The roll was called, the following Councilmen answering present: Gordon, Claire, Brown and Williamson. Absent; Councilman Whitson. REPORTS OF HEADS OF DEPARTMENTS 247 Allowing expenses for meeting. It was moved by Councilman Claire, seconded by Councilman Brown and carried, that the reading of reports of Heads of Departments be dispensed with and all the reports ordered filed. REPORTS OF SPECIAL COMMITTEES City Engineer Patterson reported on the matter of the Gartler pier and landing floats at 817 Coast Highway, the same having been laid over from a previous meeting, and was advised by Mayor Williamson that steps were being taken to remedy the cause of the complaint. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the matter of the Gartler pier, together with.the Frank L. Scott landing floats which do not conform to the City's specifications, were laid over until the mext meeting of the Council. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The application of Jabra Isaac for a veteran's exempt license to peddle linens, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, laid on the table. Residents in the area between Ninth and•Fifteenth Streets presented a petition requesting the installation of street lights in that district. The matter was discussed and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was referred to the City Engineer with instructions to check the number of poles available for the type of lights suggested. The communication of the Hamasi Corporation relating to building restr- ictions in force in certain areas of Corona del Mar was presented and read, and on motion of Councilman Gordon,.seconded by Councilman Claire and carried, same was referred to the City Attorney and Mayor for report at the next meeting. The letter of James Irvine in connection with a certain sewer easement granted the City of Newport Beach, was presented and discussed. Whereupon it was moved by Councilman Gordon, seconded by Councilman Claire, that the Mayor appoint a representative from the City to meet with a representative of the Irvine Company, the two to appoint a third member to go into the matter with a view of determining the monetary value of the easement as a means of settlement on that basis. City Attorney Thompson called attention to certain phases of the agree- ment between the City and the Irvine Company. After some discussion regarding the question, the motion was carried by the - following vote, to -wit: AYES: Councilmen Gordon, Claire, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilman Whitson. A petition was presented by residents in the vicinity of Edgewater Place, Montero and Anade Streets, requesting the lowering of the grade and improvement of the alley in that district. On motion of Councilman Claire, seconded by Councilman Gordon and carried, same was referred to the City Engineer for report. The letter and resolution from the City officials of San Diego thanking the officials of Newport Beach for taking a party composed of San Diego officials and Chamber of Commerce representatives over the Bay, was presented and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was ordered filed. Whereupon City Engineer Patterson advised in a written • report that the matter had already been taken care of and that the construction of a bulkhead would be prohibitive as to the cost of same. On motion of Council- man Claire, seconded by Councilman Gordon and carried, the letter was ordered ' filed and the report of the City Engin,grer was accepted. A.M.Nelson On motion of Councilman Claire, seconded by Councilman Gordon and conference carried, A. M. Nelson was authorized to attend the Pacific Coast Building attendence Officials Conference to be held in Oakland from October 3rd to 6th inc., fifty dollars being apportioned for the purpose. The invitation of Mayor Rossi of San Francisco for the Mayor to attend Mayor Rossi Mayor's day at the California State Fair in Sacramento was read, and on motion of ivitation to Councilman Williamson, seconded by Councilman Claire and carried, the City Clerk Mayor. was instructed to advise that attendence would not be possible. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the letter was ordered filed. Municipal Officers The letter from the Municipal Officers urging attendence at the League invitation of Municipalities, was read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was ordered filed. UNFINISHED BUSINESS City Engineer. A. Andrews. On motion of Councilman Gordon, seconded by Councilman Brown and carried, the estimate was approved and the work authorized accordingly. Gate City Engineer Patterson presented a report as to the cost of install - Corona del Mar ing a gate at the intersection of Iris and Ocean Blvd., Corona del Mar, for the purpose of closing off the entranee to the beach easterly of the east jetty at night. On motion of Councilman Claire, seconded by Councilman Gordon and carried, same was approved. NEW BUSINESS The monthly demands having been.duly audited by the Finance Committee, Demands were on motion of Councilman Claire, seconded by Councilman Gordon and carried, ' allowed and warrants ordered drawn for same. WHEREAS, certain defects have appeared in Resolution of Intention No. 1579 of the City. of Newport Beach, which said resolution was duly and regularly adopted by the City Council of the City of Newport Beach on the 13th day of March, 1939, and is on file in the office of the City Clerk of the City of Newport Beach; and WHEREAS, it is necessary that a new resolution of intention referring to the same work of improvement shall be passed by the City Council of the City of Newport Beach. NOW, THEREFORE, BE IT RESOLVED: That resolution of intention No. 1579, being a resolution of the City Council of the City of Newport Beach declaring its intention to order the closing up and abandonment of a portion of a certain street, and portions of certain alleys, and certain alleys, in the City of Newport Beach, as follows: A portion of Carnation Avenue; a portion of alley in Block "B ", Tract 470p an alley in Block R, Tract 323, an alley in Block B, Tract 323; declaring it to be for the public interest and convenience, and fixing the time and place for hearing objections to said'proposed improvement, and specifying the exterior boundaries of the district of lands to be affected or benefited by said work or improvement and to be assessed to pay the samages, costs and expenses thereof; which resolution was duly and regularly adopted at a regular meeting of the City Council of the City of Newport Beach held on the 13th day of March, 