Mayor, City of Newport Beach M:Z:ZZity I Clerk City Hall, Newport Beach, May 2, 1932. The City Council of the City of Newport Beach met in regular session at 7:30 o'clock p. m on the above date.. The meeting was called to order by Mayor Hilmar. The roll was called showing the full Council •oresent. The minutes of the previous meeting were read, corrected and approved. The reports of the heads of departments were read and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the reports were acceroted and ordered filed. REPORTS OF COMmITTES: The application of the Sea Scouts for a lease of a portion of the North Bay frontage from the City was reported on by Councilman Ellsworth who advised against leasing any of the frontage but recommended 1 that the Sea Scouts be allowed the use of the 100 feet of same adjoining and west of that portion being used by the High School. On motion of Councilman Cltd re, seconded by Councilman Garfield and carried, the recommendation was approved. Councilman Gordon made the following motion: 1.. That all unnecessary expense of the Police Department be curtailed as much as possible. 2. That reductions in salaries and personnel of the Police Department be as follows: Chief of Police, from $250. to $200. Officers receiving 160. to 135• Officers receiving 150 to 132.50 Officers receiving 135. to 125. Officers receiving 125. to 120. Harbor master 155. to 144. 3. That two officers of the present police force be put on the extra list, to work part time, said officers to be the ones who could best afford to do so. The motion was seconded by Councilman Claire and was lost by the following roll call vote: AYES; Councilman Gordon. NOES; Councilman Claire, Ellsworth, Garfield and Hilmer. ABSENT: Councilmen None. CO=TICATIONS: I City Treasurer Gant presented a letter to the Council requesting that all departments heads prepare their budgets for the ensuing fiscal year and to present them by June let. It was moved by Councilman Ellsworth, seconded by Councilman Garfield and carried that the matter be referred to the Finance Committee. A letter from C. F. V. Taylor of Ontario,. California, in regard to certain buildings on Balboa Island was, upon motion of Councilman Ellsworth, seconded by Councilman Garfield, and carried referred to the Building Inspector for report. The Secretary of the Newport Harbor Cha.aoer of Com::ierce presented a communication relative to the Tourna..ient of Li :its to be held July 16th in which he asked for an appropriation of $1,500 and on motion of Councilman Garfield, seconded by Councilman Claire and carried, the request was referred to the Advertising Committee. n_ �; John F. It was moved by Councilman Garfield, seconded by Councilman Claire and carried that the sum of $75.00 be granted from the advertising fund. A letter signed by several electrical contractors asking that certain changes be made in the city electrical ordinance #385 was upon motion by Councilman Garfield, seconded by Councilman Gordon and carried, referred to the Lighting Committee. The communication of W. E. Carlson regarding the placing of signs warning bathers as to the violation of rules of wearing bathing trunks, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the Police Committee. The communication signed by Stephen B. Dexter referring to Tide Lands #267 Lots 1 and 2, in which said tide lands were offered for sale to the City, was upon motion by Councilman Garfield, seconded by Councilman Ellsworth and carried, ordered filed. A letter of protest from Lew H. Wallace against the granting of a permit to Geo. A. Rogers for the construction of a private pier extending into the Bay from Lot 108, Block A, East Newport, was on motion by Councilman Claire, seconded by Councilman.Ga.rfield and carried, ordered filed. The application of Thomas J. Gentle for a marine railway from Lot 14, Block 919 having been approved by City Engineer Patterson was, upon motion by Councilman Claire, seconded by Councilman Garfield and carried, approved by the City Council. (At 4o9 — 29th St-. Newport) The aoolications of the Service Lavnd.ry Company and John R. Tait at Lot 1, Block 0, Corona Del Mar for _permission to install and maintain underground storage tanks for the handling of hazardous fluids were allowed subject to the approval of the Fire Chief and. on motion made by Councilman Claire, seconded by Councilman Garfield and duly carried. 