ORAL COMMUNICATIONS: Reuben Cole addressed the Council in regard to the lack of meters on certain water consumers, and on motion of Councilman Gordon seconded by Councilman Ellsworth and carried, the water Committee was instructed to make a report showing the percentage of consumers with meters. L. W. Briggs spoke about the noisy motor boats on the Bay and on motion of Councilman Claire, seconded by Councilman Gordon and carried, 'the Police Committee was requested to instruct the Harbor Master to, abate the open muffler nuisance, warning signs to be posted at designated points. There being no further business to come before the Council it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that an adjournment be taken Sine Die. Mayor of the City of Newport Beach jI roved: Se 1932 City Clerk City Hall, Newport Beach, September 5, 1932 The City Council of the City of Newport Beach met in regular session at 7:30 o'cld_ck p m on the above date with Mayor Hilmer in the chair. The roll was called showing the full council present with the exception of Councilman Garfibld whose absence was due to illness. The minutes of the previous meeting were read, corrected, and approved. The reports of the Heads of Departments were read and on motion of Councilman Ellsworth, seconded by Councilman Claire and.carried, the reports were accepted as read and ordered filed. SPECIAL COMMITTEES: Councilman Gordon reporting for the Water Committee in regard to meter installations which was brgught up at the previous meeting submitted a report from Water Superintendent Patterson showing the number of comsumers with meters and flat rates from January 1929 to August 1932 to be followed by a more detailed report later. On motion of Councilman Claire, seconded by Councilman Ellsworth and carried the report was accepted and ordered filed. City Attorney Thompson reported verbally, that any compensation insurance carried by the City must, for legal reasons, be with State Compensation Insurance Fund. City Attorney Thompson reported in connection with the Newport Beach Fishermen's Protective Association, now a corporation, outlining certain qualifications required for membership therein and requested that the City Council grant the Association exclusive pier privileges. It was moved by Councilman Gordon, seconded by Councilman Ellsworth and carried that an agreement between the Fishermen's Association and the City of Newport Beach embodying the above be drawn by the City Attorney and presented to the City Council for approval. City Attorney Thompson asked permission from the City Council to file an amended suit in the Corona Del Mar action in order to include more property and it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that the request be granted. COMMUNICATIONS: Haim M. Perez in a letter to the Council complained of the City's business license ordinance, Mr. Perez also addressed the Council in this regard and alleged that Ordinance No. 216 was not being enforced. Some discussion foillwed in which Mayor Hilmer, City Attorney Thompson, Chief of Police Hodgkinson and License Collector Summers participated. It was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that the communication be filed. 430 John F. Vogel's communication in which he suggested a three daay a week employment for all appointive positions with the City, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the Finance Committee. A letter from Frank M. Holt,Commissary Manager of the Welfare Board in which it was requested that the City furnish gas for the use of the trucks used in connection with the welfare work. It being illegal for the City to comply with this request, Councilman Claire, made a motion which was seconded by Councilman Ellsworth and carried, that Councilman Gordon be appointed as a committee to interview .certain of the oil companies in regard to furnishing fuel for the Welfare Board's trucks. A letter from S. A. Jones in which he complained of injuries to his wife due to being struck by a spear in the hands of a fisherman on the Newport pier, was on motion of Councilman Claire,. seconded by Councilman Ellsworth and carried, ordered filed. Leon S. Hessman, Secretary of the Beach Preservation Association, in a letter td the Mayor and City Council praised. the work done by the City in keeping the beach clean and the boardwalk in good repair. It was moved by Councilman Ellsworth, seconded by Councilman Gordon and carried that the letter be filed. The letter from Edwin M. Williams, Secretary of the Corona Del Mar Property Owner's Association, complaining of unsanitary conditions of the beach in the vincinty of Rocky Point, was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, referred to the County Health authorities. R. E. Turner, Adjutant