M. on above date with Mayor Williamson presiding. Roll call The roll was called, the following Councilmen answering present: Gordon, ' Claire, Whitson, Brown, Williamson. Absent, Councilmen: None. REPORTS OF HEADS OF DEPARTMENTS On motion of Councilman Claire, seconded by Councilman Gordon and carried, the reading of the reports of Heads of Departments was dispensed with and the reports ordered filed. . REPORTS OF SPECIAL COMMITTEES Councilman Gordon reporting on the matter of improving a certain portion of Lafayette Avenue, petitioned for at a previous meeting of the Council, advised that same had been referred to the City Engineer for further report. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS Home Oil Co. The application of the Home Oil Company for a permit to install under - gasoline storage ground storage for the handling of petroleum products, -was on motion of Council- man Claire, seconded by Councilman Whitson and carried, granted subject to the • approval of the Fire Chief. E. Marr The application of Ernest Marr for a veteran's exempt license to license wholesale coffee cakes, was on motion of Councilman Claire, seconded by Councilman ex. Whitson and carried, denied. O.K.Greene The application of 0. K. Greene for a permit to construct a pleasure 6 pier, fronting on Lots 5 and „ Block 3 „ Tract 742, was on motion of Councilman pier permit Claire, seconded by Councilman Whitson and carried, referred to the City Engineer for approval. S.M.Gri£fith The application of S. M. Griffith to construct and install a slip float slip float in conjunction with an existing pier, having been approved.by the City Enginner, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, granted. Petition A petition, together with three letters, bearing upwards of 30 names 36th St. of property owners in West Newport section, was presented with a request that the 36th Street bridge over the Rivo Alto be removed, and on motion of Councilman bridge Whitson, seconded by,Councilman Gordon and carried, the matter was referred to the Street Committee and the City Engineer. The letter of J. L. McBride, City Engineer of Santa Ana, in connection J.L.McBride with the allocation of Gas Tax Funds, was presented, and on motion of Councilman gas tax funds Whitson, seconded by Councilman Claire and carried, the Mayor was instructed to' take the matter up with the League.of Municipalities with power to act. P.G.Balaton The application of P. G. Balaton for a re- zoning of Lot 5, Block 5, Seashore Colony Tract, was on motion of Councilman Claire, seconded by Councilman re- zoning Gordon and carried, referred to the Planning Commission. J. M.M.Leonard The letter of J. M. M. Leonard, thanking the Council for flowers sent to his father, was on motion of Councilman Claire, seconded by Councilman Gordon thanks and carried, ordered filed. I , 1st Tr & Sav A communication was presented from the First Trust & Savings Bank of Bank of Paaa. Pasadena in reference to the non - payment of taxes on certain property in Tract bulkhead in 518 and suggesting a plan for the construction of a bulkhead fronting on Block Tr-518 P of said Tract, whereby the necessary dredging and inspection in connection with said project.be borne by the City of Newport Beach. On motion of Councilman Gordon, seconded by Councilman Whitson and carried, the matter was referred to the City ' Engineer for reply. The letter of Newport Harbor Post 291 of the American Legion requesting American Legion the adoption of a Major Disaster Preparedness Plan Ordinance, was presented, and Major Disaster on motion of Councilman Claire, seconded by Councilman Gordon and carried, same Plan Ord. was referred to the Police Committee and Chief of Police. Ba1.Island The application of the Balboa Island Yacht Club for permission to •f Yacht Club construct additional floats, was on motion of Councilman Claire, seconded by floats Councilman Gordon and carried, referred to the City Engineer for approval. The letter of Jessie W. Collins in reference to a former communication 'Collins Jessie oll in regard to an alleged nuisance caused by the activities of the Balboa Island Boat Shop, was on motion.of Councilman Claire, seconded by Councilman Brown e:nuisaoll and carried, referred to the City Attorney for reply. UNFINISHED BUSINESS 4�1 ORDINANCE NO. 481, being AN ORDINANCE OF THE CITY OF NEWPORT BEACH Ordinance AMENDING SECTION 1 OF ORDINANCE NO. 479 OF THE CITY OF NEWPORT BEACH came up water rates for final passage, whereupon it was moved by Councilman Brown, seconded by Councilman Whitson, that the ordinance be adopted. The motion was duly carried and the ordinance adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. NEW BUSINESS Demands On motion of Councilman Claire, seconded by Councilman Gordon and carried, the monthly demands having been duly audited by the Finance Committee, were allowed and warrants ordered drawn for same. The request of City Attorney Thompson that Corinne E. Barker be paid the salary. of $75.00 per month, beginning as..of February 1, 1939, instead of • and during the absence of Lenore E. The matter between the City of Newport Beach and Dr. Albert Soiland Albert Soi7a.nd in connection with certain property situated between Bay Avenue at Buena Vista property Boulevard was brought up, and on motion-of Councilman Brown, seconded by Councilman Whitson and carried, same was laid on the table until the next meeting of the Council. The matter of the Hamasi Corporation was brought up, and on motion of Hamasi Corp, Councilman Gordon, seconded by Councilman Claire and carried, was laid on the table until the next meeting of the Council. The matter of the Strobridge Sub- Division, known as Tract 1011 and Tract 1011. the Planning Commissions non - approval of same due to lack of sewage facilities, was presented,, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, the action of the Planning Commission was upheld. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the City Attorney was instructed to prepare the necessary protests to present to the Board of County Supervisors in connection with Tract 1011, and the Mayor appointed Councilman Whitson to act with the City Attorney in the matter. On motion of Councilman Claire, seconded by Councilman Whitson and Amend. Ord, carried, the City Attorney was instructed to prepare a resolution in regard to No. 440. the amendment of Zoning Ordinance No. 440 in connection with certain protions of Tract 919 being re -zoned from R -3 to 0-1 classification, same having been duly approved and recommended by the Planning Commission Resolution No. 151 of the City Planning Commission was presented, said P1an.Comm resolution granting permission to Clair C. Pyle to re- construct and make additions permit to to a non- conforming element located on Lot 29, Block 13, Section 4, Balboa Island. C.C,Pyle On motion of Councilman Whitson, seconded by Councilman Brown and carried, the resolution of the Planning Commission was approved.
