The roll was called showing the full Council present. REPORTS OF HEADS OF DEPARTMENTS The report of the City Treasurer was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the report was accepted, the reading of reports of other Heads of Departments dispensed with, and all the reports ordered filed. REPORTS OF SPECIAL COMMITTEES None REPORTS OF STANDING COUNITTEES None COMWXICATIO148 On motion of Councilman Gordon, seconded by Councilman Garfield and carried, the request of Albert Soiland, General Chairman of the Celebration Committee for the Formal Opening of Newport Bay and Ha.rbor,for the use of McFadden Place parking area for the holding of the Carnival in connection with the celebration was granted. Capt. Wm. J. Brown addressed the Council concerning the event. The application of A..B. Brown for permission to extend an existing pleasure pier fronting on Lot 46, Tract 907, Lido Isle, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of Darrell W. Ring for permission to const- ruct a commercial pier fronting on Lot 10, Tract 515, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of J. A. Beek for permission to construct a pier fronting on Lot 4, Block 7, Section 1, Balboa Island, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of Chris Anderson for permission to construct a pleasure pier fronting on Lot 47, Tract 907, Lido Isle, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of George J. Meachem for permission to construct four finger floats fronting on a portion of Lot.H, Tract 919, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The applications of Dan Humason, J. M. Fuller and Grant Fuller for licenses to operate certain games of skill and science were presented, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the applications were referred to the Police Committee for report. The application of George J. Meachem for a license to operate a restaurant on a portion of Lot H. Tract 919, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed subject to the restrictions of the Zoning Ordinance and the approval of the Health Officer. The application of George J. Meachem for a permit to operate a parking lot and Trailer Camp on a portion of Lot H, Tract 919, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, denied due to the Sanitary Ordinance respecting trailer camps. The application of E. G. Greeley for a renewal of contract for use of the City Dump Ground, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Attorney with instructions to prepare the same and the Mayor and City Clerk were authorized to execute same on behalf of the City. The letter of Gladys V. Rhodes in reference to the filling of certain bay frontage in Tract 756, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, Laid on the Table. The invitation of the Long Beach Chamber of Commerce to attend the First Annual Long Beach Institute of Government to be held in that City, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, ordered filed. I. 201 The request of Rev. Kemp J. Winkler, Pastor of Christ Church by the Sea, for the use of a City Park for Easter Services, was on motion of Councilman Garfield, seconded by Councilman Claire, and carried, granted and the City Clerk instructed to notify the applicant of the Council's action in the matter. The application of Reuben Cole for a permit to extend certain piling to the new proposed pierhead lines, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the City Engineer. The letter of Charles Fallert, Manager of District No. 14, ' National Employment Service, commending the Chief of Police and the Department for the cooperation extended by them to his organization, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to the Chief of Police.. The bid of Boyd R. Lewis.for the purchase of Lot 9, Block 9, Section 2, City owned property on Balboa, Island, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, Laid on the Table. The letter of the Secretary of the Planning Commission recommend- ing the amendment of C -1 of the Zoning Ordinance, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, Laid on the Table. The letter of Eugene Ganster, referred to the City Council by the Planning Commission, and objecting to voting of bonds for sewer construction in the Corona del Mar District, was on motion of Councilman Cordon, seconded by Councilman Claire and carried., referred to the City Clerk with instructions to advise the writer that no sewer construction was being considered for that area. Bids advertised for in the construction of an office for the Harbor Master resulted in but one bid being submitted, that of Gordon B. Findlay, the same was opened and read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the matter was laid on the Table. UNFINISHED BUSINESS ' .The application of S. M. Griffith for permission to construct a pleasure pier fronting on Lot 323, Tract 907, Lido Isle, having been approved by the City Engineer, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed. The recommendation of the Police Committee that the application of Frederic K. Brown for a license to operate certain games of skill and science be denied, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, approved. City Engineer Patterson reported on the matter of the Newport pier landing, recommending a certain type of construction for same. D. W. King and Walter Gehres addressed the Council concerning the landing and urged the repairs to the present one be made immediately. City Attorney Thompson advised the Council that this was the time to consider protests pertaining to the vacation of a portion of that certain street known as Ocean Boulevard in Corona del Mar, whereupon the City Clerk advised that no protests had been filed with him in connection with the matter; the Mayor then asked if anyone present desired to protest the proceedings. No one responded. Whereupon Councilman Ellsworth moved the adoption of Resolution No. 943, being a Resolution Ordering Improvement. The motion was duly seconded by Councilman Gordon and the Resolution was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield. NOES: Councilman Hilmer. ABSENT: Councilmen None. ' Councilman Claire moved the adoption.of an Emergency Resolution authorizing the City Engineer to proceed without delay the construction of a new landing for the Newport Pier and repairs to the existing landing. The Resolution was considered and designated Resolution No. 944. The motion was duly seconded by Councilman Gordon and passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. 