HomeMy WebLinkAbout10/08/1936 - Adjourned Regular Meeting272 L, MM P MM FAIN MMMM= CSi Newport Beach, October 5, 1936. , The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 1 o'clock P. M. on above date with Mayor Williamson presiding. The following Councilmen responded to the roll call: Gordon, Claire, Whitson, Garfield, Williamson. Absent -none. Communication from the Federal Emergency Administration of Public Works in connection with the grant allocated to the City of Newport Beach (Docket No. Calif. 1256 -R) for the construction of the Balboa Island Sea Wall was read in full and upon motion of Councilman Claire, seconded by Councilman Garfield and carried, the communication was ordered filed. Councilman Claire moved the adoption of a resolution of Award of Contract which was duly seconded by Councilman Garfield and carried by the following vote, to -wit: AYES: Councilmen Gordon,.Claire, Whitson, Garfield, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Said resolution being in words and figures, following to -wit: RESOLUTION OF AWARD OF CONTRACT , 'No. 999 RESOLVED, that the City Council of the City of Newport Beach, California, having in open session on the 5th day of October, 1936, opened, examined and publicly declared all sealed proposals or bids for the following work to be done and improvements to be made in the said City, to-wit- The improvement of South Bay Front and certain other streets and public ways in Balboa Island, and certain tide lands owned by the City of Newport Beach adjacent to said Balboa Island, by the construction of certain cement concrete bulkhead and appurtenances, cement concrete sidewalk, cast iron pipe storm drains and appurten- ances, cement concrete curb inlets, reinforced concrete coping on top of existing bulkhead, public piers of wooden and cement concrete construction, including piles, decks, guard rails and floating mmorings, with structures and appliances necessary and convenient thereto, and by the moving and installation on top of said bulkhead of certain existing ornamental light poste, together with wires, cables, conduit and other suitable and necessary appliances for the purpose of light- ing said public ways and by the installation of posts, wires, cables, conduits, King lanterns (Design No. 1241), and suitable and necessary appliances for the purpose of lighting said public piers, as more particularly described in Resolution of•Intention No. 915, passed and ' adopted by the City Council of said City on the 12th day of November, 1935, and on file in the office of the City Clerk of said City. For further particulars, reference is hereby made to said Resolution of Intention No. 915, and to plans, profiles and sections for said improvements tp being Plan No. 400, consisting of twelve (12) sheets, numbered.one (1) to twelve (12) inclusive, and Standard Plan No. 1047, all on file in the office of the City Engineer of said City of Newport Beach, and to specifications for said work adopted by the City Council on November 12th, 1935, and on file in the office of the City Clerk of said City, and all of said plans, profiles and specifications heretofore approved by said City Council are incorporated herein and made a part hereof and reference is hereby made thereto for a more particular description of said work. The said City Council has declared and determined that the said contemplated work and improvement hereinbefore mentioned is, in the opinion of said City Council, of more than local or ordinary 27.E public benefit, and the expenses of the said work and improvement are made chargeable upon a district, except as hereinafter particularly provided. For a particular description of the said. district, reference is hereby made to the said Resolution of Intention No. 915.. . The said City Council has determined and declared that serial bonds bearing interest at the rate of seven per cent (7"k) per annum shall be issued to represent each assessment of Twenty -five and no /100 Dollars ($25.00) or more, remaining unpaid for thirty (30) days after the date of the warrant. Said serial bonds shall extend over a period ' ending nine (9) years from the second day of January next succeeding the next October fifteenth following their date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the City Treasurer, and the same shall be disbursed by him, all as provided in the "Improvement Act of 1911,11 hereinafter referred to. As aid to the district as proposed, the City has filed with the Federal Emergency Administration of Public Works, under the provis- ions of the Emergency Relief Appropriation Act of 1935 of the Congress of the United States an application for a Grant of a sum equal to forty -five