1939, be and the same is hereby rescinded, annulled and declared of no further force or effect for any purpose whatever. WHEREAS, Resolution No. 1623, passed and adopted by the City Council of the City of Newport Beach on the 5th day of June, 1939, being a resolution ordering improvements pursuant to Resolution of Intention of the City of Newport Beach No. 1579 is of no further force or effect for the reasonthat said Resolution No. 1579 of the City of Newport Beach has been rescinded, annulled and declared of no further force or effect for any purpose whatever. NOW, THEREFORE, BE IT RESOLVED: That Resolution No. 1623 of the City of Newport Beach, being a resolution ordering certain improvements to be made in said City pursuant to Resolution of Intention No. 1579, be and the same is hereby rescinded, annulled and declared of no further force or effect for any purpose whatever. Mayor Williamson advised the Council that the Heads of Departments meeting Meeting of would be held at the City Hall at 12 o'clock noon hereafter and requested as many dept. heads of the Council to attend as possible. Mayor Williamson appointed Councilman Brown to act with himself in look- ing over regulations regarding Municipal Camp Grounds in other cities with a view of improving conditions in the local Camp Ground. Mayor Williamson brought up the subject of people camping on the beach all night, and suggested that something should be done to remedy the matter. Mayor Williamson suggested that some action should be taken towards installing a sewer system in certain sections of Newport Heights, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the City Engineer was instructed to investigate the same. The matter of trash blowing off City trash wagons was discussed, the Street SupertnteAdent advising thet covers for the wagons would be provided. Councilman Claire moved the adoption of a resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf,of the City of Newport Beach Quitclaim Dees in favor of the following people and covering the following described property. The motion was duly seconded by Councilman Gordon and the resolution adopted by the follouaing vote, to -wit: AYES: Councilmen Gordon,. Claire, Brown, Williamson. NOES: Councilmen None. City Engineer Patterson presented estimates in connection with'the re- Re- roofing roofing the reservoirs at Corona del Mar and the City Hall, and after discussing reservoirs & the matter, it was moved by Councilman Claire, seconded by Councilman Gordon and City Hall. carried, that the spedifications and estimates be approved for the reservoirs. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the spediiications and estimate for re- roofing the City Hall was approved with the exception that the shingles should be removed instead of laying a new roof over same. On motion of Councilman Claire, seconded by Councilman Gordon and carried, alternate bids were authorized to be advertised for in connection with the re- roofing of the Corona del Mar reservoirs and the City Hall. Min. Res. City Engineer Patterson pesented a map showing suggested improvements to Water system the water system on Newport Heights and Balboa Island, submitting estimates as to Newport Heights the cost of said improvements. After considerable discussion regarding the matter, Councilman Gordon moved the adoption of a resolution authorizing the calling for bids for the necessary material for the proposed improvements to the water system, the labor in connection with same to be performed by the regular hel15 in the department. COMMUNICATIONS Property owners in the district of Balboa peninsula lying easterly of 15th Street, presented a petition requesting the Council to institute the necessary proceedings for the formation of an assessment district.for'the purpose of re'?, constructing the existing pier at Balboa, said construction to include a bait stand, storage facilities and observation platform for yacht races. Edward H. Allen addressed the Council at length concerning the proposed project. Others to address the Council in favor of the project were Mrs. Edna Fisher and Frank L. Scott. John Lamar also addressed the Council with a suggestion that parking facilities should be provided before building a pier. After much discussion of the subject, Council- man Claire moved that the City Engineer be instructed to make a report in connection with the "Debt Limitation and Majority Protest" features of the 1911 Act. Alley in East Newport V.`anan's Assn, closing dance hall. Anchorage of "Para .-on" harbor ::actor vacation Nine property owners in the vicinity of Alvarado Street and Island Avenue presented a petition requesting the Council to gravel, oil and roll the existing alley through Block 11, East Newport, and including the alley leading into Central Avenue. . The City Engineer presented the matter of grades in that district and recommended the usual maihtenancey, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the matter was referred to the City Engineer with power to act. Eighteen property owners in Block 4, East Newport, presented a petition requesting the Council to acquire and dedicate for alley purposes certain corners of the "H" shaped alley in order to make same more accessible. On motion of Councilman Gordon, seconded by Councilman Brown and carried, the City Engineer was instructed to contact the property owners affected and report on the matter. A petition signed by R. M. Worley et al requesting that the City construct a public pier at the foot of "N" Street in Tract 518, was presented, and on motion of Councilman Brown, seconded by Councilman Claire and carried, same was referred to the City Engineer for an estimate of the cost. The communication of M. A. Davis and the communication of C. G. White regarding the intersection of the alley westerly of Lindo Avenue, were presented and read, said communications having to do with the acquiring of a portion of Lot 145, Block A, East Newport for the purpose of constructing an alley so as to permit easier access to said alley. After some discussion it was moved by Council- man Claire, seconded by Councilman Gordon and carried, that the City Engineer be instructed to interview the property owners affected regarding the necessary proceedings in connection therewith and report on same. ' The communication from the Newport Harbor Woman's Association requesting that the Rendezvous Dance Hall be closed from 12 o'clock midnight to 9 o'clock the following morning, was presented and read, and after some discussion by the Council, Chief of Police, Mrs. Edna Fisher and Mrs. G.
