The City Council of the City of Newport Beach met in regular adjourned session in the City Council Chambers of the City of Newport Beach at 7;30 p. m. on above date with Mayor Hilmer in the Chair. The roll was called showing the full Council present. REPORTS OF SPECIAL COMb:ITTEES None. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The application of J. Morrison for a permit to conduct a cafe at 125 Agate Avenue, Balboa Island, was on motion of Councilman Garfield, seconded by Councilman Gordon and carried, allowed subject to the approval of the Health Officer. The application of August Heimberg for a permit to conduct a. restaurant with music in the Balboa Pavilion at the foot of Main Street, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed subject to the approval of the Health Officer. - The application of E. N. Workman for a transfer of license numbers 69 and 70 from 115 Main Street to 206 Main Street, Balboa, was on motion of Councilman Garfield, seconded by Councilman Claire and carried, allowed subject to the approval of the Police Committee and the Police Chief. The application of Mrs. H. C. Haubold for permission to construct a pleasure pier fronting on Lot S, Block 4, Tract 626, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. Mrs. John Legg of Balboa Island, in a letter to the Council, complained of the unsightly appearance of an old structure at the corner of Park and Diamond Avenues, Balboa Island, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the complaint was referred to the Building Inspector. M. L. Campbell, in a letter to the Council protested against the use of the canyon north of the State Highway at the intersection of E1 Modena Avenue and Ocean Drive as a dumping ground, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the matter was referred to the Street Superintendent with power to act. I. M. Stevens of the Queen City Laundry, in a letter to the Council protested against the license tax charged laundries doing business in the City, and on motion of-Councilman Garfield, seconded by Councilman Gordon and carried, the communication was laid on the Table. A letter addressed to the City Attorney from A. S. Richardson of Balboa Island asking for an extension of time in which to remove his building from City property back to the property line, was read, and on motion of-Councilman Claire, seconded by Councilman Gordon and carried, the letter was ordered filed. H. E. Williamson in a letter to the Council asked for a refund of Twenty Dollars due to an alleged discrimination in charges for the installation of water meters in some portions of the Canal Section. The matter was explained to the Council by the Water Superintendent, and on motion of Councilman Claire, seconded by Councilman Gordon and Carried, the claim was denied and the City Clerk instructed to notify the claimants accordingly. Logan Jackson, Sheriff of Orange County, in a letter to the Mayor, extended an invitation to the members of the Council to attend the meeting of the Pease Officers Association at the American Legion Hall in Santa Ana on June 6th, and on motion of Councilman Garfield, seconded by Councilman Gordon and carried, the City Clerk was instructed to thank the Sheriff on behalf of the Council for the invitation. A letter signed by various dealers in cement was read to the Council, in which protest was made against the use of 'Transit Mixed Concrete' which, it was stated lessened the employment of labor,•and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the communication was ordered filed. en i 41 A communication signed by J. A. Beek, Secretary of the Balboa Island Water Carnival Association, togetherwith an accompanying resolution adopted by that organization advocating a more rigid enforcement against law violations of any kind, was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the matter was referred to the Police Committee. A request from the 'Park - Marine Business Men's Association' of Balboa Island for the sum of Three Hundred Dollars for use in holiday festivities and advertising was read, the same being laid over to Unfinished Business.' A letter from H. L. Parks, togetherwith a petition signed by ' numerous citizens,._residents and tax - payers of Balboa Island, protesting the allocation of any public funds for,the purpose of attracting to Balboa Island and entertaining holiday crowds and transient pleasure seekers, was presented, the same being laid over to Unfinished Business. UNF'IIJISHED BUSINESS The request, laid over from a previous meeting, of the Balboa Island Water Carnival Association, for Three Hundred-Dollars for the purpose of advertising and the purchase of trophies and fireworks, was brought up and considered by the Council, with the request for a similar amount from the Park - Marine Association and the petition protesting the furnishing of any public funds for Balboa Island events. J. A. Beek addressed the Council on behalf of the Balboa Island Water Carnival Association, and H. L. Parks addressed the Council in support of the petition presented by him on behalf of numerous residents of the Island. Considerable discussion was indulged in by the Council and the various advocates of the issues involved, whereupon it was moved by Councilman Claire and seconded by Councilman Garfield, that Three Hundred Dollars be allowed for the various Balboa Island groups, subject to the approval and under the supervision of the Advertising Committee.. The motion was carried by the following roll call vote, to -wit: AYES: Councilmen Claire, Ellsworth, Garfield. ' NOES: Councilmen Gordon, Hilmer. ABSENT: Councilmen None. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the application of the Park - Marine Business Men's Association was referred to the Advertising Committee for further investigation. On motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the petition filed by H. L. Parks for the signers thereof was ordered filed. On motion of Mayor Hilmer, seconded by Councilman Garfield and carried, Fifty Dollars was allowed for the erection of a sign on Coast Highway which would advertise Balboa Island as a Home City. Claude A.' Pullen on behalf of the Corona Del Mar Property Owners Association, presented a letter to the Council asking for $150 for the purpose of staging a surf board meet at the Harbor entrance on June 24, 1934, Mr. Pullen addressing the Council regarding the request. On motion of Councilman Claire, seconded by Councilman Garfield and carried the matter was referred to the Advertising Committee for report at the next meeting. George A. Rogers addressed the Council and suggested that the City take steps toward the establishing of a recreation center on the City owned property fronting the North Channel of the Bay, stating that it might be possible to secure cooperation for the project from the.County Supervisors. H. L. Parks addressing the Council, withdrew on behalf of the Park - Marine Business wen's Association the application from that organization for funds in the sum of Three Hundred Dollars. Claude A. Pullen representing the Corona Del Mar Property Owners Association withdrew the application of that organization for an allotment of One Hundred and Fifty Dollars for a surf board event. On motion of Councilman Gordon, seconded by Councilman Ellsworth and carried the letter from Mr. Pullen was ordered filed. On motion of Councilman Garfield, seconded by Councilman Gordon and carried, the application of the Park - Marine Business Men's Association for funds was ordered filed. W Lew H. -Wallace addressed the Council concerning the advertising campaign of the Ordng6 County Coast Association, forth the purposes, plans and amounts required for the same. was taken by the Council in the matter. NEW BUSI14ESS setting No action There being two vacancies on the Planning Commission Board, Mayor Hilmer appointed E. I. Moore and Frank C. Brookings, to succeed themselves for the ensuing term. City Attorney Thompson presented a Resolution authorizing a contract between the City of Newport Beach and Frank Suttora for the Erection by the latter of an electric hoist on the City owned pier extending into the Bay from 26th Street. The Resolution was read, considered and designated Resolution No. 526, the adoption of which was moved by Councilman Claire, duly seconded by Councilman Garfield and carried by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. MINUTE RESOLUTION On motion of Councilman Claire, a resolution was offered authorizing the Mayor and City Clerk to execute on behalf of the City a Quit Claim deed in favor of Maude Thomas covering Lot 1 (Nally Z), Block 133, Corona Del Mar. The motion was duly seconded by Councilman Ellsworth and the Resolution adopted by the'following roll call vote, to -wit: AYES: Councilmen Gordon, NOES: Councilmen None. ABSENT: Councilmen None. The motion was duly seconded by Councilman Ellsworth and the Resolution adopted by the following roll call vote, to -wit: AYES: Councilmen Gordon, NOES: Councilmen None. ABSENT: Councilmen None.
