JOHNSON AFTER REPORT AND RECOMMENDATION OF PLANNING. variance to COUISSION AND PURSUANT TO ORDINANCE NO. 440 AND.AMENDMENTS THERETO, was presented, H.L.Johnson and on motion of Councilman Whitson, seconded by Councilman Gordon, the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. J. Martin Clark addressed the Council concerning the locating of a swimming float at the foot of Adams Street, Balboa, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the matter was referred to the City Attorney with instructions to report to the City Council at the next meeting thereof. The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock p. m. on above date with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon, Claire, .,Brown end Williamson. ... Absent: Councilmen Whitson. REPORTS OF'HEADS OF DEPARTMENTS The report of the City Treasurer was read d, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the report was approved, the'reading of other reports-of Departmental Heads dispensed with and all reports ' ordered filed. REPORTS OF SPECIAL COlaiITTEES None. REPORTS OF STANDING COMMITTEES None. • COMMUNICATIONS The application of William F. Stephens for permission to install under- ground storage for petroleum products at 803 State Highway in Tract 919, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed subject to the approval of the Fire Chief and Zoning restrictions. The application of Frances Gochenouer fot a license to conduct a lunch counter at 23rd Street and Ocean Front, Newport Beach, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed subject to the approval of the Health Officer. The application of Harold C. Simonds for permission to install a pier barge fronting on Lot 865, Tract 907, Lido Isle, was on motion of Councilman ' Claire, seconded by Councilman Gordon and carried, referred to the City Engineer for approval. The request of H. N. Shivers for a lease on 600 feet of certain City owned property in Tract 919, was presented, and after some discussion was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to a committee to report on same in two weeks. The letters of Lois C. Mason, Florence M. Pollard and Etta and Lydia Griffith, requesting that something be done to curb the influx of dogs on Balboa Island and that all dogs be innoculated against rabies, were presented, and on ' motion of Councilman Claire, seconded by Councilman Gordon and carried, were laid on the Table. The letter of Dr. Albert Soiland concerning the easterly line of Lot • 1, Tract 710 was presented, and after considering the matter it was moved by Councilman Claire, seconded by Councilman Brown and carried, that the matter be referred to the City Engineer. 1 J.Martin Clai swimming floa= Roll Call. Doris Green The letter of Doris Green in regard to the City and County having made flood damage any arangements toward rehabilitating or restoring property in the Seashore Colony sum of $200.00; and Tract damaged by the flood, was presented, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, was referred to the City Engineer. Mrs.T.H.Webb The letter of Mrs. T. H. J.E.Roecher The letter from J. E. Roecher concerning the condition of property on cond. of prop. Canal Street in the Seashore Colony Tract was presented, and on motion of Counoil- man Gordon, seconded by Councilman Claire and carried, the matter was referred to 1935 -39, and unpaid improvement assessments of record. Also subject to conditions, the City Engineer. J. McCabe The letter of J. McCabe asking to rent certain City owned property at application to 23rd Street and Ocean Front was presented, and on motion of Councilman Claire, rent prop. seconded by Councilman Gordon and carried, the letter was ordered filed. The report of Harbor Master Bouchey regarding a meeting held in San • H.M. Bouchey H.M. Francisco with Captain Rhodes, Superintendent of Lighthouses and in connection lights with the jetty lights and fog horn, was presented, and on motion of Councilman etc. Claire, seconded by Councilman Gordon and carried, was ordered filed. UNFINISHED BUSINESS ' H.L.Beezley The application of H. L. Beezley for an exempt veteran's license to ex. license peddle hand made novelties, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, referred to Chief of Police Hodgkinson. NEW BUSINESS Demands. The monthly demands having been duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed and warrants ordered drawn for same. Res. 1330 Resolution No. 1330. WHEREAS, DONALD H. LEBO and CELESTINE M. LEBO, sale of lots husband and wife, have this day offered to the City of Newport Beach, the sum to Donald H. of $200.00 for Lot 15 and the Northeasterly one -half of Lot 16, Block 743, Corona Lebo et ux. del Mar, in the city of Newport Beach, as shown on Map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, records of Orange County, California; and WHEREAS, the said price is a fair and adequate price as and for the purchase price of said lots; and WHEREAS, the City Council of the City of Newport