HomeMy WebLinkAbout08/03/1931 - Regular Meeting342 City Hall, Newport Beach, August 3 1931. The City Council of the City of Newport Beach met in reg- ular session at 7:30 o'clock P.M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full council present. The minutes of the previous meeting were read and approved as read. On motion of Councilman Ellsworth seconded by Councilman Gar- field and carried, the regular order of business was suspended to take up the opening of bids for bonds to obtain immediate possession in Acquisition and Improvement District No. 1 of the City of Newport Beach. The Clerk notified the Council that this was the time and place fixed pursuant to NOTICE INVITING BIDS for bonds to obtain imm- ediate possession in the matter of Acquisition and Improvement Dis- trict No. 1 of the City of Newport Beach, and reported that he had received one bid, which bid was publicly opened, examined and de- clared as follows: G.W.Bond & Son, pax value'thereof, without any accrued in- terest added; WHEREUPON Councilman Claire introduced a RESOLUTION OF AWARD NO. 701, and moved its adoption, which motion was seconded by Councilman Garfield and upon call of the roll the Resolution was passed by the following vote, to -wit: AYES, Councilman Hilmer, Claire,Ellsworth, Gaxfield,Johnson. NOES, Councilmen None. ABSENT, Councilmen None. AN On motion of Councilman Claire seconded by Councilman Gar- field and carried, the regular order of business was resumed. The reports of the heads of the departments were read, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the reports were accepted and filed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the report of the license collector on the peddlars com- plained of by I. Weiner, was filed. ' The report of Building Inspector Nelson that there had been very little done by A.J.Borden in regard to fixing up his place in West Newport, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the report was filed I and the Building Inspector was instructed to send Mr. Borden a notice to abate the nuisance as contained in Ordinance No. 375. A letter from Roy L. Mc Ilrath asking the City to pa him $1900.00 for approximately 1 acre near the reservoir site, or 5000.00 for his portion of Lot 1013 of approximately 2 -1/2 acres was considered, and on motion of Councilman Garfield seconded.by Councilman Claire and carried, the City Attorney was instructed to take steps to condemn the 1 acre strip on which a portion of the reservoir stands. The communication from S.V.Cortelyou, District Engineer of the State Highway, intimating that the State might be willing to assume $125,000 of the expense of the grade separation, leaving $75,000 for the City and County, was considered, and J.P.Greeley verbally addressed the Council in favor of going ahead with it. After due consideration on motion of Councilman Hilmer seconded by Councilman Garfield and aarr- ied, the matter waseierred to the Street Committee. City Engineer Patterson reported in order to lay larger mains in the Seashore Colony Tract to increase the water pressure would cost about $950.00, and as work of this kind is usually done under an Assess- ment District, on motion of Councilman Ellsworth seconded by Councilman Hilmer and carried, the Water Supt. was instructed to communicate the information to the people in that district, if this would be satisfactory to them the City would install new mains under an assessment district upon their request to do so. The communications were read and acted upon as follows: ' A communication with contracts from the Townsend Land Co. to R.L .'Patterson in regard to the new sewer location, was presented and on motion of Councilman Claire seconded by Councilman Garfield and carried, the matter was referred'to the sewer Committee, City Attorney Thompson and City Engineer Patterson. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the application of D.V.Curry for permission to construct a pier in front of Lot 3, Block 240 Canal Section; was referred to the City Engineer for the customary two weeks. The communication from G.C.Macleod,enclosing letter from E.G. Livingston asking the City to replace his mooring destroyed during the Tournament of Lights parade, was considered, and on motion of Council- man Claire seconded by Councilman Garfield and carried, the Harbor Master 343 was instructed to raise the mooring if possible and if not to replace it with another one. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the request of the Christian Science Church to place two signs in front of their Church, was referred to the Chief of Police. On motion of Councilman Garfield seconded by Councilman Claire and carried, the communication from Treasurer Gant reporting on the lots purchased at the tax sale in Santa Ana, was filed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the communication from Thomas J. Whelan in regard to the celebration of the 200th anniversary of Washingtons Birthday was filed. The communication from Rev. Russell C Stroup asking permission to erect a sign on each of the piers and one at the camp ground to dir- ect visitors to each of the three churches in the City was considered, and on motion of Councilman Garfield seconded by Councilman Claire and carried, the request was granted. