ADJOURNMENT On motion of Councilman Claire, seconded by Councilman Gordon and carried, an adjournment was taken to 7:30 o'clock p, m. September 11; 1939. APP OVED City Clerk Newport Beach, September 11, 1939• The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall in the City of Newport Beach on above date with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon, Claire, Whitson, Brown, Williamson. Absent: Councilmen None. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS Property owners in the district of Balboa peninsula lying easterly of 15th Street, presented a petition requesting the Council to institute the necessary proceedings for the formation of an assessment district.for the purpose of rea, constructing the existing pier at Balboa, said construction to include a bait stand, storage facilities and observation platform for yacht races. Edward H. Allen addressed the Council a.t length concerning the proposed project. Others to address the Council in favor of the project were Mrs. Edna Fisher and Frank L. Scott. John Lamar also addressed the Council with a suggestion that parking facilities should be provided before building a pier. After much discussion of the subject, Council- man Claire moved that the City Engineer be instructed to make a report in connection with the "Debt Limitation and Majority Protest" features of the 1911 Act. The motion was seconded by Councilman Gordon and carried by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Nine property owners in the vicinity of Alvarado Street and Island Avenue presented a petition requesting the Council to gravel, oil and roll the existing alley through Block 11, East Newport, and including the alley leading into Central Avenue. The City Engineer presented the matter of grades in that district and recommended the usual m&ihtenancbp, and on motion of Councilman Claire, seconded by Councilman Brown and carried, the matter was referred to the City Engineer with power to act. Eighteen property owners in Block 4, East Newport, presented a petition requesting the Council to acquire and dedicate for alley purposes certain corners of the "H" shaped alley in order to make same more accessible. On motion of Councilman Gordon, seconded by Councilman Brown and carried, the City Engineer was instructed to contact the property owners affected and report on the matter. A petition signed by R. M. Worley et al requesting that the City construct a public pier at the foot of "N" Street in Tract 515, was presented, and on motion of Councilman Brown, seconded by Councilman Claire and carried, same was referred to the City Engineer for an estimate of the cost. The communication of M. A. Davis and the communication of C. G. White regarding the intersection of the alley westerly of Lindo Avenue, were presented and read, said communications having to do with the acquiring of a portion of Lot 145, Block A, East Newport for the purpose of constructing an alley so as to permit easier access to said alley. After some discussion it was moved by Council- man Claire, seconded by Councilman Gordon and carried, that the City Engineer be instructed to interview the property owners affected regarding the necessary proceedings in connection therewith and report on same. The communication from the Newport Harbor Woman's Association requesting that the Rendezvous Dance Hall be closed from 12 o'clock midnight to 9 o'clock the following morning, was presented and read, and after some discussion by the Council, Chief of Police, Mrs. Edna Fisher and Mrs. G. Maxwell, it was moved by Councilman Gordon, seconded by Councilman Whitson and carried, that the matter be referred to the Police Committee for report at the next meeting. The communication of the protestants regarding the anchoring of the boat "Paragon" in a certain area adjacent to the southwesterly shore line of Balboa Island, was presented and read, and on motion of Councilman Whitson, seconded by Councilman Gordon and carried, same was ordered filed. The request of Harbor Master Bouchey for five days of his vacation from September 12th to 17th, was on motion of Councilman Claire, seconded by Councilman Whitson and carried, granted. 255 Auditor °s report Roll Call Assess -ment Dist for Balboa pier. I:SAACSON, and covering a portion of Lots 3, 6 and 7, in Section 28, from J.J. Township 6, South, Range 10 West,, S. B. B. & M., was presented. [idhereupon it was Isaacson moved by Councilman Claire, seconded by Councilma4i Gordon that said resolution be adopted and the motion was carried by the following vote, to -wit AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. On motion of Councilman Claire, seconded by Councilman Cordon and Demands carried, certain demands which had been approved by the Finance Committee, were approved and warrants ordered drawn for same. Mrs. Ralph Richardson addressed the Council concerning certain billboards, ,.''