In. for the operation of a coffee and tea wagon, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to such restrictions as are embodied in Ordinance No. 471. The application of the Newport Ice and Cold Storage Co. for the operation of an ice plant and delivery trucks, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to such restrictions as are embodied in Ordinance No. 471. The application of Lester G. Rees for the operation of an ice plant and delivery trucks, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to such restrictions as are embodied in Ordinance No. 471. The application of W. J. Gehres for a license to run a restaurant at 517 - 30th Street, Newport Beach, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed subject to the approval of the Health Officer. The application of Paul Teeter, Jr., for a license to operate a "Guess Your Age and Weight" game, was on motion of Councilman Claire, seconded by Council- man Whitson and carried, allowed subject to being on private property. The applications of H. E. Kendall for permission to construct a barge and two anchor pilings fronting on Lots 5 and 6, Block 2, Section 2, Balboa Island; D. B. Maurice to cast and set two mooring piling fronting on Lot 69, Tract 907, Lido Isle; Ruth Jordan to place barge and anchor piling in front of existing pier fronting on Lot 15, Block 5, Section 5, Balboa Island; and Carl T. Long to construct pier and barge fronting on Lot 1, Block 1, Tract 742, were presented, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the applications were referred to the City Engineer. The application of John Vogel for a license to handle bicycles and merchandise at 308 Marine Avenue, was on motion of Councilman Claire,seconded by Councilman Whitson and carried, allowed subject to conforming with the bicycle Ordinance. The application of Arthur Schweizer for a veteran's exempt license to peddle fruits and vegetables, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, Laid on the Table. The application of E. B. Alexander for a license to operate a shooting gallery in the 'Fun Zone', Balboa, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, denied due to the zoning restrictions. The letter of Earl R. Tibbets regarding permit to conduct live bait and charter boat fishing dock at 711 Coast Highway on a percentage or flat rate under one license, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, denied due to an existing ordinance requiring each boat to have a separate license, and the City Clerk was instructed to notify the applicant. 0 r 0 • The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 o'clock on above date with Mayor Williamson presiding. Roll Call The roll was called, the following Councilmen answering present: Gordon, !Whitson, Claire, Brown and Williamson. Absent, Councilmen None. REPORTS OF HEADS OF DEPARTMENTS On motion of Councilman Claire, seconded by Councilman Whitson and carried, the reading of reports of Heads of Departments was dispensed with and all .reports ordered filed. REPORTS OF SPECIAL COMMITTEES Parking bet Councilman Whitson reported on the matter of parking between 19th and 19th & 23rd 23rd Streets as requested and petitioned for by property owners in that district, Streets advised the Council that in his opinion the prohibiting of parking would invite speeding, and also recommended that the Newport Beach Branch of the Bank of America be granted a 10 minute green zone with a capacity for two cars. • COMMUNICATIONS Hal G. Boehmer, Lot 43; Clarence White, lot 60; Wm. H. Schell, Lot 344; and R. E. Campbell, Lot 452, all in Tract 907, Lido Isle, they were on motion of Councilman Claire, seconded by Councilman Whitson and carried, allowed. The City. Engineer having approved the application of Bay Island Club for an extension to an existing pier, it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that same be allowed. The City Engineer having approved the application of Ross A. Williams for the construction of a landing float and ramp fronting on Lot 7, Block 635, Canal Section, it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that same be allowed City Engineer-'. Patterson advised the Council that a Standard Plan for the construction of steps over the seawall of the Grants Canal, Balboa Island, was being prepared and that two requests had been received for applications for same. The letter of James Irvine protesting the leasing of City owned bay ' frontage on the North Channel for industrial purposes to private parties, was presented, and on motion of Councilman Claire, seconded by Councilman Whitson • and carried, the letter was ordered filed. The request of Roland Vallely for a permit to install a float fronting on Lot 6, Block 9, Section 1, Balboa Island, was presented, together with the endorsement of the owner of above property and a protest against the installation ' of the float from Edward J. Power of 112 Opal Street, Balboa Island. