HomeMy WebLinkAbout10/03/1938 - Regular MeetingNewport Beach, October 3, 1939- The Cityy Council of the City of Newport Beach met in re ular session in the City Council Chambers, at the City Hall in the'City of Newport Beach on above date, with Mayor Williamson in the Chair. The Roll was called, the following Councilmen answering present: Gordon, Claire,.Whitson, Brown, Williamson. REPORTS OF HEADS OF DEPARTMENTS On motion of Councilman Claire, seconded by Councilman Gordon and carried, the reading of reports of Heads of Departments was dispensed with and all reports ordered filed. COMMUNICATIONS A letter was presented and read from the Bartholomae Oil Corporation, C_ complaining of certain debris, allegedly owned and placed in a public alley by C\1 Dr. Howard W. Seager, and requesting the removal of same by the City in order to C. provide access to their property. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the matter was referred to the Street Superintendent °P and the Street Committee. The letter of Robert L. Bonham of 114 Garnet Street, in which complaint was made of certain trees on adjoining property obstructing and extending over on his lot, was on motion of Councilman Claire, seconded by Councilman Gordon and • carried, referred to the City Attorney for reply inasmuch as the matter would constitute a civil suit and not eovered by City jurisdiction. A petition signed by 29 residents of Newport Heights was presented, in which a request was made for lower water rates for that district. On motion of Councilman Whitson, seconded by Councilman Claire and carried, the matter was referred to the Water Superintendent and the Water Committee. The request of Judge W. A. Leonard for a vacation of two weeks during which he expects to leave the State of California, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed. NEW BUSINESS The monthly demands having been duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed and warrants ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the demand of L. W. Briggs in the sum of $152.04 covering the premium on a certain fire insurance policy in favor of the City of Newport Beach, was allowed and a warrant ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the demand of the Orange County Harbor Realty Company in the sum of $152.05 covering the premium on certain fire insurance policy in favor of the City of Newport Beach was allowed and a warrant ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the demand of Chas. F. Dennison in the sum of $152.05 covering the premium on a certain fire insurance policy in favor of the City of Newport Beach was allowed and a warrant ordered drawn for same. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the demand of Anna Hawkins Lane in the sum of $152.05 covering the premium on a certain fire insurance policy in favor of the City of Newport Beach was allowed and a warrant ordered drawn for same. The demand of Lew H. Wallace in the sum of $1,141.59 covering the premium on the City's automobile fleet insurance, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed and a warrant ordered drawn for same. Resolution No. 1425, being a quitclaim deed to the City of Newport Beach from H. Cardoza Sloan and Lillian Crosby Sloan, and covering a portion of Block "F ", Balboa Tract, was presented, whereupon it was moved by Councilman Whitson, seconded by Councilman Gordon that said quitclaim deed be accepted, • and the motion was carried by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Resolution No. 1426. WHEREAS, J. HOYT UNDERHILL, a single man, has this day offered to the CITY OF NEWPORT BEACH, the sum of $300.00 for Lots 6, 9 and 10, Block 335, Corona del Mar, in the City of Newport Beach, as shown on map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, records of Orange County, California; and WHEREAS, the said price is a fair and adequate price as and for the purchase price of said lot; and WHEREAS, the City Council of the City of Newport Beach deems that it is for the best interests of said City that said property be sold for the said sum of $300.00; and WHEREAS, the price offered is just, fair and adequate and is not disproportionate to the real value of the property above described. NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the said J. Hoyt Underhill, a single man, for the sum of $300.00, free and clear of all encumbrances, subject to the taxes for the fiscal year 1939-39, and unpaid improvement assessments of record. Also subject to conditions, restrictions, and reservations of record. And the Mayor and the City Clerk are hereby authorized and directed to execute and deliver a deed for said property to the said party upon receipt of the consideration above set forth. BE IT FURTHER RESOLVED: That the sum of $30.00 be paid to Gerald W. • Ritchie, as and for has commission for the negotiating of the sale of said real property to J. Williamson City Clerk Mayor - City of Newport Beach Res. 1427 Grant Deed from Resolution No. 1427, being a Grant Deed to the City of Newport Beach B.H. Dalton from B. H. Dalton and Margaret J. Dalton, husband and wife and covering a portion et ux of Lot 3, Block L, Tract 323, was presented. Whereupon it was moved -by Councilman Claire, seconded by Councilman Gordon and carried that the Grant Deed be accepted. The resolution was adopted by the following vote, torwit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Res. 1425 Resolution No. 1425, being a grant Deed to the City of Newport Beach Grant Deed from from Lillian R. Branscomb, and covering a portion of Lot 2, Block S, Tract 323, L.R.Branscorab was presented. Whereupon it was moved by Councilman Claire, seconded by Councilman Gordon, that the Grant Deed be accepted. The resolution was adopted by the following vote, to�wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Res. 1429 Resolution No. 1429, being a grant Deed to the City of Newport Beach Grant Deed from Margaret Freytag from Margaret Freytag, and covering a portion of Lot p 3, Block Tract 323, was presented. Whereupon it was moved by Councilman Claire, seconded by Councilman Gordon, that the Grant Deed be accepted. The resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Res. 1430 The application of George C. Hiner for a renewal of the Live Bait Agreement with George C. Hiner concession on the Newport pier for a period of.five years was presented, and after some discussion regarding the matter, Councilman Whitson moved the adoption of a resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach a.license agreement in favor of George C. Hiner for the Live Bait concession on the Newport pier for a period of three years. The motion was duly seconded by Councilman Gordon, the resolution designated Resolution No. 1430 was adopted by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. ADJOURNMENT On motion of Councilman Claire,_ seconded by Councilman Gordon and carried, an adjournment was taken to 5 o'clock P. M.
