AP ..• a� r'of the City of NL�:vrD_ort Be City Engineer Patterson presented the matter of Plans and Specifications in connection with the Sewer Project, and on motion of Councilman Claire, seconded by Councilman aarfield and carried, the same was laid over until the next meeting of the City Council. - -1 Newport Beach, November 2, 1936- The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock P. M. on above date with Mayor Williamson presiding. Upon roll call the following answered present: Councilmen Gordon, Claire, Whitson, Garfield and Williamson, Absent; Councilmen None. The report of the City Treasurer was read, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the report was accepted, the reading of reports of other Heads of Departments dispensed with, and all the reports ordered filed. Vertrees for a permit to install underground storage facilities for the handling of petroleum products, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to the approval of the Fire Chief and-Zoning restrictions. The application of Simon Jesberg and E. Goodell Sherman for a permit to construct an addition of eight feet to an existing pleasure pier, was on motion of Councilman Claire, seconded by Councilman dhitson and carried, referred to the City Engineer for report. The application of Henry P. Shaw for a permit to build a pleasure pier fronting on Lots 858 and 859, Tract 907, Lido Isle, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Engineer for report. r 277 The application of Prank L. Scott for a permit to build a pier fronting on a portion of Lot H, Tract 919, was on motion of Council- man Gordon, seconded by Councilman Garfield and carried, referred to the City Engineer for report. The letter of Mrs. Edwin M. Williams of Corona del Mar, request - int that the City Council take the necessary steps toward establishing a recreation center in that district, was on motion of Councilman Whitson, seconded by Councilman Gordon and carried, referred to the Street Committee. Whereupon Mayor Williamson appointed a committee consist- ing of Councilman Claire and Councilman Garfield and Assistant Street Superintendent Siegel to investigate the matter and report. The claim filed by Attorney Wm. H. Brauner in behalf of a client by the name of Lindsey for alleged damages said to be due to a defective sidewalk, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Attorney. The demand filed by Dr. C. C. Synder of Pasadena in the sum of ninety -two dollars for medical services for L,rs. k. M Gasseling, was on motion of Councilman Claire, seconded by Councilm. an Whitson and carried, denied. The report of City Engineer Patterson in connection with the installation of the 20" cast iron water main siphon across the channel westerly of the Turning Basin, was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, was ordered filed. The report of City Engineer Patterson in connection with an appearance by him and Harry Welch before the Rivers and Harbors Board of Engineers at Washington, D. C. on October 19, 1936, was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, was ordered filed. The report of City Attorney 'Thompson regarding the Supreme Court's decision of the case of Newcomb vs The City of Newport Beach and in favor of the City, was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the report was ordered filed. City Attorney Thompson advised the Council that since submitting the report a re- hearing of the case sought by the plaintiff had been denied by the Supreme Court. ' The report of the City Attorney in connection with the case of metropolitan Trust Company vs City cf Newport Beach for a refund of taxes and of judgment being rendered in favor of the City, was read, and on motion of Councilman Garfield, seconded by Councilman Claire and carried, the report was ordered filed. The letters of Lew H. 4allace and of Senator iiaaan Johnson relating to a Government grant for the Sevier Project, were read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the letters were ordered filed. The letter of Willis D. %larner,representing the Committee appointed to consider the proposition of the Lletropolitan hater District, requesting that a representative from this City attend a meeting to be held in the City of Orange on November 23rd, was read, and on motion of Councilman Garfield, seconded by Councilman Whitson and carried, City Engineer Patterson was delegated to attend the meeting. The letter of the Fish & Game Development Association inviting the City of Newport Beach to join in a state -wide movement in conserving the sardine supply being depleted by floating reduction plants, was read, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the matter was Laid on the Table. The specimen trailer camp ordinance submitted by the Board of 'Health, was presented, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the same was referred to the Planning Commission for study. The letter of Mayor L. E. Olson of Glendale asking support ' for Proposition No. 15 on the November election ballot, was read, and on motion of Councilman Claire, seconded by Cowzcilman Gordon and carried, the same was ordered filed. The letter of thenalboa Yacht Club requesting that the contractors on the Balboa'Island Seawall start operations at the southeast end of the Island, was on motion of Councilman Garfield, seconded by Councilman Gordon and carried, referred to the City Engineer. The letter of Clanton Reah, Secretary of the Shoreline Planning Association, asking the City of Newport Beach to pass a resolution in opposition to Proposition No. 4 on the November ballot, said Proposition pertaining to tideland oil development, was read. On motion of Councilman Claire, seconded by Councilman Larfield and carried, the communication was ordered filed. 