.rs.Richardson considerable discussion ensuing in connection therewith. Whereupon it was moved by billboards Mayor Williamson, seconded by Councilman Gordon and carried that an ordinande abolishing all billboards from the City be passed to the second reading. The _notion was carried by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson.. Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Councilman Brown brought up the matter of the complaint of Jessie Collins Jessie Collins regarding the tarring of boats by the Balboa Ferry Line, alleging that same constituted tarring boats a public nuisance. After some discussion it was moved by Councilman Gordon, seconded by Councilman ?'Jhitson and carried, that same be referred to the City Attorney. M ayor- permission On motion of Councilman Claire, seconded by Councilman Whitson and carried, to leave state. Mayor Williamson was granted permission to leave the State. On recommendation of Fire Chief Crocker, it was moved by Mayor Williamson, Fire hose seconded by Councilman Gordon, that the City Clerk be ordered to advertise for bids bids called for 2000 feet of two and one -half inch and 450 feet of one and one -half inch fire hose. The motion was carried by the following vote, AYES: Councilmen Gordon, Claire, Whitson,, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. • • The letter from the Mayor and City Manager of Long Beach requesting the Mayor of Long support of the City in securing the convention of the League of Municipalities for Beach. League 1940, was presented and read, and on motion of Councilman Claire, seconded by Convention. Councilman Whitson and carried,'same was referred to the delegates attending the convention at Oakland. The letter of City Engineer Patterson relating to a certain deed from Deed from H. Cardoza Sloan affecting certain property at Corona del Mar, was presented and H.C.Sloan read and it was moved by Councilman Gordon that same be accepted, the motion was seconded by Councilman Claire and carried by the following vote, to -wit: AYES: Councilman Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilman None. ABSENT: Councilmen None, The report of the City Engineer regarding a request from property owners Street lights between 18th Street and 15th Street for street lights in that district was presented, bet 18th & said report indicating that the type of lights requested were not practical from 15th Sts. a standpoint of cost. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the matter was referred to the Electrical Committee to arrange a meeting with the petitioners in order to go into the matter. Mrs. V. 0. Wroolie addressed the Council concerni-mg the matter of the lights installed on Newport Island. The controversy in connection with the sand and gravel bunkers opperated Bunkers Gravel .unkers by E. M. Burris in the vicinity of Newport Heights was brought up, Mr. Holman Newport Heights representing the protestants addressed the Council, after which E. M. Burris explained his position in the matter and offered to furnish the necessary gravel to improve the alley leading to the bunkers if the City would grade and oil same, that being one of the things complained of due to the dust arising therefrom. At the request of Mr. Holman it was moved by Councilman Gordon, seconded by Councilman Claire and carried that the matter be laid on the table until the next meeting. Resolution No. 1659. WHEREAS, GLYDE MAYNARD, a single woman has this Ices. 1659. day offered to the CITY OF NEWPORT BEACH the sum of $350.00 for Lot 2, Block 242, Sale of lot Corona del Mar, in the City of Newport Beach, as shown on Map recorded in Book to Glyde 3, page 41 and 42 of Miscellaneous Maps, records of Orange County, California; .'aynard and WHEREAS, the said price is a fair and adequate price as and for the purchase price of said lot; and WHEREAS, the City Council of the City of Newport Beach deems that it is for the best interests of said City that said property be sold for the said sum of $350.00; and WHEREAS, the price offered is just, fair and adequate and is not dis- proportionate to the real value of the property above described. NOW, THEREFORE, BE IT RESOLVED: That said property be sold to the said Glyde Maynard, a single woman, for the sum of $350.00, free and clear of all encumbrances, subject to the taxes for the fiscal year 1939 -40 and unpaid improvement assessments of record. Also subject to conditions, restrictions and reservations of record. The Mayor and the City Clerk are hereby authorized and directed to execute and deliver a deed for said property to the said party upon receipt of the consideration above set forth. BE IT FURTHER RESOLVED: That the sum of $35.00 be paid to Hamasi Corporation, as and for its commission for the negotiating of the sale of said real property to Glyde Maynard, a single woman, as her separate property, said sum being a fair and reasonable commission to be allowed in said sale, and said broker being -a licensed realtor of the City of Newport Beach. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 11th day of September, 1939, by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
