HomeMy WebLinkAbout11/06/1933 - Regular Meeting14 Cn Newport Beach, November 6, 1933• The City Council of the City of Newport Beach met in regular session in the Council Chambers of the City of Newport Beach at 7 :30 p. m. on above date, with Mayor Hilmer in the Chair. The roll was called showing.the full Council present. REPORTS OF HEADS OF DEPARTMENTS The reports of Heads of Departments were read and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the reports were accepted and ordered filed. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. COkkUNICATIONS City Treasurer Gant submitted a report relative to the liquidation of secured deposits in the closed First National Bank of Newport Beach. The report was-read and on motion of Councilman Claire seconded by Councilman Garfield and carried, the same was ordered filed. City Attorney Thompson in a letter to the Council reported on the City's portion of the beans, bean straw, and barley hay received as crop rental from the tenant on City owned land. It was moved by Councilman Claire and seconded by Councilman Ellsworth and carried, that the Street Superintendent be instructed to store the beans and that the tenant sell the bean straw and baled barley hay to the best advantage. The Corona Del Mar Property Owners Association petitioned the Council to take steps towards the erection of a comfort station for that district, Mrs. Lura A. Schofield addressing the Council on the subject.. It was moved by Councilman Gordon, seconded by Councilman Garfield and. carried that the matter be laid on the table pending further investigation and report. A communication from the Mayor of the City of Burbank ' was read regarding deliquencies under Improvement Bond Act of 1915 and asking that the City Attorney be authorized to attend a conference called for November 10th and that an appropriation be made of not to exceed Fifty Dollars for the employment of special counsel in connection with the subject. On motion of Councilman Claire, seconded by Councilman Garfield and carried, the City Attorney was instructed to attend the meeting of City Attorneys from various cities and that the sum of Fifty Dollars be allowed for the purpose of special counsel fees in an effort to secure a rehearing by the Supreme Court of California. F. A. Baughan, Secretary of the Reorganization Committee of Southern Municipalities in a letter to the Council asked to meet with the members at some convenient date, and on motion of Councilman Garfield, seconded by Councilman Gordon and carried, the City Clerk was instructed to notify Mr. Baughan of the date of the neat Council meeting. Hal Will Smith presented a communication in which was advocated the planting of trees along certain portions of Marine Avenue, Balboa Island, and on motion of Councilman Garfield, seconded by Councilman Gordon and carried, the City Clerk was instructed to advise Mr. Smith that the City would cooperate with the movement and for him to confer with the Street Superintendent regarding the matter. Hugh McMillan's letter to the Council suggesting that a sign be displayed directing people to the entrance of Newport pier ' and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the matter was referred to the Police Chief with power to act. Arthur M. Brown addressed a communication to the City Council in reference to an order received by him from the Building Inspector to remove a wall in front of his property on Balboa Island and encroaching upon City property. The matter was discussed and the City Attorney ruled that it was unlawful for any construction to extend beyond the property lines. On motion of Councilman Claire, seconded by Councilman Garfield and carried, the communication was ordered filed. Stephen B. Dexter's letter concerning certain tideland locations in Newport Bay,.was on motion of Councilman Garfield, seconded by Councilman Ellsworth and carried, referred to the City Attorney. A. W. Burns made application for the construction of a marine railway extending into the County Channel from his property in Lot H, Tract 919. On motion of Councilman Claire,'seconded by Councilman Ellsworth and carried, the permit was allowed subject to the approval of the City Engineer and after the dustomary two weeks. A. S. Richardson applied for a permit to construct a commercial wharf with three slips, to be located 525 feet North of U. S. Bulkhead Station No. 104. On motion of Councilman Claire, seconded by Councilman 'Gordon and carried, the application was referred to the City Engineer for approval. Letters from Leo E. Hubbard, Frank Kolarik together with a petition bearing numerous names was presented asking the Council to devise ways and means of protecting the ocean beach in the Seashore Colony Tract from erosion by the installation of groynes at certain points in that district. The matter was discussed at length, Messrs. Mitchell, Kolarik, Brooks and others addressing the Council on the subject. It was moved by Councilman Ellsworth, seconded by Councilman Gordon and carried, that the City Engineer be instructed to prepare plans and estimate the cost of said protection, presenting the same at the next meeting of the Council. UNFINISHED BUSINESS It was moved by Councilman Claire, seconded by Councilman Garfield and carried that the City Attorney be instructed to prepare a lease between the City and George Hiner for certain pier concessions according to the terms of that of the previous year. City Engineer Patterson having reported favorably on the application of Harrison C. Mower for the construction of a pleasure pier fronting on Lot B, Block 15, Section 1, Balboa Island, it was moved by Councilman Claire, seconded by Councilman Garfield and carried that the same be allowed. ' NEW BUSINESS The monthly demands having b6en duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed and warrants ordered drawn for same. It was moved by Councilman Claire, seconded by Councilman Garfield and carried, that eight sacks of beans be delivered to the Unemployment Association on 21st Street, Newport Beach. City Attorney Thompson brought up the matter of an action being brought by the City of Newport Beach vs Sarah Newcomb, Golden State Holding Company, Stephen B. Dexter et al, and it was moved by Councilman Claire that a Minute Resolution be adopted authorizing the City Attorney to proceed in the above matter. The motion was duly seconded by Councilman Garfield and was passed unanimously by the City Council. I, Frank L. Rinehart, the duly elected, qualified and acting Clerk of the City of Newport Beach, California, hereby certify that the foregoing Resolution was passed and adopted by the City Council of said City on the 6th day of November, 1933 by e vote above ed. City Clerk of the City of ' Newport Beach, California. City Attorney Thompson presented a Resolution referring to the recovery of a certain sum of money deposited with the County Clerk of Orange County some years previous and pursuant to law in action 'No. 13707, and also for the payment of a certain commission to the Sierra Service Organization for their efforts in securing the refunding of said money. The Resolution was read, considered and designated Resolution No. $O1, the adoption of which was moved by Councilman Ellsworth, duly seconded by Councilman Garfield and was passed by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. City Attorney Thompson reported on the claim for damages against the City by one Dick Swift, advising the Council that the demand should be denied and on motion of Councilman Gordon, seconded by Councilman Claire and carried, the report of the City Attorney was accepted and the claim denied. It was moved by Councilman Garfield, seconded by Councilman Claire and carried that the City-Attorney be instructed to attend the meeting to be held at 12 o'clock Tuesday November 7th, preliminary to the meeting concerning the 1915 Improvement Act Decision to be held on Friday November 10, 1933• City Engineer Patterson presented a communication from the State Highway Commission in which the City was to assume control of certain City Streets and under certain stipulations. A Resolution relating to same was introduced, considered and designated Resolution No. 802., the adoption of which was moved by Councilman Ellsworth'and duly seconded by Councilman Garfield and passed by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire,'Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. It was moved by Councilman Claire, seconded by Councilman Garfield and carried that the Mayor and City Clerk be authorized to sign the quit claim deed in reference to Lot 17, Block 13, Section 1, Balboa Island. It was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the Mayor and City Clerk be authorized to sign the quit claim deed in reference to Lot 9, Block 6, Balboa Tract. Side were received for the purchase of certain City owned lots on Balboa Island and other parts of the City, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the bids were rejected and the City Clerk instructed to return the amounts accompanying the bids.
