HomeMy WebLinkAbout03/06/1933 - Regular Meeting45� Councilman Gordon recommended that the per diem wage of the Chief of Police be set at $8.65, whereupon a motion was made by Councilman Gordon to that effect which was duly seconded by Councilman Claire and carried by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield. NOES: Councilman Hilmer. ABSENT: Councilmen None. Councilman Claire brought up the Balboa Island and Corona Del Mar policing problem, and moved that the Police Department employ one additional officer at $4.00 per day, the position to be (divided between two men and on the established five day plan. The.motion was seconded by Councilman Ellsworth and carried. E. V. S. Pomeroy addressed the Council concerning his contract for City garbage,.asking a reduction in the cost to him for same. It was moved by Councilman Claire, seconded by Councilman Ellsworth and carried, that the City advertise for bids for the sale of garbage. There being no further business to come before the Council it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried, that an adjournment be taken Sine Die. "PI j Aab ���..:� ._ r of the City of N Newport Beach, March 6, 1933 The City Council of the City of- Newport Beach met in regular session at 7:30 o'clock p. m. on above date at the City Council Chambers.of the City of Newport Beach, with Mayor Hilmer presiding. The roll was called showing the full Council present. The minutes of the previous meeting of February 6th were read, corrected and approved The reports.of Department Heads were read and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the reports were accepted and ordered filed. Various applications for renewal of contracts for water furnished by the City to consumers outside the City limits were read and on motion of Councilman Gordon, seconded by Councilman Claire and carried, the applications were referred to City Attorney Thompson for preparing the necessary resolutions and contracts for same. The request of Samuel Tustin for the zoning of a certain section of the East Newport Subdivision for business purposes, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the Planning Commission for report. Rev. G. Lawrence presented a letter asking for permission to hold outdoor services in the City, and on motion.of Councilman Claire, seconded by Councilman Gordon and carried, the letter was ordered filed. B. W. Harmer's application to conduct a Money Exchange business at Balboa was, on motion of Councilman Gordon, seconded by Councilman Claire and carried, allowed. D. W. Humason's application for permission to.operate a °Flasher" game in the Walker building Balboa, was on motion of Councilman Garfield seconded by Councilman Gordon and carried, allowed, subject to the approval of the Chief of Police. Edwin M. Williams, Secretary of the Corona Del Mar Property owner's Association in a letter to the Council, asked that a 'No Camping' sign be posted at the head of the stairway leading to Buck Gulch and also invited the Council's attention to certain repairs needed on the East Jetty. It was moved by Councilman r J 457 Claire, seconded by Councilman Gordon-and carried, that,the matters be referred to the Chief of-Police and the City Engineer respectively. George C. Macleod, Secretary of the Chamber of Commerce presented a letter received by the Chamber from Smart & Final Co., Ltd. in which they complained of the 'Truck License' charged them for making deliveries within the City. It was moved by Councilman Claire, seconded by Councilman Garfield and carried, that.the communication be filed. A letter from the Secretary of the Chamber of Commerce called attention to a notice received from the Secretary of the Associated Chambers of Commerce inviting representatives from this City to meet with those interested in the Orange County Water Bill ' at the City Hall in Santa Ana, Thursday, March 9th at 7:30 o'clock p.m. It was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that Mayor Hilmer appoint a committee to attend the meeting, whereupon the Mayor appointed Councilman Garfield, Chairman of the Water Committee; Roland Thompson, City Attorney and R. L. Patterson, City Engineer, as representatives from the City of Newport Beach, suggesting that they confer with the Committee appointed by the Chamber of Commerce. G. C. Macleod, Secretary of the Chamber of Commerce presented a letter calling attention to an invitation extended by the Long Beach Chamber of Commerce to a dinner to be tendered to the Naval Officials in connection with the visit of the "U. S. S. Constitution ", to be held on March 16th. It was moved by Councilman Ellsworth, seconded by Councilman Claire and.carried that the letter be filed. The Secretary of the Chamber of Commerce presented a letter in which it was stated that the Chamber had requested that a night harbor patrol service be instituted during the Easter vacation season, and on motion of Councilman Ellsworth, seconded by Councilman Garfield and carried, the matter was referred to the Harbor Master