0. C. Clasby presented an application for permission to operate a pony ring on a portion of Lot 7, Block 20 in Newport Beach which was denied by the City Council on a motion by Councilman Claire, seconded by Councilman Garfield and carried. The application of Lars. W. A. Osgood for a permit to operate a lunch stand in the dance hall on Central Avenue in T!ewport Beach and the application of-Fred A. Fay for a transfer of license from 612 Surf Avenue to 111 Main Street Balboa, were on a motion by Councilman Claire, seconded by Councilman Garfield and carried, allowed subject to the approval of the Health Officer. The application of C. A. Neighbors for permission to build a pleasure pier extending into the Bay from the easterly 30 feet of Lots 8,•9, 10 and 11, Block 25, Balboa East Side Subdivision was, on motion of Councilman Garfield, seconded by Councilman Gordon and. carried, referred to the City Engineer for approval. The application of Glenn Wells for a position in any depart- ment of-the City was on motion of Councilman Garfield, seconded by Councilman Claire and carried, ordered filed. The application of Forrest A. Mayes for the position of City Electrician was on motion of Councilman Garfield, seconded by Councilman Claire and .carried, ordered filed. A number of letters protesting any proposed reductions in the salaries or the number of men in the police department were read by the Clerk and on motion by Councilman Garfield, seconded by Councilman Claire and carried, the letters were ordered filed. UNFINISHED BUSINESS: The application of George A. Rogers for a permit to build a pleasure pier extending bayward from Lot 108, Block A, East Newport, presented at the last meeting was by motion of Councilman Claire, seconded by Councilman Ellsworth and carried, denied by the Council. An application of the Van de Kamp Holland Dutch Bakers presented at a previous meeting for permission to conduct a retail store on property owned by the County of Orange at Nevroort Road and State Highway was, due to the refusal of the Supervisors of Orange County to lease the ground, ordered filed on a motion made by Councilman Claire, seconded by Councilman Garfield and carried. 4 1. 15 A letter from City Attorney Thompson regarding the suit against the City of Newport Beach filed by 0. Eliason was read by the Attorney and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried the same was approved and ordered filed. The suit of E. A. Hoffman Candy Company against the City of Neercort Beach in which it was sought to en;oin the City from enforcing Section 79 of Ordinance No. 361, was reviewed in a letter from City Attorney Thompson and on motion of Councilman Garfield, seconded by Councilman Claire and carried, the same was approved and ordered filed. FEW BUSIUESS 1 On motion of Councilman Claire, seconded by Councilman Garfield, the re.aands which had been signed and approved by the Finance Committee were allowed and warrants to be drairm for same. WATER CONTRACTS: � Plater contracts between the City of New -oort Beach and the l2 U Irvine Company and General Petroleum Corporation were presented for apnxoval by the City Council and on motion by Councilman Claire \.� L"! seconded by Councilman Garfield and the following roll call vote were) ordered approved and signed: AYES: Councilmen Claire, Ellsworth and Garfield. NOES: Councilmen Gordon and Hilmer. ABSENT: Councilmen None. City Attorney Thompson presented an ordinance amending Ordinance No. 393 of the City of Newport Beach relating to 'Transient Merchants ". The Ordinance was considered and designated Ordinance No. 401 and on motion of Councilman Claire, seconded by Councilman Gordon and caxxied, was passed to the second reading. City Attorney Thompson presented an ordinance known as "The Tile and Marble Ordinance ". The ordinance was considered and designated Ordinance No. 402 and on motion by Councilman Claire, seconded by Councilman Ellsworth and carried was passed to the second reading. City Attorney Thompson presented an ordinance known as the ' 'Plaster Ordinance ". The ordinance was considered and designated Ordinance No. 403 and on motion of Councilman Claire, seconded by Councilman Garfield and carried was passed to the second reading. City Attorney Thompson presented an ordinance amending Section 5, relating to bonds of plumbers of Ordinance No. 379 of the City of Newport Beach. The ordinance was considerea and designated Ordinance No. 404 and on motion of Councilman Claire, seconded by Councilman Garfield and carried was passed to the second reading. City Attorney Thompson presented and ordinance concerning chimney construction. The ordinance was considered and deisgna.ted Ordinance No. 405 and on motion by Councilman Claire and seconded.by Councilman Garfield and carried was passed to the second meading. ORAL COMMUNICATIONS: H. M. Perez addressed the City Council in reference to certain Chamber of Commerce expenditures, the matter being referred to the City Attorney for a report at the next meeting by a motion made by Councilman Claire, seconded by Councilman Garfield and carried. On motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the City Engineer was requested to prepare plans and a report for the riprapping of the East Jetty. ADJOURNMENT; There being no further business to come before the City Council it was moved by Councilman Claire, seconded by Councilman Ellsworth that an adjourn ment be taken to 7:30 o'clock p. m.