Beach deems that it is for the best interests of said City that said property be sold for the said sum of $200.00; and WHEREAS; the price offered is just, fair and adequate and is not disproportionate to the real value of the property above described. NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the said Donald H. Lebo and Celestine M. Lebo, husband and wife for the sum of $200.00, free and clear of all encumbrances, subject to the taxes for the fiscal year 1935 -39, and unpaid improvement assessments of record. Also subject to conditions, restrictions and reservations of record. The Mayor and the City Clerk are hereby ' authorized and directed to execute and deliver a deed for said property to the said parties upon receipt of the consideration above set forth. BE IT FURTHER RESOLVED: That the sum of $20.00 be paid to Gerald W. Ritchie, as and for his commission for the negotiating of the sale of said real property to Donald H. Lebo and Celestine'M. Lebo, his wife, as joint tenants, said sum being a fair and reasonable commission to be allowed in said sale, and • said broker being a licensed realtor of the City of Newport Beach. Thompson for permission to construct a pleasure F.B.Thompson pier fronting on Lot 12, Block 2, Tract 626, the plans for which having been changed pier permit in accordance with the plans and specifications approved by the City Engineer and adopted by the City Council, was on motion of Councilman Claire, seconded by Council- man Brown and carried, allowed. The application of Charles Weinberg for permission to construct a pleasure pier fronting on Lot 333, Tract 907, Lido Isle, having been approved by the City Engineer, was on motion of Councilman Brown, seconded by Councilman Claire and carried, allowed. City Engineer Patterson reporting on the request of the Corona del Mar Civic Association for a float to be placed at the foot of Fernleaf or Dahlia Avenues, advised that inasmuch as' a new barge was to be constructed for the dredger, the present dredger barge could be placed at the Camp Ground and the Camp Ground float could be placed at the foot of Fernleaf Avenue. Whereupon it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the City Clerk advertise for bids for the construction of a barge for the dredger in accordance with the plane and specifications prepared by the City Engineer. - H. M. Lane addressed the Council regarding reports over the radio of dogs infected with rabies and suggested that it should be advertised that there is no pestilence of any kind here. BAXTER, AFTER REPORT AND RECOMMENDATION variance to OF PLANNING COMMISSION AND PURSUANT TO ORDINANCE NO. 440 AND AMENDMENTS THERETO, was C.F.Baxter presented, and on motion of Councilman Claire, seconded by Councilman Gordon the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Brown, Williamson. Councilman Brown presented the matter of prohibiting the sale and shooting Sale and 'of fire works as requested by certain citizens of Balboa Island, and on motion of shooting of Councilman Brown, seconded by Councilman Gordon and carried, the City Clerk was fireworks instructed to notify the parties making the request, that inasmuch as the County of Orange was contemplating the adoption of an ordinance prohibiting the sale of fire- works, the city would cooperate with the County at that time. The application of J. W. Peyton Boat Co. for permission to construct boat Peyton Boat y slips fronting on a portion of Lot H, Tract 919, having been approved by the City Co. boat Engineer, was on motion of Councilman Claire, seconded by Councilman Gordon and slips. carried, allowed. Thompson for permission to construct a pleasure F.B.Thompson pier fronting on Lot 12, Block 2, Tract 626, the plans for which having been changed pier permit in accordance with the plans and specifications approved by the City Engineer and adopted by the City Council, was on motion of Councilman Claire, seconded by Council- man Brown and carried, allowed. The application of Charles Weinberg for permission to construct a pleasure pier fronting on Lot 333, Tract 907, Lido Isle, having been approved by the City Engineer, was on motion of Councilman Brown, seconded by Councilman Claire and carried, allowed. City Engineer Patterson reporting on the request of the Corona del Mar Civic Association for a float to be placed at the foot of Fernleaf or Dahlia Avenues, advised that inasmuch as' a new barge was to be constructed for the dredger, the present dredger barge could be placed at the Camp Ground and the Camp Ground float could be placed at the foot of Fernleaf Avenue. Whereupon it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the City Clerk advertise for bids for the construction of a barge for the dredger in accordance with the plane and specifications prepared by the City Engineer. - H. M. Lane addressed the Council regarding reports over the radio of dogs infected with rabies and suggested that it should be advertised that there is no pestilence of any kind here.