278 UNFIAISHED BUSINESS City Engineer Patterson reported on the City's Automobile Insurance, letters of L. 17. Briggs, Otto G. Wildey Agency and Lew H. Wallace were read, and after considerable discussion regarding the insurance matter, it was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the same be Laid on the Table until the next meeting of the Council. The application of 14rs. Arthur Davis for permission to construct a pleasure pier fronting on Lot 313, Tract 907, Lido Isle, having been approved by the City Engineer, was on motion of Councilman Claire, seconded by Councilman-Garfield and carried, allowed. NE9 BUSINESS The monthly demands having been duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed and warrants ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the City Engineer and City Attorney were instructed to prepare an escrow agreement between the City of Newport Beach and the Pacific Electric Railway for the purchase of certain land owned by the latter and situated in the vicinity of Coast Boulevard and 23rd Street in Newport Beach. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the fees, other than salary df the City Attorney, were placed on a permanent basis at twelve dollars and fifty cents per day for office work and twenty -five dollars per day for appearance in court on behalf of the City. City Attorney Thompson presented a resolution being Resolution No. 1001. A quitclaim deed dated the 29th day of September, 1936, from FLORENCE HARRIET REYNOLDS WRIGHT MORREY, formerly known as Florence Harriet Reynolds Wright, the duly qualified and acting Trustee under and by virtue of the decree of distribution heretofore made and entered by the Superior Court of the State of California, in and for the County of Los Angeles, in that certain proceeding entitled "In the matter of the Estate of Joseph Sheridan Reynolds, deceased ", Probate No. 94045, and NONA HYER, also known as Nona F. Hyer, to the City of Newport Beach, a Municipal corporation of the sixth class of Orange County, California, remising, releasing and quitclaiming to the City of Newport Beach all of their right, title and interest in the following described real property, to -wit: All that certain real property situated in the City of Newport Beach, County of Orange, State of California, and more particularly described as follows, to -wit: All that portion of Lot "B" as laid out and shown on a map of Section Four, Balboa Island, recorded in Book 7, page 37 of L.iscellaneous Daps, Records of Orange County, California, lying between the northerly prolongation of the Westerly line of Lot 16, Block 14, of said Section Four and the Northerly prolongation of the Easterly line of Lot 17, of said Block 14. was presented to the •0ity Council of the City of Newport Beach, California. -Whereupon, Councilman Vrnitson made a motion duly seconded by Councilman Garfield and carried, that said quitclaim Deed be accepted by said City of Newport Beach,`and the Clerk instructed to record the same forthwith with the County Recorder of Orange County, California. That said motion was carried by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Garfield, ',Williamson. NOES: Councilmen None. ABSENT: Councilmen None. City Attorney Thompson presented a resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach a Crop Lease in favor of D. A. Bear and Karvey L. Bear for a period of three years and ending on the 30th day of September, 1939• The resolution was,read, designated Resolution No. 1002, the adoption-of same being moved by Councilman Garfield, duly seconded by Councilman Claire and passed-by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson. NOES: Councilmen None. ABSENT: Councilmen-None. Cn 279 City Engineer R. L. Patterson presented Plan No. 401 and specifications for the construction of Sanitary Sewer trains, Sewage Disposal Plant, Sewage Pumping Stations and other work incidental thereto. Upon motion of Councilman Whitson, seconded by Councilman Claire and carried, the plans and specifications, as presented by the City Engin- eer, were adopted for the work described in said plans and specifications. Upon motion of Councilman Claire, seconded by Councilman Gordon and carried, the City Clerk was instructed to publish a Notice Inviting Proposals for the construction of Sanitary Sewer Mains, Sewage Disposal Plant, Sewage Pumping Stations and other work incidental thereto, three ' times in the "Newport News ", a weekly newspaper printed, published and circulated within the said city and is hereby designated for that purpose, subject to approval of the State Director of the Federal Emergency Admin- istration of Public '+7orks. Councilman Claire then offered and moved the adoption of Reso- lution No. 1003, entitled "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ASCERTAINING AND DETERIINIXG THE PREVAILING RATE OF WAGES TO BE PAID FOR CONSTRUCTION OF SANITARY SEWER MAINS AND APPURTENANCES, SEWER DISPOSAL PLANT AND APPURTENANCES, SEWER PUMPING STATIONS AND APPUR- TENANCES, AND OTHER WORK AND IMPROVEMENT, SERVING SAID CITY OF NEWPORT BEACH, CALIFORNIA." Said motion was seconded by Councilman Garfield, and upon roll call.was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson.. NOES: Councilmen None. ABSENT: Councilmen None. Councilman Gordon then offered and moved the adoption of Resolu- tion No. 1004, directing and authorizing the Mayor and City Clerk of the City of Newport Beach to execute in the name and on behalf of the City of Newport Beach an Agreement with C. H. Currie and-F. S. Currie for engineering services in preparing plans for the Sewage Disposal Plant. The motion was seconded by Councilman Garfield, and upon roll call was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson. NOES: Councilmen None. ' ABSENT: Councilman None. ,xlenn E. luiller addressed the Council on matters pertaining to the grant of the U. S. Government toward the construction of the new sewer project.
