apparent deceit in the free admission tickets given for the Balboa Dance Marathon was considered, and on motion of Councilman Claire seconded by Councilman Garfield and car - ried, the communication was filed. The communication from John Sherrod Harris extending an invitation for all city employees to hold a picnic at their bathhouse on Corona Del Mar and on the beach in front of same any day except Sunday, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the matter was referred to the Street Supt, to investigate and report. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the resignation of Mrs. Elizabeth B. Douglas as Assistant Librarian was accented, and the Clerk instructed to write and thank her for her past services. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the communication from 17.H.Kendall complaining of some of the sidewalks on Corona Del Mar being grown up with weeds and grass, was referred to the Street Supt, to look after. The communication from the Heirs Research and. Recovery Bureau stating they have a Bonding Company who is willing to bond the improve- ment of Lots 1 and 2 of Tideland Location No. 267, was considered, and ' on motion of Councilman Garfield seconded by Councilman Hilmer and car- ried, the communication was filed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the communication from J.R.Wilder complaining of the dust in the alley near his place in Block A East Newport, and asking if the City would not oil and gravel it, was referred to the Street Supt. for attention as soon as practical, and to notify Mr. Wilder of his inten- tions. The communication from the Orange County Coast Association asking the City to renew its membership in the Association was considered, and on motion of Councilman Hilmar seconded by Councilman Claire and carried, the renewal was authorized. Councilman Claire introduced an Ordinance PRESCRIBING THE ADDITIONAL DUTIES OF POLICM,,EN'AND FIREMEN. The Ordinance was read, considered, designated Ordinance No. 388, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the Ordinance was passed to the second reading. The communication from the West Newport Im)rovement Associ- ation favoring the construction of groins from 36th St, to the west city limits was considered at some length, and on motion of Councilman Ellsworth seconded by Councilman Hilmer and carried, the City Engineer was instructed to make an accurate estimate ofthe cost of one groin at 36th Street, and also an estimate on the tdal number of groins he con- siders necessary to protect the beach to the west city limits. On motion of Councilman Claire seconded by Councilman Ells- ' twth'and carried, the request of G.E.Arbogast for transfer of his meat market license to J.D.McIntosh, was allowed. The application of O.F.Elliott for license to sell umbrellas on the easterly 135 feet of Lot D, ocean front lot in the Balboa Tract was considered, and the City Attorney ruled that the license should be granted as the lot was privately owned. On motion of Councilman Garf- ield seconded by Councilman Claire and carried, the application was allowed. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the application of J.J.17allace for transfer of a flasher license from 204 Main Street to Balboa Pavilion Casino, was gra7ted. On motion of Councilman Clare seconded by Councilman Ells- 242 worth and carried, the application of James E. Brown for transfer of � his Real Estate license from 114 - 21st St. to 3609 Central Avenue, was granted. On motion of Councilman Claire seconded'by Councilman Hilmer and carried, the request of J.A.Gant, Treasurer, for transfer of $178.02. from account No. 362 -D to expense of float for Tournament of'Lights, was allowed. A petition containing 83 signatures protesting against the establishment of our new sewage disposal plant in the west end of the City was presented, but inasmuch as the signers did not give their property, on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the petition was referred to the City Clerk for checking as to property owned. City Engineer Patterson stated that in order to hold the sand ' for the fill at the end of the peninsula, it would be necessary to put in a groin about 75 feet long at N Street. The matter was considered and on motion of Councilman Claire seconded by Councilman Garfield and carried, the City Engineer was instructed to prepare plans and specifi- cations for the groin at N Street.' UNFINISHED BUSINESS ORDINANCE NO. 387, entitled: AN ORDINANCE AMENDING ORDINANCE NO. 345 OF THE CITY OF NEWPORT BEACH BY ADDING TWO SECTIONS THERETO, TO BE KNOWN AS SECTION 35 -a AND SECTION 35 -b, came up for final passage, was read, considered, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. NEW BUSINESS. Councilman Hilmer introduced a Resolution, entitled, A