M. on above date. The roll was called showing all members of the Council present. The minutes of the previous meeting were read, approved and signed by members of the Council. The reports of Heads of Departments were read and, on motion of Councilman Claire, seconded by Councilman Garfield and carried the reports were ordered filed. A report from the City Planning Commission in which the zoning of certain lots on the Bay Front between Montero and Anade for business purposes was recommended to be denied, andon motion of Councilman Claire, seconded by Councilman.Gordon and carried, the report was ordered filed. City Engineer Patterson reported on the probable cost of moving the building from the Balboa Pier to the Washington Street pier for the use of the Harbor Master, and on motion of Councilman Claire, seconded by Councilman Garfield and carried the expense was not authorized and the report was ordered filed. COMMUNICATIONS. A letter from Samuel Tustin was read in which the City Council was requested to zone Lot 33 and � of Lot 34, B1ock.A, East Newport for recreational purposes or vacate Edgewater Street on which the above described property faces. It was moved by Councilman Gordon, seconded by Councilman Garfield and carried that the communication be referred to the Planning Commission. George Bauer presented a letter in which was set forth the reasons for delay in making repairs to his building on Lots 15 & 16 Block 21, Newport Beach, and on motion of Councilman Claire, seconded by Councilman Garfield and carried the matter was referred to the Building Inspector. A communication from J. C. Elliott and E. I. Moore requesting that the City Council amend the Ordinance prohibiting the sale and shooting of fireworks within the City limits. The matter was discussed at length by the Council and the petitioners, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the City Attorney was instructed to prepare an Ordinance in conformity with the Ordinance in effect in the City of Los Angeles, and specifying that the shooting 6f fireworks be limited to water fronts only in the City of Newport Beach. A letter from the Santa Ana Building & Loan Association complaining of the restriction contained in the Chimney Ordinance of this City, was read. It was moved by Councilman Garfield, seconded by Councilman Ellsworth and carried, that the City Attorney reply to the letter. A letter from E. E. Campbell, Chairman of the Santa Ana Basin Water Rights Protective Association was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried the letter was ordered filed. 464 E. G. Greeley made application for renewal of his contract with the City for the City Dump Grounds, and on motion of Councilman Ellsworth, seconded by Councilman Claire, and carried, the City Attorney was instructed to draw the necessary papers for a yearly contract. C. M. Derden applied for a transfer of his restuarant license from the Walker- Hamann Building to 307 Main Street, Balboa, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the same was allowed. T. Numato applied for a license to operate an open air fruit and vegetable market at the corner of Adams and Central Ave., and on motion of Councilman Garfield, seconded by Councilman Claire and carried, the same was denied due to confliction with City regulations. W. E. Balluff applied for a license to conduct a smoked fish business at 212 Seashore Colony and on motion of Councilman Claire, seconded by Councilman Garfield and carried the same was allowed subject to the approval of the Health Officer. Eleven applications for permits to sell beer were filed and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the applications were ordered filed. A letter from the Mayor of Salinas was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Attorney with instructions to prepare a resolution in connection therewith. A letter from N. H. Sloane *relating to the' Uniform Building Code of California, was on motion of Councilman Ellsworth, seconded by Councilman Gordon and carried, ordered filed. Louis W. Briggs presented.a•letter in behalf of the owners of the property in Tract #902 asking for renewal of agreement for sewage disposal and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried the mattek was referred to the Water Committee for report. Certain petitions pertaining to the Live Bait boat situation were presented and on motion of Councilman Claire, seconded by , Councilman Garfield and carried, the matter was referred to the Street Committee for investigation and report. NEW BUSINESS The monthly demands having been duly audited by the Finance Committee, a motion was made by Councilman Claire, seconded by Councilman Garfield and carried, that the same be allowed and warrants drawn for same. Councilman Ellsworth moved that the following rates be adopted for Camp Ground accomodations. Day Week Bay Front $1.00 $5.00 Inside .75 3.50 the motion was seconded by Councilman Garfield and carried. There being no.further business to come before the Council adjournment was taken to May 9, 1933 at 7:30 o'clock P. M. an motion of Councilman Ellsworth, seconded by Councilman Claire and carried.