per cent J45 %) of the total cost of the improvement, and that preliminary approval and allotment has been made by said Administration for such Grant. Under the rules and-conditions set up under said Act, the amount of the Grant will be determined after bids are received for the work and submitted to the Government authorities for approval. All of the work herein ordered and for the issuance of bonds shall be done and carried through in pursuance of an Act of the Legisla- ture of the State of California, designated "Improvement Act of 1911," ,approved April 7, 1911, and all acts amendatory thereto. Said City Council hereby rejects all of the said proposals or bids, except the next hereinafter mentioned, and hereby awards the contract for the said work and improvement to the lowest, regular, responsible bidder, to -wit, to: Griffith Company at the price named in its bid for the said work, on file in the office of the City Clerk of the said City. The City Clerk of the said City is hereby directed to cause a Notice of Award of Contract to be published in the manner and form required by law by two insertions in the "NEWPORT NEWS," a weekly newspaper published and circulated in the City of Newport Beach, and hereby designated for that purpose by the said City Council. PASSED AND ADOPTED by the City Council of the said City of Newport Beach, California, this 8th day of October, 1936, by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson. I hereby certify that the above and foregoing Resolution of Award of Contract was passed and adopted by the City Council of the said City of Newport Beach, California, at the time and by the vote above stated. On motion of Councilman Gordon, seconded by Councilman Garfield and carried, it was decided and authorized that two representatives for the City of Newport Beach be sent to Washington in connection with the hearing before the Rivers and Harbor Board of Engineers to be held in that City on Tuesday, October 20, 1936, said authorization being contingent on the County of Orange bearing a portion of the expenses thereof. On motion of Councilman Claire, seconded by Councilman Garfield and carried, a demand in favor of Theodore Robins and duly audited by the Finance Oommittee, was allowed and a warrant ordered drawn for same. 274 The matter of the automobile insurance covering the City's fleet of cars was reported on by the City Engineer, the same having been referred to that Department for checking at a previous meeting. Tabulated figures of the various bids and standing of the insurance companies submitted by same were furnished by the City Engineer, together with the coverage indicated in varying amounts. After discussing the question at length it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the Mayor be author- ized to appoint a Committee to investigate the automobile.insurance and report at the next meeting of the Council. City Attorney Thompson presented an ordinance, beingg an ordinance amending certain sections of Zoning Ordinance No. xO , and on motion of Councilman Claire, seconded by Councilman Gordon and carried the ordinance was passed to the second reading. Grainger Hyer addressed the Council regarding certain quit claim deeds in connection with the widening of Marine Avenue, Balboa Island. ADJOURNMENT There being no it was moved by Councilm and carried, that an adjournn further business to come before the Council, an Claire, seconded by Councilman Whitson APPROVED: City Clerk. SPECIAL MEETING Newport Beach, California. October 29, 1936. A special meeting of the City Council of Newport Beach, held pursuant to the preceeding call of the Mayor, was held on the 29th day of October, 1936, at the City Hall. The meeting was called to order by the Mayor and on roll call the following answered present: Councilmen Gordon, Claire, Garfield and Williamson. The following were absent: Councilman Whitson. The call for the special meeting was read by the Mayor, and on motion of Councilman Gordon and seconded by Councilman Garfield and carried, the Notice of Call was ordered filed. After discussion of the offer of the United. States of America to aid by way of grant in financing the construction of sewers and sewage disposal plant, the following Resolution, numbered 1000, and entitled "A RESOLUTION AOCEPTING THE OFFER OF THE UNITED STATES TO THE CITY OF NEWPORT BEACH TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF SEWERS AND SEWAGE DISPOSAL PLANT" was proposed by Councilman Gordon and read in full: RESOLUTION NO. 1000 A-RESOLUTION ACCEPTING THErOFFER OF THE UNITED STATES TO THE CITY OF NEWPORT BEACH TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF SEWERS AND SEWAGE DISPOSAL PLANT.