RESOLUTION OF TIE CITY COUNCIL OF THE CITY OF NEW- PORT BEACH FIXING THE RATE PER CENTUM AND LEVYING A TAX UPON ALL OF THE TAXABLE PROPERTY WITHIN THE CITY OF NEW- PORT BEACH WHICH IS TAXABLE FOR MUNICIPAL PURPOSES. The Resolution was read,'considered, designated RESOLUTION ' NO. 617, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. Councilman Garfield introduced a Resolution, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, GRANTING TO FOSTER & KLEISER COMPANY, A CERTAIN FRAN- CHISE OR LICENSE TO ERECT AND CONSTRUCT A CERTAIN SIGN BOARD FOR PAINTED OR ILLUMINATED ADVERTISIP nS�TG S OA I. TY OWNED PROPERTY AND AUTHORIZING THE MAYOR OSAIIYAY EXECUTE SAID CONTRACT IN THE NAME OF THE CITY OF NEWPORT BEACH. The Resolution was read, considered, designated RESOLUTION NO. 618, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None On motion of Councilman Hilmer seconded by Councilman Garfield and carried, the demands, except the one from the Standard Dredging Co., having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for the same. On motion of Councilman Hilmer seconded by Councilman Ellsworth ' and carried, the demand of the Standard Dredging•Co, was allo�7ed upon receipt of a check for two broken light standards for which a bill had been sent them. Mr. Kirkpatrick made a verbal protest against including the ocean front lots in Block 36,Newport Beach Tract, in the Acquisition Proceedings for a road to the west city limits; he also stated he rep- resented the other ocean front lot owners in that block. The• matter was discussed for some time but no action was taken at this time. Water Supt. Patterson stated he had a Dump, some belting, etc at the pumping plant for which he had no use at the present time and he had received a very satisfactory offer for same and thought-it wise to dispose of it. The matter was discussed and on motion of Councilman ,243 Hilmer seconded by Councilman Garfield and carried, the water Supt. was authorized tQ sell the equipment on the offer received. There being no further business on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the meeting adjourned to 7;30 o'clock P.M. on Monday, Sept. 15, 1930. lVA Ma or, City �O'f�Nwport Beach v Approved September 15th, 1,930 City Clerk City Hall, Newport Beach, Sept. 15, 1930 The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P.M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. City Engineer Patterson reported that the contracts for furnishing water outside the City were all signed but the Bay Shore Camp winch he expected in a day or two. ' City Attorney Thompson reported in regard to the contract with the American Legion that he had asked for their papers of in- corporation but had not received them as yet. The City Clerk reported that the.check of the petition for the overheard crossing showed 2112 lots represented, with was considered and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the City Attorney was instructed to notify the Board of Supervisors that the Council is ready to proceed with same, and we would be glad to meet with their Board at any time. The Clerk also reported that there were 64 lots represented on the petition protesting against the sewer plant being located in the west end of town, and on motion of Councilman Garfield seconded by Councilman Claire and carried, the petition was filed until the time for hearing protests on the proceedings.. City Engineer reported that his estimate on the cost of a groin at 36th Street 128 feet long, was $0098.00 which he suggested putting in out of the general fund as it was .a test groin. The matter was discussed thoroughly and inasmuch as the property owners mostly benefitted by the groin in Block 36 were protesting on the acquisition of a road along the P.E. track, on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the City Attorney was in- structed to draw up a petition for the owners of the ocean front lots to sign, that if the groin is constructed at 36th Street they will not protest a ainst being included in the assessment district on an equal share for the balance of the groins necessary to protect the ' beach, nor for the acquisition proceedings for a road tothe west city limits. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the City Attorney was instructed to furnish the signed 7etitions to the City Engineer as soon as received so that he can go ahead with the construction of the groin. City Engineer Patterson stated that the Newport Beach Boat Builders thought that tiro groins would be necessary to hold the fill at "° ?" Street;'one world cost about $1178.30 and the other about $537.30. 'The matter was considered and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the City Engineer was instructed to authorize the,-,o rk done under the present contract for dredging.
