HomeMy WebLinkAbout11/19/1945 - Adjourned Regular Meeting71 �I L 0 0 t November 19, 1945 The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall at the hour of 4 o'clock p.m. on above date with Mayor Hall presiding. The roll was called; the following Councilmen answering present: Allen, Isbell, Reed, Hall, Stanley. The Mayor asked if any of the Councilmen or anyonein the audience wished the minutes of the previous meeting, or any part thereof, read; no one responded and the reading of the minutes was dispffised with. REPORTS OF SPECIAL COMMITTEES: None REPORTS OF S AL?DING COMMITTEES: None COMMUNICATIONS The application of Arthur Vetch for a license to operate a Taxi service from 440 Heliotrope Avenue, Corona del Mar was on motion of Councilman Allen, seconded by Councilman Isbell and carried, referred to the Chief of Police and Police Commissioner. The application of Beckner and Purdy for a license to engage in the Pet Food and Supplies business at 111 Agate Street, Balboa Island, was on motion of Councilman Allen, seconded by Councilman Reed and carried, granted, subject to the approval of the Health Officer. The letter of Hugh M. Wilcox, Scout ExecutiNe requesting a 25 year lease on City owned property between highway 101 and the North Channel was read, whereupon Mr. Wilcox addressed the Council on the question and exhibited sketches of proposed buildings to be erected on the premises. Thejmethod of financing the project was gone into as well as the escrow proceedings. The plan met with favor with the Council, the City Attorney advising on the legal phases of the matter regarding the lease held by the Union High School proposed to be assigned to the Sea Scouts. On motion of Councilman Allen, seconded by Councilman Reed and carried, the Mayor was requested to appoint.a Committee to confer with a Committee from the Sea Scouts to prepare a tangible`lplan to present to the Council. The letter of Marion Younghusband in reference to Lot 5, Block B, getter of U Colony Tract alleged to have no outlet to a public street was husband. Referred to on motion of Councilman Reed, seconded by Councilman Allen and carried, Engineering Depart. referred to the Engineering Department. The letter of John J. Sailors, Assistant to the City Engineer, Appli a tions for regarding the leasing of the 93 acres of City owned land was read, leasing 93 acres of whereupon applications for leasing said land presented by Casey Blue and City owned land of Harvey Bear were read when the proposal presented informally to the Casey Blue and Harvey Council to lease the property for an Air Port was brought up and on Bear. Assistant City Engineer Webb's letter in reference to a pier Illegal construction being constructed by George C. Seba fronting on Lot 24, Tract 742, of pier built by Geo. Balboa Island for which the permit for same was granted in 1943 had C. Seba, ordered expired at the end of that year was read and after some discussion of removed. the matter it was moved by Councilman AlleA seconded by Councilman Reed and carried, that inasmuch as the pier was being built illegally its removal should be ordered and the matter referred to the City Attorney. Councilman Stanley and Mayor Hall not voting on the question. The letter of John J. Sailors, Assistant to the City Engineer Barge belonging to regarding the removal o1a certain barge belonging to Smith Brothers Smith Bros. to be said to be moored without authority off the City Camp Grounds was read removed within 30 days and after some discussion of the question which involved the rental of frontage on the North Channel for repairing the barge, it was moved by y Councilman Reed., seconded by Councilman Allen and carried, that the owners of the barge be given 30 days in which to remove the barge or legal action would be taken in the matter. A letter from Harbor Master Craig pertaining to the disposition Owner of barge of the derelict 'Mindanao' was read, it appearing that the owner of the 'Mindanao° giver. barge is delinquent in moorage charges and it was suggested that the City 30 days to remove ;rom Attorney start legal proceedings for the City's claim and removal of the Harbor. barge. On motion of Councilman Reed, seconded by Councilman Allen and carried, the City Attorney was instructed to give 30 days notice to the owner of the 'Mindanao' for its removal from the Harbor. A letter from Harbor Master Craig relating to a location for °U' Street to be set the Army Rescue Boat to be stationed in Newport Harbor recommended the as location for the 'N' Street pier as the most suitable location and that a charge of Ten Army rescue boat. Dollars per month be made for maintainence of the pier, and that a small recreational.room for the use of the crew of the boat be built. After some discussion of the matter, it was moved by Councilman Isbell, seconded by Councilman Allen and carried, that the subject be referred to Assistant to the City Engineer Sailors to investigate and report. 332 Lookout tower at Corona del Mar to be removed. Teu,porary employment of W.K. Kelly and V. Cusumano in P.D. approved. Discussion to join Metropolitan Water District. Hearing scheduled. in connection with the vacation of certain alleys in Tract 907 Cont. til next meeting On motion of Councilman Stanley, seconded by Councilman Allen and carried, the proper authorities to be notified to remove the Lookout station at Corona del Mar. The request of Chief of Police Hodgkinson for the temporary employment of Walter K. Kelly as patrolman at a salary of.