HomeMy WebLinkAbout07/03/1933 - Regular Meeting1 Newport Beach, July 31 1933• The City Council of the City of Newport Beach met in regular session in the Council Chambers of the City of Newport Beach at 7:30 p. M. on above date. The roll was called showing the full Council present with the exception of Councilman Ellsworth who was absent. On motion of Councilman Claire, seconded by Councilman Garfield and carried, the reading of the reports of Heads of Departments was waived and the reporte,were ordered filed. City Attorney Thompson presented a written report in which it was ruled that the cancelling of taxes on certain property in connection with the Veteran's Welfare Board could not be allowed, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the report was ordered.filed. City Attorney Thompson presented a report respecting the suit filed by Gertrud Weiczorek against the City of Newport Beach which had been disposed of in favor of the City, and on motion of .Councilman Claire, seconded by Councilman Garfield and carried, the report was ordered filed. City Attorney Thompson presented a report in which it was ruled that the parking time limit asked for by merchants on Marine Avenue, Balboa Island could not be allowed, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the report was ordered filed. The Planning Commission submitted a report adversely to the zoning of Lot 33 and p4.rt of Lot 34, Block A, East Newport for business or recreational purposes. Panola Logue addressed the Council at length on behalf of Samuel Tustin regarding the question, and on motion of Councilman Claire, seconded by.Councilman Garfield and carried the report of the Planning Commission was ordered filed. The application of R. G. Ross, at Acacia and Coast Blvd., Corona Del Mar, for permission to install underground storage tanks, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed subject to the approval of the Fire Chief. The application of Harry L. Parks to install underground storage tanks at the southeast corner of Marine and Park Avenues, Balboa Island, was on :notion of Councilman Claire, seconded by.Oouncilman Garfield and carried, allowed subject to the approval of the Fire Chief. The application of A. W. Spear to operate a lunch room in the Pavilion at Balboa, was on motion of Councilman Garfield, seconded by Councilman Gordon and carried, allowed Subject to the approval of the Health Officer. The application of Harry Clouse to operate a lunch stand at 104 McFadden Place, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed subject to the approval of the Health Officer The application of Karl C. Burdick and Ben Denslow to operate a fish market in Block 429 Lancaster Addition, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed subject to the approval of the Health Officer. A petition bearing the names of certain operators of games on Main Street, Balboa, asking that an ordinance be passed providing for closing of said games at 2 o'clock a. m., and on motion of Councilman Garfield, seconded by Councilman Gordon and carried,'the matter was referred to the Chief of Police with power to act. A petition containing 39 names was presented protesting against the enforcement of the ordinance against peddling wagons. Considerable discussion was had regarding the matter and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the matter was laid on the table ending further developments. Mrs. Arthur F. Bro presented a letter complaining about the ruins left-from a fire in the 2800 Block and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the letter -was referred to the Building Inspector. Stephen B. Dexter's letter regarding certain tidelands in Newport Bay, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, ordered filed. Harry L. Parks presented a communication complaining of a gasoline pump located on the sidewalk at the Northeast corner of Park and Marine Avenues. Mr. Norton also addressed the Council regarding the matter, and on motion of Councilman Gordon, seconded by Councilman Garfield, and carried, the Street Superintendent was instructed to investigate and remedy the condition. P It was moved by Councilman Gordon, seconded by Councilman Garfield and carried, that all gasoline pumps being operated on City property be removed. G. E. Halderman presented a letter protesting against the riding of bicycles on the Balboa Island sidewalks and also suggested that markers -b'e installed to facilitate the finding of locations on ' the Island, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the matters were referred to the Chdef of Police and the Street Superintendent respectively. R. C. Mize presented a letter to the Council offering for sale to the City certain property on Newport Heights and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the communication was ordered filed. J. W. Reeder presented a letter regarding damage by the earthquake to the sea wall on Balboa Island and asked that the matter be investigated, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the request was referred to the Street Superintendent. C. H. Fry, Superintendent of Safety of the Industrial Accident Commission, presented a communication advocating an inspection of trucks and tools used by workmen, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the matter was referred to the Street Superintendent. A resolution adopted by the Orange County Builders Exchange protesting against certain license ordinances passed by some cities discriminating against outside labor was presented, and on motion of Councilman Claire, seconded by Councilman Gordon and carried the resolution was ordered filed. UNFINISHED BUSINESS: None NEW BUSINESS City Attorney Thompson presented the new tax ordinance drafted in accordance with the new State tax law, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the Ordinance was passed to the second reading. Due to the absence of Councilman Ellsworth member of the Finance Committee, Mayor Hilmer appointed Councilman Garfield as a member of that Committee. The monthly demands having been duly audited by the Finance Committee, it was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the demands be allowed and warrants drawn for same. The budget of the Chamber of Commerce, together with a demand on the City Treasurer for certain expenditures was presented, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the same was laid on the table. The City Attorney presented an Ordinance amending Zoning Ordinance No. 367 and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the-Ordinance was passed to the second reading. The offer made by the Sierra Service Organization to recover certain funds due the City of Newport Beach for a percentage of same, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, laid on the table. ADJOURNMENT There being no further business to come before the Council a motion to adjourn to 7:30 P. m.
