The motion was duly seconded by Councilman Whitson and the resolution was passed by the following vote, to -wit: AYES: Councilmen Gordon, Whitson, Brown, Claire, Williamson. NOES: Councilmen None. Balaton City Engineer Patterson presented the application of the Balboa Yacht Balboa Yacht Club for a permit to construct a pier and floats fronting on Lots 5, 6 and 7, Club, pier permit Block 4, Section 5, Balboa Island and recommended that the same be allowed subject to the approval of the War Department. On motion of Councilman Claire, seconded by Councilman Gordon and carried, same was laid on the table until the next-meeting of the Council. ADJOURNMENT On motion of Councilman Claire, seconded by Councilman Whitson and carried, an adjournment was taken to 12 o'clock Noon, Thursday, August 25, 1935. APP::! G/ ounc Newport Beach, August 25, 1935• The City Council of the City of Newport Beach met in regular adjourned session in the City Council Chambers at the City Hall in the City of Newport Beach at 12 o'clock Noon, on above date, with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Claire, Roll Call Whitson, Brown, Williamson. Absent, Councilman Gordon. REPORTS OF SPECIAL COMMITTEES A delegation from the Balboa Yacht Club appeared before the Council in connection with the controversy over a certain pier and float constructed by Andrew's pier ' Frank Andrews adjoining the property of the Yacht Club. H. C. Patterson, Commodore of the Club addressed the Council, insisting that the pier and float of Andrews be made to conform with the the City's regulations inasmuch as the Club had been compelled to do so. After some discussion it was moved by Councilman Brown, seconded by Councilman Claire and carried, that Frank Andrews be ordered to remove that certain piling set contrary to the City requirements and reset same five • feet inside the property line in accordance with the Standard regulations. COMMUNICATIONS The application of Stephen H. Root of Elsinore, for a free license to S.H. Root peddle home grown produce, was on motion of Councilman Claire, seconded by peddling Councilman Whitson and carried, laid on the table. The application of Norman G. for a license to conduct card tables at Dan's Cafe, 100 Mein Street, Balboa, was on motion of Councilman Claire, Card Tables seconded by Councilman Whitson and carried, allowed subject to the approval of the Police Committee.' The application of R. G. Blake for a license to conduct a museum of R.G.Blake Western Life on Lot 4, Block E, Tract 323, Corona del Mar, was on motion of museum Councilman Claire, seconded by Councilman Whitson and carried, allowed. The application of Gerald Dow by G.-Ross for a free license to take Gerald Dow orders for merchandise made by the blind at the State Institution and the Blind peddling Veterans at Sawtelle. After some discussion it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that same be laid on the table. The letter of E. E. Lush regarding his application for a free license E.E. Lush to sell honey, was read, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the letter was ordered filed. peddling ' The resolution from the Planning Commission requesting the Council to Harbor Comm. petition the Orange County Board of Supervisors to appoint a Harbor Commission, was on motion of Councilman Whitson, seconded by Councilman Claire and carried, • ordered filed. The communication from the Planning Commission in connection with the R.G.Blake application of R. G. Blake for a permit to erect certain buildings for the museum purpose of housing an exhibit pertaining to early western life, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, ordered filed. 1,4..! Sewage The invitation of the California Sewage Works Association for the City Works Assn. to send a representative to the annual convention to be held at Santa Barbara Sept. convention 6th and 7th, was on motion of Councilman Claire, seconded by Councilman Brown insurance and carried, ordered filed. On motion of Councilman Claire, seconded by Councilman Brown and League. of carried, the City Officials were authorized to attend the meeting of the League Mun. of Municipalities to be held in Santa Barbara during the month of September, 1938. convention The request of Mayor Rossi of San Francisco for the support of the City Townsend. of Newport Beach in securing the League of Municipalities meeting for 1939, was on motion of Councilman Claire, seconded by Councilman Whitson and carried,- ordered filed. The letter of Harry Welch, Secretary of the Chamber of Commerce, submitting Traffic the suggestion of F. C. Splane regarding the traffic situation between 15th and situation 19th Streets, was presented, and the matter already being under consideration by the Police Committee, it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the letter be filed. American The request of G. A. Fanning, Vice - Commander of the American Legion of Legion Conv. the City-.to be represented at the National Convention to be held in Los Angeles September 19th to 22nd, was read, and on motion of Councilman Whitson, seconded by Councilman Brown and carried, all City employees were invited to attend same. Min. Res. UNFINISHED BUSINESS by adding a new section thereto Quitclaim to be known as Section 24, Ord. 476 Ordinance No. 476, being an ordinance amending License Ordinance