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the application of G.H.Walker to construct a pier in front of Lot 9, Block 3 E1 Bayo Tract, was referred to the City Engineer for the customary two weeks. The communication from O.U.Miracle asking an extension of 60 days time on his contract for the improvement of River Avenue and other streets and alleys in the City of Newport Beach, was considered and on motion of Councilman Garfield seconded by Councilman Claire and carried, the extension was granted. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of Young & Smothers for a permit to construct an underground storage gasoline tank at the N.W.Corner of Balboa and Marine Ave. Balboa Island, was allowed subject to the approval of the Fire Chief and Building Inspector. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the complaint of Julian Van Duesen, that the retain- ing wall and sidewalk in front of Lot 6, Block 2, Section 1, Balboa Island was caving in, was referred to the Street Supt. for action and report•. The communication from F.J.Moran complaining of the trees in front of their place at 1206 Ocean Blvd. Corona Del Mar, shutting off ' their view of the ocean and asking permission to replace them with others, was considered, and on motion of Councilman Garfield second- ed by Councilman Ellsworth and carried, the matter was referred to the Street Supt. A communication from the Orange County Builders Exchange calling attention to a meeting at the City Hall in Santa Ana to consider the matter of a " prevailing wage scale " for Orange County, was con- sidered and on motion of Councilman Claire seconded by Councilman Hilmer and carried, Asst. Street Supt. Siegel was instructed to attend if it was possible for him to do so. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the complaint of F.P.Winne in regard to the stag- nant pool near Bitter Point Dam, was referred to the Street Bunt. for report. On motion of Councilman Ellsworth seconded by Councilman Gar- field and carried, the communication from Major Lanagan calling a hear- ing on the CJ;P.True application for permit to dredge the approach to his pier, was filed. A lengthy communication from Stephen B. Dexter for the Heirs Research and Recovery Bureau, stating he would contest our purchase of Lots 1 and 2 in Tideland Location No. 267 at the tax sale in Santa Ana, was considered, and on motion of Councilman Garfield seconded by Council- man Claire and carried, the communication was filed. A communication from L.J.Ozenne asking a refund of the taxes paid on his automobile which he stated was outside the City the lst of 1 March, was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the matter was referred to the City Attorney to report on. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of J.M.Fuller for license to operate a Dart Candy Wheel at 204 Main Street, Balboa, was allowed subject to the app- roval of the Chief of Police. On motion of Councilman Garfield seconded by Councilman Claire and carried, the application of Mickey Walker for transfer of her Rest- aurant license No-232 to Mrs. Gertrude Howland, was denied being pro- hibited by Ord. No. 393• UNFINISHED BUSINESS None. NEW BUSINESS. Councilman Hilmer asked to be relieved from his duties on the f� 344 water and sewer committee as he felt he had not been consulted on �.. a sewer matter, and there being no objections Mayor Johnson accepted the resignation. On motion of Councilman Claire seconded by Council- man Garfield and carried, the acceptance was approved. In this connection Councilman Ellsworth brought up the matter of having only one member on each committee, and the City Attor- ney was asked by the Mayor to report at the next meeting as to whether it was necessary to have more than one on each committee. On motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the demands which were in proper form and signed and app - roved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of Councilman Claire seconded by Councilman ' Ellsworth and carried, Robt. Balbridge was appointed patrolman on the police force at a salary of $160.00 per month, A Deed under Section 37558 of the Political Code of the State of California, dated the 31st day of July, 1931, from J.C.Lamb Tax Collector of the County of Orange, State of California, to the City of Newport Beach, granting to the City of Newport Beach all that certain real property situate in the City of Newport Beach, County of Orange, State of California, and more particularly described as foll- ows to -wit: Lot 31, in Block 16, Section 3, Balboa Island, Records of Orange County, California. was presented to the City Council of the City of Newport Beach, Cal- ifornia. WHEREUPON, Councilman Claire made a motion, duly seconded by Councilman Ellsworth and carried, that said deed be accepted by the City of Newport Beach and the Clerk instructed to record the same forthwith with the County Recorder of Orange County, California. That said motion was carried by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth,Garfield,Johnson. NOES, Councilmen None. ABSENT, Councilmen None. The matter of the improvement of Seashore Drive in West Newport was brought up, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the City Engineer was instructed to prepare the plans and specifications for the improvement of Seashore Drive. Councilman Claire introduced an Ordinance entitled: An ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH GRANTING TO THE SOUTHERN PACIFIC RAILROAD COMPANY CERTAIN PRIV- ILEGES. The Ordinance was read, considered, designated ORDINANCE N0. 397 and on motion of Councilman Claire seconded by Councilman Gar- field and carried, the Ordinance was passed to the second reading.
