Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Kathryne Cho, Civil Engineer, kcho@newportbeachca.gov PHONE: 949-644-3014 TITLE: 2018-2019 Playground Improvements Project — Award of Contract No. 7582-1 (19P01) ABSTRACT: Staff has received bids for the 2018-2019 Playground Improvements Project and is requesting City Council approval to award the work to R.E. Schultz Construction, Inc. (R.E. Schultz), of Orange. RECOMMENDATION: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301_Class 1 (Existing Facilities) and Sec. 15302_Class 2 (Replacement or Reconstruction) of the CEQA Guidelines, because this involves maintenance of existing facilities and will be reconstructing existing facilities on the same site as the structure [facility] replaced. The project will have substantially the same purpose and capacity as the structure [facility] replaced; b) Approve the project drawings and specifications; c) Award Contract No. 7582-1 to R.E. Schultz for the total bid price of $188,645.00, and authorize the Mayor and City Clerk to execute the contract; d) Establish approximately $20,000.00 (approximately 10 percent), contingency amount to cover the cost of unforeseen work not included in the original contract; and e) Approve Budget Amendment No. 19BA-042 transferring $28,000.00 of project savings in Jasmine Creek Maintenance Road Reconstruction to 2018-2019 Playground Improvements. FUNDING REQUIREMENTS: Upon approval of the Budget Amendment 19BA-042, to transfer project savings from the Jasmine Creek Maintenance Road Reconstruction project into this Playground Improvements project, sufficient funding will be available for the award of this contract. 5-1 2018-2019 Playground Improvements Project — Award of Contract No. 7582-1 (19P01) April 23, 2019 Page 2 Since the budget amendment transfers existing appropriations, there is no further impact on fund balance. Schultz Construction Contingency $ 20,000.00 Various Incidentals, Printing $ 5,000.00 Total: $ 213,645.00 DISCUSSION: At 10 a.m. on April 4, 2019, the City Clerk opened and read the following bids for this project: Bidder Low R.E. Schultz 2nd Tot Lot Pros 3rd JMJ Construction Base Bid Amount $ 188,645.00 $ 200,005.20 $ 200,608.00 The base bid amount submitted by the low bidder, R.E. Schultz, is one percent less than the Engineer's Estimate of $200,000.00. R.E. Schultz possesses a valid and current California State Contractor's License A with C -61/D-34 (Prefabricated Equipment) and a subcontractor who holds a C -61/D-12 (Synthetic Products) license, as required by the contract documents. A check of the Contractor's references indicates satisfactory completion of similar projects for Newport Beach and other local municipalities. R.E. Schultz currently holds an on-call maintenance/repair services agreement with the City for playground equipment installation services. The work necessary for the completion of this contract consists of removing and disposing of existing improvements, including current rubber surface wear course and playground equipment; furnishing and installing flexible play surface systems; installing City - purchased playground equipment at Eastbluff, Channel Place and Cliff Drive parks; and other incidental items to complete the work in place as required by the contract documents. The design and play components proposed for Channel Place and Eastbluff parks were determined based on community input received at two publicly noticed meetings. The proposed Channel Place playground components are accessible from the ground level. The proposed Eastbluff play equipment will have ground level components, as well as elevated components that will be accessible via a transfer platform. 5-2 2018-2019 Playground Improvements Project — Award of Contract No. 7582-1 (19P01) April 23, 2019 Page 3 Ground level components include the Talk Tube, Clubhouse and Image Reach Panel. Accessible elevated components include the Clatter Bridge with Barriers, Cliff Climber, Double Slide, Loop Pole, Match 4 Panel, Slidewinder2 and Zoo Panel. The project proposes to expand the rubber surfacing area at both locations for increased accessibility. Pursuant to the contract documents, the contractor will have 40 consecutive working days to complete the work. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301, Class 1 (Existing Facilities) and Sec. 15302, Class 2 (Replacement or Reconstruction) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this involves maintenance of existing facilities and will be reconstructing existing facilities on the same site as the structure [facility] replaced. The project will have substantially the same purpose and capacity as the structure [facility] replaced. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
