The City Council of the City of Newport Beach met in reg- ular adjourned session at 7:30 o'clock P.M. 6n above date. The meet- ing was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. City Engineer Patterson reported on the letter from C.W. Wilson in regard to the sand being dug out from under the sidewalk at Montero Street, that it had been dug out as stated but that it could be put back with a scraper at low tide, which he would do al- ' though there was nothing to hold it there. The communications were read and acted upon as follows: The revised application of W.P.True for permission to con- struct a pier in front of his property was again taken up, and City Attorney Thompson presented a Deed to the lot on which the pier was to be constructed in which there was an omission in the acknowledge- ment. On motion of Councilman Claire seconded by Councilman Garfield and carried, the plans and specifications were approved and the permit granted subject to the Deed being filled out to the satisfaction of the City Attorney, and the permit is also subject to the will of the Council. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the application of Mrs. Roger Goodan for permit.to construct a pier in front of Lot TO Bay Island, was granted subject to the will of the Council. The communication in regard to the grade separation at the Arches was again taken up but as Mr. Patterson had not received the information asked for by letter, on motion of Councilman Claire se- conded by Councilman Ellsworth and carried, the matter was laid on the table until the information asked for is received. The communication from Mrs. Geo. P. Wilson, Secretary of the Library Board stating that the Library Boaxd would recommend that the salary of the Librarian be raised from $12500.00 to $1,620.00 per year was considered, and on motion of Councilman Hilmer seconded by Council- ' man Garfield and carried, the salary increase was granted. On motion of Councilman Garfield seconded by Councilman Claire and carried, the communication from I. Weiner complaining of some week -end peddlars of popcorn and peanuts, whom he claimed were operating without a permit and on private ground without the owners permission, was referred to the Police Committee for attention. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication from Leon S. Heseman, Commodore of the Yacht Club, thanking the Council for the dredging done for them, was filed. On motion of Councilman Claire seconded by Councilman Gar - field and carried, the communication from the i:Iagnetic Neon Co. in re- gard to Traffic signs was referred to the Police Committee for consid- eration. The application of M.F.Prechtl for license to operate a Tango Amusement Parlor in the Stone Building was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the application was allowed subject to the approval of the Chief of Police. On motion of Councilman Claire seconded by Councilman Garfield and carried, the applic�on of Geo. K. Noland for license to operate a Flasher Game in front4o the Starcks Pool Hall on 21st Place, was granted subject to the approval of the Chief of Police The communication from Harold P. Hula, City Attorney of Pasadena asking to know definitely before August let whether the eity of Newport Beach desired any of the electric energy to be developed from Hoover Dam, was considered, and on motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the City Clerk was in- structed to notify them that we have decided not to take any electric energy from Hoover Dam. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the request of City Treasurer Gant for transfer of $500.00 from the current expense fund to the Library fund was allowed. UNFINISHED BUSINESS. ORDINANCE NO. 396, re- dedicating a portion of First Street in East Newport for street,purposes came up for final passage. The Ordinance was read, considered.and upon call of the roll passed by the 340 following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth,Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. NEW BUSINESS. Mr. J.W. Schmid of Los Angeles verbally addressed the Council in regard to the license of $2.50 per day asked of Harry Lambert of Costa Mesa who had been peddling vegetables in Newport Beach for the past three years on a $10.00 license. He stated Mr. Lamberts mother was ill and his wife was crippled at present and one of their two children was ill, and he would probably be a charge upon the County , unless allowed to sell his produce. The City Attorney advised him if he would get a small place of business in the City he could get a business license for $12.00. No further action was taken at this time. WHEREUPON,Councilman Herman Hilmar made a motion, duly seconded by Councilman Lloyd Claire and carried, that said deed be accepted by said City of Newport Beach, and the Clerk instructed to record the same forth- with with the County Recorder of Orange County, California. That said motion was carried by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth,Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. A Deed under Section 3795B of the Political Code of the State of California, dated the 8th day of July, 1931, from J.C.Lamb ' as Tax Collector of the County of Orange, State of California, to the City of Newport Beach, granting to the City of Newport Beach all that certain real property situate in the City of Newport Beach, County of Orange, State of California, and more particularly des- cribed as follows, to -wit: Newport Beach City, Lake Tract, Lot 19, Block 129, Records of Orange County, California. was presented to the City Council of the City of Newport Beach, Cal- ifornia. WHEREUPON, Councilman Herman Hilmar made a motion, duly se- conded by Councilman Lloyd Claire and carried, that said Deed by accept- ed by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of Orange County, California. That said motion was carried by the following vote, to -wit: AYES, Councilmen Hilmer,Claire, Ellsworth,Garfield,Johnson, NOES, Councilmen None. ABSENT, Councilmen None. WHEREUPON, Councilman Herman Hilmar made a motion, duly seconded by Councilman A.J.Garfield and carried, that said Deed be accept- ed by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of Orange County, California. ABSENT, Councilmen None. 341 A Deed under Section 3795B of the Political Code of the State of California, dated the 8th day of July, 1931, from J.C.Lamb as Tax Collector of the County of Orange, State of California, to the City of Newport Beach, granting to'the City of Newport Beach all that certain real property situate in the City of Newport Beach, County of Orange, State of California, and more particular described as follows, to-wit: Newport Beach City, Third Addition, Lot 6, Block 44, Records of Orange County, California. was presented to the City Council of the City of Newport Beach, Calif- ornia. WHEREUPON, Councilman Herman Hilmer made a motion, duly second- ' ed by Councilman A.J.Garfield and carried, that said Deed be accepted by the City of Newport Beach and the Clerk instructed to record the same forthwith with the County Recorder of Orange County, California. That said motion was carried by the following vote,to -wit: AYES, Councilmen Hilmar, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the City Attorney was instructed to bring suit for quiet title to the four pieces of property purchased by Mr. Gant at the tax sale, and deeded to the City by the County Tax Collector. MINUTES FOR HEARING ON ASSESSMENT FOR THE IMPROVEMENT OF BAY AVENUE, 9TH STREET AND CERTAIN ALLEYS IN TRACT 884. The Clerk advised the Council that this was the time and place fixed pursuant to statute and notice given for the hearing in the matter of the assessment for the improvement of Bay Avenue, 9th Street and certain alleys in Tract 884 in the City of Newport Beach, as contem- plated by Resolution of Intention No. 654, adopted by the City Council on the 2nd day of March, 1931. The Clerk also informed the Council that affidavit of the posting and publication of the notices of filed assessment were on file in his office, and that he had received no written appeals or objections. ' The Mayor then asked if there were any interested persons pre- sent desiring to be heard in the matter of the said assessment. No one responded. All interested persons having been given full opportunity to show cause why said assessment should not be confirmed, and all appeals or objections presented having been heard and fully considered and the work done in substantial compliance with the requirements of the con- tract, and also being satisfied with the correctness of the assessment and diagram filed by the Superintendent of Streets, it was moved by Councilman Claire that the assessment with the diagram attached be con- firmed and approved and that the Superintendent of Streets of the City of Newport Beach shall forthwith attach a warrant to said assessment in the manner provided by statute bearing the date of this order or confirmation by the City Council.,, which motion being duly seconded by Councilman Garfield was carried by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. City Engineer Patterson referred to the abandonment of a portion of Washington Street as contemplated by Resolution of Intention No. 688, passed June 1, 1931, and no protests having been filed, he presented a Resolution Ordering the improvement. The Resolution was read, considered, designated RESOLUTION NO. 700, and upon call of the roll passed by the following vote, to -wit: ' . AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield. NOES, Councilman Johnson. ABSENT, Councilmen none.