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the matter was referred to the City Engineer. The letter.of Watson Airfotos Inc., soliciting the City's cooperation with Orange County in an aerial mosaic map, was presented, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the same was ordered filed. The invitation of the City of Huntington Beach to participate in their Fourth of July dalebration was presented, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, was ordered filed. The letter to the Water Committee from the Worthington Meter Company was presented, and on motion of Councilman Gordon, seconded by Councilman Whitson z. and carried, was referred to the Water Superintendent. �i The letter from the Planning Commission in�connection.with an application := for the rezoning of certain districts lying between the Westerly line of 19th St. and the Easterly line of 30th Street and the Northerly line of Central Avenue and et the Bay Front from Zone C -2 to Zone M -1 in order to permit the smoking of fish, was presented with the Planning Commission's recommendation that the same be denied, and on motion of Council..am Gordon, seconded by Councilman Whitson the recommendation of the Planning Commission was approved by-the following vote, • to -wit: • AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. UNFINISHED BUSINESS ' Resolution No. 1364, being a resolution re- zoning a portion of Lot "A ", Tract 919, was presented, and on motion of Councilman Gordon, seconded by Council- man Claire, the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. Ordinance No. 474, being AN ORDINANCE OF THE CITY OF NEWPORT BEACH GRANTING TO J. A. BEEK, A FRANCHISE FOR CE?TAIN PURPOSES WITHIN THE SAID CITY OF NEWPORT BEACH, was presented and read, and on motion of Councilman Claire, • seconded by Councilman Whitson and carried, the -ordinance was passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. The communication of Grainger Hyer in connection with the granting of a ferry franchise, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, ordei`ed filed. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the firm of Crenshaw, Diehl & Wright were authorized to be employed for the auditing of the City books. Resolution No. 1365, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach certain escrow instructions in connection with the purchase of certain property from Ralph P. Maskey and Irene Maskey, his wife, was presented and on motion of Councilman Claire, seconded by Councilman Whitson, the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Resolution No. 1366. A Grant Deed dated the day of July, 1935, from RALPH P. ITEEREUPON, Councilman Claire made a motion, duly seconded by Council- man Whitson and carried, that said Grant Deed be accepted, and that the City Clerk be instructed to record the same forthwith with the County Recorder of Orange County, California. Resolution No. 1367, being a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF 1/4 CENT GAS TAX ALLOCATED FOR STREETS OF MAJOR IMPORTANCE, was presented, and on motion of Councilman Claire, duly seconded by Councilman Whitson the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Anti - picketing I Councilman Whitson brought up the matter of an anti - picketing ordinance ordinance and presented a copy of the Orange County ordinance in connection question. therewith, and upon the advise of the City Attorney that same was not applicable to the question at hand, no action was taken. Res. 1365 Resolution No. 1368, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport a certain agreement Agreement of Purchase with the General Electric Company, a New York corporation, was with Gen.Electric presented, and on motion of Councilman Claire, seconded by Councilman Whitson, the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson NOES: Councilmen None. M., July 18, 1939- 4 0 ayor 66f _the city of Newport Beach 0 0 C] 0 City Engineer Patterson advised that some changes should be made Piers on in the construction of piers on Balboa Island and recommended that combination Balboa Island piers should be considered as a solution to the congestion of too many piers, whereupon Mayor Williamson appointed Councilman Brown, Chairman and Councilman Gordon and the City Engineer as a committee to study the pier situation. The letter of City Engineer Patterson regarding the non- compliance of Frank Andrews pier permit granted to Frank Andrews in which he had been duly notified that a pier nearing would be held in connection with same at 7:30 P. M. July 18th at which the matter would be considered, was presented and on motion of Councilman Gordon, seconded by Councilman Brown and carried, the City Engineer was notified to instruct Mr. Andrews to remove the float if found to be in employment On motion of Councilman Claire, seconded by Councilman Gordon and on survey work carried, the City Engineer was authorized to employ two men on survey work in connection with the city's applications for PWA for funds for certain proposed projects. R.P.Maskey Ralph P. Maskey addressed the Council regarding the cleaning of certain street ends on Newport Island, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, same was referred to the City Engineer. Dave Friendenberg The request of Dave Friendenberg of 307 Fernando Street for the surfacing surface alley of an alley, was on motion of Councilman Whitson, seconded by Councilman Gordon and carried, not allowed due to budget restrictions.
