Newport Beach, January 6, 1936 The City Council of the city of Newport Beach met in regular session in the City-Council Chamber of the city of Newport Beach at 7:30 o'clock P. M. on above date, with Mayor Hilmer presiding. The roll was called showing the full Council present. REPORTS OF HEADS OF DEPARTMENTS The report of the City Treasurer was read, and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the report was accepted, the reading of the rest of the reports of Heads of Departments dispensed with and all the reports ordered filed, REPORTS OF SPECIAL COLLITTEES City Engineer Patterson reporting on the condition of the Grand Canal, Balboa Island, as complained of in a letter to the Council at a former meeting, advised that some of the old piling had been removed which had remedied matters considerably. REPORTS OF STANDING COMkITTEES None COMMUNICATIONS The application of Wm. H. McIntee for permission to install underground storage tanks for the handling of hazardous fluids at 2422 West" Central Avenue, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred,to the Fire Chief for approval. The application of B. E. Keeler for an exempt Veteran's license to sell pickles and other products to retail merchants, was on motion of Councilman Claire seconded by Councilman Ellsworth and carried, denied. The application of George C. Lovett for an exempt Veteran's license to peddle fruits and vegetables, was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, allowed. UNFINISHED BUSINESS Zoning Ordinance No. 440 was presented for final passage, being, AN ORDINANCE ESTABLISHING LAND CLASSIFICATIONS AND DISTRICTS WITHIN.THE INCORPORATED TERRITORY OF THE CITY OF NEWPORT BEACH AND REGULATING THE USES OF- PROPERTY 'THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN SAID ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AMENDMENT THEREOF AND PRESCRIBING PENALTIES FOR ITS VIOLATION. The adoption of the Ordinance was moved by Councilman Claire, seconded by Councilman Garfield and passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer, NOES: Councilmen None. ABSENT: Councilmen None. NEW BUSINESS The monthly demands having been duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed and warrants ordered drawn for same. Ordinance No. 441 was presented for the first reading, being an Ordinance amending and modigying Ordinance No. 435 relating to certain amusements and games of skill. On motion of Councilman Gordon, seconded by Councilman Garfield, the ordinance was passed to the second reading by the Hollowing vote, to-wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen Hone. Sp ORDER ASCEHTAI14ING AND DETERMINING THE PREVAILING RATE OF WAGES TO BE PAID FOR CONSTRUCTION OF ADDITION TO THE PUBLIC PIER AND FLOAT AT 19th STREET IN THE CITY OF NEWPORT BEACHo CALIFORNIA. Councilman Claire moved the adoption of the following order, to-wit: WHEREAS, the City Council did on the 30th day of December, 1935, order the construction of an addition to the public pier, together with a wooden float at 19th Street in the City of Newport Beach, California; and WHEREAS, pursuant..to Chapter 397 of the Statutes of 1931 of the State of California, it is necessary that the City Council of the City of Newport Beach ascertain and determine the general prevail- ing rate of wages on public workso and by the provisions of said Act makes it mandatory upon the awarding body of any public contract where the said body subsequently calls for bids for any public improvement, to ascertain and determine the-general prevailing rate of per diem wages in the locality in which the work is to be performed, for each craft or type of workman or mechanic needed to execute the contract, and also the general prevailing rate for legal holiday and overtime work for each craft or type of workman or mechanic; NOW, THEREFORE, this City Council of the City of Newport Beach, California, has ascertained and does hereby determine that the general prevailing rate of per diem wages in the locality in which the said work described to be performed in.the matter of the construction of said addition to the pier and wooden float, for each craft or type of workman or mechanic needed to execute contract, and also the general prevailing rate for legal holiday and overtime work for each craft or type of workman or mechanic to be as follows: Trade or Occupation Per Diem Wage Hourly Wage Rate Carpenter, Finish $8.00 $1.00 Carpenter, Rough 8.00 1.00 Calker 8.00 1.00 Engineer, Pile Driver 8.00 1.00 Guard 4.48 0.56 Laborer 4.48 0.56 Operator _ Hoist 6.00 0.75 Operator - Pump 6.00. 0.75 Operator - Crane 8.00 1.00 Painter 8.00 1.00 Pile Driver Operator 8.00 1.00 Truck Driver 6.00 0.7`Z5 Watchman 4.48 0.56 Overtime - one and one-half (1') times the above rates. Sundays and holidays (except watchmen and.guards) double the above rates. The foregoing schedule of per diem wages is bases upon a working day of eight (8) hours. The hourly wage rate prescribed hereabove is the per diem rate divided by the aforementioned number of-hours constituting a working day. Said motion was, seconded by Councilman Garfield, and upon roll call was adopted by the following vote,. to -wit: AYES: Councilmen Gord on, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen hone. Resolution Ao. 934 was presented, being a resolution pertain- ing to a certain Agreement between the city of Newport Beach and the Department of Public Works of the State of California for the expenditure of k cent Gas Tax on State Highways within the City of Newport Beach. The adoption of the resolution was moved by Councilman Claire, seconded by Councilman Garfield and passed by the following vote, to -wit: AYES:'Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES :.Councilmen None. ABSENT: Councilmen None. ADJOURNMENT There being no further businessto come before the Council, it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried, that an adjournment be taken to 7:30 o'clock P. Harvey for a license to operate a wholesale fish market. at 2802 Lafayette Street, having been approved by the Health Officer, was on motion of Councilman Ellsworth, seconded by Councilman Garfield and carried, allowed. The application of T. R. Dittmar for a permit to build a commercial pier fronting on Lots 4, 5 and 6, Block 425, Lancaster Addition, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer for approval. UNFINISHED BUSINESS Ordinance No. 441 came up for final passage, being an ordinance amending Ordinance 435 relating to certain amusement games; providing for licensing thereof and prescribing penalties for infraction of any laws in connection therewith. Upon motion of Councilman Claire, seconded by Councilman Gordon, the Ordinance was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer, NOES: Councilmen None.
