The City Council of the City of Newport Beach met in regular session in the City Council Chambers at the City Hall at the hour of 4 o'clock p. m. on above date, with Mayor Hall presiding. Roll Call The roll was called, the following Councilmen answering present: Allen, Isbell, Reed, Kirk, Hall. Absent, Councilmen None. Mayor Hall asked if any member of the Council, or any one in the audience wished the Minutes of the previous meeting of the Council, or any part thereof, redd,no one responded and the reading of the Minutes was dispensed with. Gas Co. application for franchise Chief of Police employment of E.H.Waltz REPORTS OF HEADS OF DEPARTMENTS The report of the City Treasurer was read, and on motion of Councilman Allen, seconded by Councilman Isbell and carried, the reading of the other reporst was dispensed with and all the reports ordered filed. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. COMMUNICATIONS The application of Mary Miller for a license to practice palmstry in the Pavilion in Balboa, was on motion of Councilman Allen, seconded by Councilman Reed and carried, referred to the Police Committee and the Chief of Police. The application of the Peyton Company for a permit to install under- ground storage for the handling of petroleum products at 901 Coast Highway, having been approved by the Fire Chief, was on motion of Councilman Reed, seconded by Councilman Kirk and carried, granted. The request of the Peyton Company to lease one of the City owned docks on the Coast Highway, was on motion of Councilman Reed, seconded by Councilman Kirk and carried, referred to the City Engineer for investigation and report. The bid submitted by Hal Will Smith to purchase certain property in Corona del Mar was presented, and on motion of Councilman Kirk, seconded by Councilman Allen and carried, the offer was rejected and the check accompanying the bid ordered returned. The application of the Southern Counties Gas Company for a new franchise from the City under the 1937 Act of the State to replace the present one, was presented, and on motion of Councilman Allen, seconded by Councilman Kirk and carried, was referred to the City Attorney for report at the next meeting. The request of Chief of Police Hodgkinson for the temporary employment of Ernest H. Waltz as a patrolman at a salary of $140 per month, was on motion of Councilman Isbell, seconded by Councilman Reed and carried, granted. 0 40 NEW BUSINESS The letter of Fire Chief Crocker recommening the adoption of an 1st reading ordinance in connection with the proposed reciprocal plan for mutual assistance of Ord. re between Cities, was presented, and on motion of Councilman Kirk, seconded by mutual aid Councilman Allen an ordinance adopting the same was passed to the second reading of Cities by the following roll call vote, to -wit: AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res. 2724 Resolution No. 2724 was presented, being a resolution regarding a stipulation in stipulation in a Superior Court Suit, City of Newport Beach vs. Ralph P. Maskey Maskey suit et ux, and on motion of Councilman Allen, seconded by Councilman Reed, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res 2725 The matter of salary increases for certain City employees was brought salary up, a report on same by the Chairman of the Finance Committee was read by the increases Clerk, whereupon it was moved by Councilman Reed, seconded by Councilman Kirk that Resolution No. 2725 authorizing the increases be adopted affective as of May 1, 1943 and the salaries to be paid the following month. The resolution ' was adopted by the following vote, to -wit: AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Res. 2726 Resolution No. 2726 was presented, being a resolution authorizing the deed to U.S. Mayor and Qty Clerk to sign a deed to the United States Government for land Government acquired for the construction of a Railway spur to the Santa Ana Army Air Base. Ry spur On motion of Councilman Reed, seconded by Councilman Kirk, the resolution was ' adopted by the following vote, to -wit: AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall. Res. 2727 Resolution No. 2727 was presented, being a resolution cancelling all cancelling taxes and penalties against certain City owned property, and on motion of • certain taxes Councilman Kirk, seconded by Councilman Isbell, the resolution was adopted by the following vote, to -wit: AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall. The application of John J. Haines for a permit to install piling and J.J.Haines landing fronting on Lot 5, Block 533, Canal Section, was on motion of Councilman landing permit Allen, seconded by Councilman Isbell and carried, granted subject to the approval of the War Department and the War Production Board. The application of E. H. Hurst for a.permit to install piling and E.H.Hurst landing fronting on Lot 6, Block 340, Canal Section, was on motion of Councilman landing permit Allen, seconded by Councilman Isbell and carried, granted subject to the approval of the War Department and the War Production Board. • The application of Marguerite Macculloch for a permit to install groins fronting Lots 28 884, M.Nacculloch on and 29 in Tract was on recommendation of the City Engineer request to and on motion of Councilman Isbell, seconded by Councilman Reed and carried, laid install groins on the table until the next meeting of the Council. The request of the Orange County League of Municipalities for the Council'Mssembly bills recommendation in support of Assembly Bills 22 and 1676, was presented, and on motion of Councilman Reed, seconded by Councilman Kirk and carried, the Secretary of the Chamber of Commerce was instructed to write to Assemblymen Collins and Watson urging the passage of the bills. The monthly demands having been duly audited by the Finance Committee, Demands were on motion of Councilman RLbd, seconded by Councilman Isbell and carried, allowed and warrants ordered drawn for same. Spalding for a City owned dock conclusion of. was again brought up for consideration, the City Attorney advising the sub - leasing lease of the same by Mr. Spalding as in similar cases, but after some discussion of the matter, it was moved by Councilman Kirk, seconded by Councilman Reed that the conclusion of the lease be granted, the motion being carried by the following vote, to -wit: .AYES, COUNCILMEN: Allen, Kirk, Isbell, Reed, Hall. Ralph Maskey Ralph Maskey addressed the Council concerning a certain water front lot water front owned by the City and suggested a m8thdd whereby the property could be placed on lot, City owned the tax roll and was advised to take the matter up with City Attorney Thompson and City Auditor Gant.