with power to act. H. H. Rohmer presented a copy of a letter sent to the Railroad Commission by the Seashore Colony Taxpayers asking that steps be taken toward establishing a crossing at Orange Street. Considerable discussion was had regarding the matter, Mr. Rohmer and others addressing the Council, and it was moved by Councilman Gordon, seconded by Councilman Garfield and carried, that the City Engineer communicate with the Railroad Commission concerning the subject. It was moved by Councilman Claire, seconded by Councilman Gorden and carried, that the City Attorney arrange for an extension on the Railroad Commission's permit for the Orange Street crossing. A petition bearing 125 names was presented asking the Council to take the necessary action to permit unmuffled speed boat racing on certain courses in Newport Bay, not to exceed 10 days a year. The petition was read and action deferred to be taken up under unfinished business. Letters'from the Parkinson Estate and others advocating a State Park project were read and on motion of Councilman Claire seconded by Councilman Garfield and carried the letters were ordered filed. UNFINISHED BUSINESS The amendment to Ordinance No. 52 known as the "Muffler Ordinance" came up for final passage, and it was moved by Councilman Gordon that the amendment be adopted. The motion was duly seconded by Councilman Claire and the Ordinance failed of passage by the following roll call vote, to -wit: AYES: Councilman Gordon. NOES: Councilmen Claire, Ellsworth, Garfield, Hilmer. ABSENT: Councilmen None. An Ordinance amending Section 21 of Ordinance No. 393, came up for final passage, but was laid on the table pending the inclusion of 45ther possible amendments. The matter of refunding certain taxes paid by the Masonic Homes of California, due to that institution being an orphanage and receiving -state aid, was considered, and by motion of Councilman Claire, seconded by Councilman Ellsworth and carried the refund was allowed. 458 �- NEW BUSINESS ..e It was moved by Councilman Claire, seconded'by Councilman Garfield and carried, that the monthly demands having been duly audited by the Finance Committee, be allowed and warrants drawn for same. It was moved by Councilman Ellsworth, seconded by Councilman Gordon and carried,'that the - Masonic Homes of California claim for tax exemption for 1933 be filed.with the-,City Assessor. It was moved by Councilman Claire; seconded by Councilman Ellsworth and carried that the resignation of Councilman Gordon as Chairman of the Police Committee be accepted. It was moved by Councilman Gordon, seconded by Councilman ' Claire and carried that the petition requesting the Council to legalize unmuffled speed boat racing be laid on the table. This being the time set for opening bids for the sale and disposal of garbage collected within the City of Newport Beach, and no bids having been filed with the City Clerk up to 7:30 o'clock p. m. of March 6, 1933, it was moved by Councilman Ellsworth, seconded by Councilman Garfield and carried, that the Street Superintendent be empowered to enter into a contract for the disposal of said garbage upon the best terms possible. There being no further business to come before the Council it was moved by Councilman Ellsworth, seconded by Councilman Claire and carried that an adjournment be taken Sine Die. A proved: City Clerk Mayor of the City of Newport Beach Newport Beach, March 23, 1933- MINUTES OF SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, HELD ON THURSDAY THE 23rd DAY OF MARCH, 1933, at the HOUR OF FOUR O'CLOCK P.M. A special meeting of the City Council of the City of Newport Beach was held pursuant to notice given as required by law, on the 23rd.day of March, 1R33, at the hour of four o'clock p.m. at the Council Chambers of the City Council of the City of Newport Beach. Upon roll call the following Councilmen answered present: Irvin George Gordon, Lloyd Claire, Paul B. Ellsworth, A. J. Garfield, and Hermann Hilmer, representing the full Council. The notice pursuant to which the meeting was held was duly read by the Clerk of the Council and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the notice was ordered filed. The meeting having been called for the purpose of enacting an Ordinance relating to the construction of buildings and repairs thereto. Considerable discussion was had by various parties concerned therewith. Upon a motion by Councilman Gordon that an emergency now exists iri the City of Newport Beach due to damage done to buildings by the earthquake of March 10th and that such emergency requires the passage of a building ordinance suitable to meet the situation. The motion was duly seconded by Councilman Claire and carried unanimously, whereupon Councilman Gordon moved the adoption of the building ordinance which was read, considered and designated Ordinance No. 410, and upon being duly seconded by Councilman Claire was passed by the following roll vote, to -wit: AYES: Councilmen, Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen, None.