of the Newport Harbor Post of the American Legion asked in a letter for an appropriation from the Advertising Fund to sponser a representation at the National Convention of the American Legion in Portland. It was moved by Councilman Ellsworth, seconded by Councilman Claire and carried that $150.00 from the unapportioned part of the advertising fund be granted. Stephen B. Dexter of the Heirs Research and Recovery Bureau,in a letter to the City Council withdrew any offers made by him for the sale of certain tidelands to the City. It was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that the letter from Mr. Dexter be filed. The Orange County Coast Association's letter asking for contributions to further their activities was on motion of Councilman Claire, seconded by Councilman Gordon and carried, ordered filed. Ol P. Rust in a letter to the Council asked that some action be taken in regard to a petition filed August 24, 1931 requesting a re— zoning of Block 15, Balboa Eastside subdivision to permit the erection of single residences only. On motion of Councilman Ellsworth seconded by Councilman Claire and carried, that the matter be referred to the Planning Commission and the City Clerk was instructed to look up the letter pertaining to the petition. Harbor Master Robinson's letter to the Council in regard to sand boxes on the Balboa Island beach was after some discussion by Mayor Hilmer, Harbor Master Robinson and Chief of Police Hedgkinson, on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, ordered filed. The petition of John A. Harvey and others requesting that the business zone of District No. 2 of Balboa Island be enlarged to include Lots 15 and 16 in Block 1, Section 4 and Lots-17 and 18, Block 2, Section 4, was on motion of Councilman Claire, seconded by Councilman Ellsworth acid carried, referred to the Planning Commission. A. B. Brown applied for a permit to construct a pleasure pier fronting on Lot 46, Tract 907. It was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that the application be referred to the City Engineer. The application of Councilman Garfield for a two months leave of absence on account of illness, was on motion of Councilman Ellsworth seconded by Councilman Claire and carried, granted. The application of H. Dodson for a transfer of business license to a new location was, on motion of Councilman Claire, seconded by Councilman Gordon and carried, granted. NEW BUSINESS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH FIXING THE RATE PER CENTUM AND LEVYING A TAX UPON ALL OF THE TAXABLE PROPERTY WITHIN THE CITY OF NEWPORT BEACH WHICH IS TAXABLE THEREIN FOR MUNICIPAL PURPOSES. 431 Councilman Claire offered and moved the adoption of the above captioned Resolution, which was read, considered and designated Resolution No. 750, the.motion was duly seconded by Councilman Ellsworth and adopted by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Hilmer. NOES: Councilmen None. ABSENT: Councilman Garfield. Councilman Claire offered and moved the adoption of a Resolution granting a written licBnse to Valdemar Sorrenson for exclusive pier 'privileges on the Balboa ocean pier. The resolution was read, considered and designated Resolution No. 751 and the motion being duly seconded by Councilman Ellsworth was passed by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Hilmer. NOES: Councilmen None. ABSENT: Councilman Garfield. RESOLUTION NO. 752 A deed dated the 28th day of July, 1932 from J. C. Lamb, as Tax Collector of the County of Orange, State of California, to the City of Newport Beach, granting to the City of Newport Beach all that certain real property situated in the City of Newport Beach, County of Orange, State of-California, and more particularly described as follows, to -wit: Newport Beach City, Corona Del Mar Lot Eight (8) Block Four Hundred Thirty -two (432, Records of Orange County, California, was presented to the City Council of the City of Newport Beach, California. WHEREUPON, Councilman Claire, made a motion, duly seconded by Councilman Ellsworth and carried, that said deed be accepted by the City of Newport Beach and the Clerk instructed to record the same forthwith with the County Recorder of Orange.County,.California. It was moved by Councilman Ellsworth, seconded by Councilman Gordon and carried that the request of Councilman Claire to leave the State until October First be allowed. It was mooed by Councilman Ellsworth, seconded by Councilman Claire and carried that the request of Councilman Gordon to leave the State until October First be allowed. There being no further business to come before the Council, Councilman Ellsworth made a motion which was seconded by Councilman Claire and carried, that the Council adjouv Sine Die.