202 01 NEW BUSINESS The monthly demands having been duly audited by the Finance Committee, it was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the demands be allowed and warrants ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Garfield and carried, the City Engineer was instructed to prepare plans for the construction of a comfort station at Corona del Mar. City Engineer Patterson reported that there had been several protests filed with the State Board of Health opposing the granting of the permit to construct the sewage plant south of the ' State Highway and easterly of the Santa Ana River, and it was his opinion that the protests would be withdrawn if the site for the plant was located at least 1,000 feet northerly of the State Highway and tMeterly of the Santa Ana River. Whereupon, Councilman Claire moved the adoption of the following resolution: WHEREAS, certain property owners have registered objections to the locating of the sewage plant southerly of the State Highway and easterly of the Santa Ana River, in accordance with the applica- tion of the City of Newport Beach, dated February 3rd, 1936; and WHEREAS, the locating of the sewage plant approximately 1,200 feet northerly of the State Highway and easterly of the Santa Ana River would be less objectionable to the property owners; NOW, THEREFORE, BE IT RESOLVED: That the application by the City of Newport Beach to the State Board of Health be amended, as follows: "For the construction and operation of a sewage settling plant on a ten acre site 1,000 feet - northerly of the State Highway and easterly of the Santa Ana River, the effluent to be discharged into the ocean at a point not less than 1,500 feet oceanward of the hightide line. The settling tank will be designed to provide a 45 - minute maximum hourly detention period at the rate of two and one -half million gallons per day. The digestion tanks will provide a capacity for 20,000 people at one and one -half cubic feet per capita. The effluent and digestive sludge will be discharged into the Orange I County Outfall on the ocean side of the existing pumping plant. The plant will be constructed in accordance with standard design, includ- ing gas collection and burning." Which motion was seconded by Councilman Gordon and adopted ly the following vote, to -wit: AYES, COUNCILMEN: Claire, Gordon, Hilmer, Ellsworth, Garfield. NOES: Councilmen None. Rinehart, On motion of Councilman Garfield, seconded by Councilman Gordon and carried, City Engineer Patterson was granted the necessary travelling expenses to San Francisco and-return in order to appear before the State Board of Health in connection with the City's application for a disposal site for the proposed sewer system improvement. Grant Fuller addressed the Council in connection with this application for a license to operate a game of skill and science at 109 Palm Street, the Council considered the matter and on motion I of Councilman Gordon, seconded by Councilman Garfield and carried, the license was granted. ADJOURNMENT There being no further business to come before the Council, it was moved by Councilman Claire, seconded by Councilman Garfield and carried, that an adjournment be taken to .,'::30_p' clock P. The City Council of the City of Newport Beach met in regular adjourned session in the City Council Chambers of the City of Newport Beach at 7:30 p. m. on above date with Mayor Hilmer in the Chair. The roll was called showing the full Council present. REPORTS OF SPECIAL COMMITTEES Councilman Gordon reporting on the proposed office to be constructed for the Harbor Master advised that the price submitted by the only bidder thereon was in excess of the amount originally estimated and recommended that for the time being not to proceed with the building and moved that the bid be rejected and-the check accompanying same be returned to the bidder, the motion was seconded by Councilman Ellsworth and carried. City Attorney Thompson reporting on the request of certain operators of rental boats that an ordinance be passed whereby it would become illegal for persons to take rented boats into the ocean without written permission from the owners of said boats, advised that the City Council was without jurisdiction in the matter, and on motion of Council- man Claire, seconded by Councilman Garfield and carried, the City Clerk was instructed to advise the petitioners accordingly. COMMUNICATIONS The application of James L. Rubel for permission to construct a pleasure pier fronting on Lot 310 and the West f of Lot 311, Tract 907 Lido Isle, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of James S. White for permission to construct a pleasure pier fronting on Lot 448, Tract 907 Lido Isle, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of M. Gladys Watson for permission to construct a pleasure pier fronting on Lot 37, Block A, East Newport, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The application of C. C. Taylor for a license to operate a pool hall in the Corum Building on Lot 9, Block 21, Newport Beach-, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed. The application of George J. Meachem to operate a parking lot on a portion of Lot H, Tract 919, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed subject to conform- ing to the lighting regulations. ,'he application of Mrs. Charles Blancheri for a license to operate a cafe in the Scott Building on a portion of Lot H, Tract 919, having been approved by the Health Officer, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed. The communication of J. B. Wilbur, recording Secretary of the Orange Ministerial Union expressing the appreciation of that body for the efforts of the City Officials in maintaining order and bettering. conditions during the Easter vacation, was read, and on motion of Council- man Garfield, seconded by Councilman Ellsworth and carried, the City Clerk was instructed to extend the thanks of the City Council to the writer.