$175.60 per month and Vincent Cusumano as Dog Officer at a salary of $175.00 per month effective November 15, 1945 was on motion of Councilman Allen, seconded by Councilman Reed granted by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Reed, Hall, Stanley NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None UNFINISHED BUSINESS The question of joining the Metropolitan Water District came up for discussion, Mayor Hall advising that it would be necessary to petition the Coastal District for annexation, various methods of joining the District being advanced. A letter from the Metropolitan Water District which up to this time had not been received, but said to be to the effect that the only means of securing the Metropolitan water would be through annexing to the Coastal District and on motion of Councilman Allen, seconded by Councilman Reed and carried, steps were ordered taken upon receipt of the letter from the Metropolitan Water District toward joining the Coastal Area. On motion of Councilman Allen, seconded by Councilman Reed and carried, the hearing scheduled for this�time in connection with the vacation of certain alleys in Tract 907 was ordered continued until the next meeting of the Council due to certain Easement Deeds to the.City not having been received. NEW BUSINESS Resolution No. 3256 was presented and read in full by City Res. No. 3256 Attorney Thompson, being a resolution authorizing the Mayor and City Agreement with U. S. Clerk to execute on behalf of the City of Newport Beach a certain Gover °t. in connection Agreement between said City and the United States Government in connection with fireboat Bright with the use and upkeep of a Fireboat, disignated as Fireboat Bright No. 1 No. 1 Official No. 241302. The motion for adoption of the resolution was made by Councilman Allen, duly seconded by Councilman Reed and was passed by the following roll call vote, to.wlt: AYES, COUNCILMEN: Allei, Isbell, Reed, Hall, Stanley NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Steps should be taken Mayor Hall stated that steps should be taken to acquire the to acquire fireboat Fireboat whereupon Councilman Stanley suggested that the former owners from former owners. of the boat should be contacted with a view of buying.their interest Laid on the Table In the boat, also that it would be advisable to have insurance on the boat Also that bids for as a protection to the City, and that local insurance agents should be insurance on the boat asked to submit bids on same and on motion of Councilman Reed, seconded be asked,. by Councilman Allen and carried, Mr. Sailors was instructed to follow Council regarding through on the matter. Commissioner, Harbor Master, Police Commissioner and Chairman of the Finance Committee was named to look into the matter by motion of Councilman Stanley, seconded by.Mayor Hall and carried, Councilman Allen voting No. Res. No. 3257 City Attorney Thompson presented and read in full a resolution, Agreement with C. W. being a resolution authorizing the Mayor and City Clerk to execute on Drant regarding lease behalf of the City of the City of Newport Beach a certain agreement on Newport pier. between said City and C. W. Drant for a lease on the Newport pier for the purpose of loading and unloading patrons and customer for sport fishing. Councilman Allen moved the adoption of the resolution which was designated Resolution No. 3257 the motion beilg duly seconded by Councilman Reed and was adopted by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Reed, Isbell, Stanley, Hall NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Res. No. 3255 City Attorney Thompson presented and read in full a resolution, Agreement with McCullah being a resolution authorizing the Mayor and City Clerk to execute on BrothY rs for loading behalf of the.City of Newport Beach a certain Agreement between said passengers from certain City and McCullah Brothers for the exclusive right and privilege of loading piers and wharves in and unloading passengers to and from certain piers and wharves in the City City. of Newport Beach to fishing barges owned and operated by McCullah Brothers. Councilman Allen moved the adoption of the resolution which was designated Resolution No. 3255 the motion for adoption being duly seconded by Council- man Stanley and was passed by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Reed, Isbell, Hall, Stanley NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Resolution presented A resolution was presented regulating the speed in which auto - regarding and regulat- ing the speed of autos mobiles may travel upon certain streets within the City of Newport Beach In Newport Beach. but after some discussion of the matter it was moved by Councilman Stanley Laid on the Table seconded by.Councilman Allen and carried, that the P solution be Laid on pending survey. the Table pending the making of a further survey on the subject. The matter of a certain strip of land bordering upon Beacon Bay Robert Mize addressed was brought up, it appearing that said strip of land is designated for Council regarding commercial uses and it being the desire of the lessee to make said strip certain strip of land of land available for recreational and residential purposes, it was moved bordering upon Beacon by Councilman Reed, seconded by Councilman. Stanley and carried, that the Bay. City Attorney be directed to prepare the necessary proceedings and present same at the next meeting of the Council. Niemeyer for a permit to construct a pier fronting on Lot S, Block 19, Balboa Ea "stside Addition having been approved by the Engineering Department was on motion of Councilman Allen seconded by Councilman Reed and carried, gra rted. The application of W. E. Donald for a permit to construct a pier fronting on Lot 5, Harbor Island, having been approved by the Engineer- ing Department was on motion of Councilman Allen, seconded by Councilman Reed and carried, granted. Councilman Stanley brought the question of the State Highu>�ay Department establishing grades on Highway 101 through Corona del Mar, lack of which is proving a deterrent to building operations, and on motion of Councilman Stanley, seconded by Councilman Allen and carried, the Engineering Departrrent was directed to request that the State Highway Department furnish the elevations in that district. Assistant Engineer Webb brought up the question of fees charged for sewer connections and calling attention to discrepancies in the present ordinance which does not provide for adequate return to the City for making said connections. On motion of Councilman Allen, seconded by Councilman Isbell and carried, the City Attorney was authorized to prepare the necessary amendment to the ordinance.