No. 393t, Punch Boards and pertaining to Punch Boards, was presented for final passage. The ordinance was read and provides for a license of one dollar for each punch board operated in the City of Newport Beach and further provides for a minimum payment of $150.00 or a license for 150 boards. The adoption of the ordinance was moved by Council- man Whitson, duly seconded by.Councilman Claire and was passed by the following vote, to -wit: AYES: Councilmen Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilman Gordon. "20- 0" Councilman Whitson brought up the matter of the tentative permission Club granted the "20 -20" Club for staging a Carnival on City owned property, and Carnival moved that in accordance with the requirements of the Police Committee, that permission be granted for five days only and that same be limited to riding devices only. BROADLICK, husband and wife, have this day offered to the CITY OF NEWPORT BEACH, the sum of $$200.00 for Lot 74, Tract 682, in the city of Newport Beach, as shown on Map recorded in Book 20, page 19 of Miscellaneous Maps, records of Orange County, California; and WHEREAS, the said price is a fair and adequate price as and for the purchase price of said lot; and WHEREAS, the City Council of the City of Newport Beach deems that it is for the best interests of said City that said property be sold for the.said sum of $200.00; and WHEREAS, the.price offered is just, fair and adequate and is not dis- proportionde to the real value of the property above described. City Clerk Mayor - City of Newport Beach Harbor Master Bouchey addressed the Council regarding the setting.of piling in connection with piers and floats and requested that no more permits be granted for same. Resolution No. 1384, was presented, being a Resolution authorizing Mayor and the City Clerk to execute on behalf of the City of Newport Beach, a certain agreement between the City of Newport Beach and Donald,Beach Kirby. Whereupon Councilman Claire moved the adoption of said resolution, the motion was duly seconded by Councilman Whitson and the resolution adopted by the following vote, to -wit: AYES: Councilmen Claire, Whitson, Brown, Williamson. .NOES: Councilmen None. ABSENT: Councilman Gordon. 13A Minute Res. quitclaim to Edith W. Van de Water Res. 1383 sale of lot to Roy Broadlick Bouchey piers & floats the Resolution No. 1354 agreement with Donald Beach Kirby. City Engineer Patterson presented the matter of the beautification of the entran (be to the City as suggested by the Chamber of Commerce wherein the City would do the necessary work incident thereto and bill the County of Orange for same as per an agreement to that effect. Whereupon Councilman Whitson moved that the City Engineer be authorized to proceed with the work,.the motion was duly seconded by Councilman Brown and carried. Chief of Police Hodgkinson addressed the Council regarding the use of public address systems on the streets, contrary to the City ordinance. On motion of Councilman Whitson, seconded by Councilman Claire, candidates would be authorized to use the public address sytems to August 30th inc. Rosie Hunt The application of Rosie Hunt for a license to conduct a restaurant at cafe license 322 Marine Avenue, Balboa Island, was on motion of Councilman Whitson, seconded by Councilman Claire and carried, allowed subject to the approval of the Health Officer. Frank Andrews The request of Frank Andrews for permission to dredge in front of a permission to portion of Lots 3 and 4, Block 4, Section 5, Balboa Island, was., on motion of dredge Councilman Whitson, seconded by Councilman Gordon and carried, referred to the City Engineer with power to act. Jennie Walters The request of Jennie Walters to tie up a fishing barge at a City fishing barge pier in the channel, was, on motion of Councilman Whitson, seconded by Councilman Brown and carried, laid on the table. Southey The request of Harbor Master Bouchey for five days vacation from vacation Sept, 6th to Sept. 11th inc., was on motion of Councilman Gordon, seconded by Councilman Bz+own and -carried, allowed. Parkway in The letter of Palmer Conner of the Land Escrow & Investment Co., Corona del Mar requesting that the City take some action towards protecting the Parkway along Ocean Blvd. in Corona Del Mar from encroachment by property owners on the bluff or southerly side of Ocean Blvd., was on motion of Councilman Gordon, seconded by Councilman Claire and carried, referred to the City Attorney for reply. G.A.Bisbee The letter of G. Allen Bisbee regarding the ramp to the entrance of ramp at garage a garage at 115 Diamond Avenue, Balboa Island, was presented, the City Engineer advising that the matter had been investigated. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the letter was ordered filed. Councilman Claire moved the adoption of a resolution, being'a resolution quitclaim to authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Charlotte Herron Beach a Quitclaim Deed in favor of Charlotte Herron, covering Lot 39, Block A, Tract 673, Corona del Mar, as shown on Map recorded in book 20, pages 17 and 15 of Miscellaneous Maps, records of Orange County, California. The motion was duly seconded by Councilman Whitson and the resolution was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire; Whitson, Brown, Williamson. NOES: Councilmen None.
