HomeMy WebLinkAbout06/17/1946 - Adjourned Regular MeetingJune 17, 1946 The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers at the City Hall at the hour of 4 o'clock p.m. on above date with Mayor Reedpresiding. • The roll was called, the following Councilmen answering present: Allen, Isbell, Robertson, Siler, Reed. The May:­r asked if any of the Councilmen or anyone in the audience wished the minutes of the previous meeting, or any part thereof, read, no one responded and the reading of the minutes was dispensed with. REPORTS OF SPECIAL COMMITTEES The Committee appointed to report on the matter of people dumping sewage from cesspools into City sewer lines recommended as follows: .I Committe report on dumping residue into City sewer system. Council addressed by C. S. Nottage. Regulation of cess- pool disposal Laid on the Table. Regular order of business changed to consider proposed Corona del Mar sewer project. ,MINUTES ON HEARING OF RESOLUTION OF INTENTION NO. 3327 IN THE MATTER OF SANITARY SEWERS IN OCEAN BOULEVARD AND OTHER STREETS, ATJ,p :Y: AND EASEMENTS. One protest filed. 1. That no one be allowed to dump any waste or residue into the City sewer system unless said residue is collected within the limits of the City of Newport Beach. ' 2. That no residue shall be dumped in any manhole which is situated nearer than 500 feet from any building. 3. That all people engaged in the business of pumping cesspools in the City of Net,port Beach shall be charged a general business license. • The Council was addressed on the subject by C. S. Nottage, a cesspool operator and Chief of Police Hodgkinson, the former suggesting that a bond be furnished by those in the cesspool business for faithful performance of the regulations proposed by the City and that certain places be designated for the dumping of sewage, same to be under the o supervision of the Police Department. The matter was Laid on the Table pending the formulating of rules and regulations to control the situation. On motion of Councilman Allen, seconded by Councilman Isbell and carried, the regular order of business was suspended In order to take up the matter of the hearing of protests In connection with the construction of the proposed Corona del Mar sewer project. MINUTES ON HEARING OF RESOLUTION OF INTENTION N0. 3327 IN THE MATTER OF SANITARY SEWERS IN OCEAN BOULEVARD AND OTHER STREETS, ALLEYS AND EASEMENTS The Clerk reported that this was the time and place fixed for the hearing of protests or objections against the work or the district as described in Resolution of Intention No. 3327 in the matter of the construction of sanitary sewers and appurtenant work In connection therewith in Ocean Boulevard and other streets, alleys, and easements. The Clerk also reported that affidavits in support of the publication of the Resolution of Intention, the mailing of printed notices of the adoption of said Resolution and of the posting of the notices of improvement as required by law-had been made and are on file in the office of the City Clerk. .The Mayor then inquired of the Clerk if any written protests or objections against the work or the district had been filed with him In said matter. The Clerk reported that one written protest had been filed with him prior to the time set for the hearing, by the following: Miss Helen G. Bryan The Mayor then announced that this was the time and place set for the hearing of protests or objections against the work or the ass- essment district each as set forth in the Resolution of Intention hereinbefore mentioned, and asked if anyone present desired to be heard in said matter. Miss Helen G. Bryan appeared in support of her written protest. All protests were referred to the Engineer for checking and report as to the percentage of the area represented thereby. The Engineer reported that the protests represented approximately 0.001 % of the total area of-the assessment district. All protestants having been heard and an opportunity having been given to all persons desiring to be heard, and a full, fair and Impartial hearing having been granted, and the City Council having before them a diagram of the assessment district and being familiar with the assessment district and also having considered all protests filed, and having considered the matter as to the area of property represented by said protestants, Councilman Allen presented the following resolution and moved its adoption: WHEREAS, certain protests having been filed by Miss Helen G. Bryan protesting against the doing of the work and improvement described in Resolution of Intention No. 3327, or against the assessment district; and WHEREAS, the City Council has carefully considered all protests or objections and having considered the area of the district represented by said protests: .I Committe report on dumping residue into City sewer system. Order ascertaining and determining rate of wages pursuant to Res. of Intention No. 3327 NOW, THEREFORE, BE IT RESOLVED by this City Council that It does hereby find and determine that the said protests or objections have been made by the owners of less than one -half of the area of the property to be assessed for said work and improvement as set forth in said Resolution of Intention No. 3327; and BE IT FURTHER RESOLVED, that each and all of the said protests or objections be and the same are hereby overruled and denied. Said motion was duly seconded by Councilman Robertson and carried by the following vote: AYES: Councilmen, Allen, Siler, Isbell, Robertson, Reed 'NOES: Councilmen; None ABSENT: Councilmen, None Councilman Robertson then moved the adoption of Resolution Ordering Work No. 3345 in the matter of construction of sanitary sewers in Ocean Boulevard and other streets, alleys and easements in the City of Newport Beach, which motion was adopted by the following vote: AYES: Councilmen, Allen, Siler, Isbell, Robertson, Reed NOES: Councilmen, None ABSENT: Councilmen; None ORDER ASCERTAINING AND DETERMINING THE PREVAILING RATE OF WAGES TO BE PAID FOR THE FOLLOWING PUBLIC IMPROVEMENT IN THE CITY OF NEWPORT BEACH, CALIFORNIA. Councilman Isbell moved the adoption of the following resolution and order, to wit: WHEREAS, the City Council did on the 20th day of May, 1946, adopt Resolution of Intention No. 3327 for the construction of sanitary sewers and appurtenantwcrk in connection therewith in Ocean Boulevard and other streets all within the City of Newport Beach, California; and WHEREAS, pursuant to the provisions of the Labor Code of the State of California, it is necessary that the City Council of the City of Newport Beach ascertain and determine the general prevailing rate of wages on public works, and by the provisions of said code make it mandatory upon the awarding body of any public contract where the said body subsequently calls for bids for any public improvement, to ascertain and determine the general prevailing rate of per diem wages in the locality in which the work is to be performed, for each craft or type or workman or mechanic needed to execute the contract, and also the general prevailing rate for legal holiday and overtime work for each craft or type of workman or mechanic. B. Rudd, Ray Copelin and Richard H. Pleger as ex- officio members of the Planning Commission for one year terms to succeed Councilman Isbell, Building Inspector Nelson and City Engineer Webb whose appointments were declared vacated on motion of Councilman Robertson, seconded by Councilman Isbell and carried. On motion of Councilman Allen, seconded.by Councilman Isbell and carried, the appointments made by the Mayor were confirmed. The letter of Mrs. Stanley Smith calling attention to the traffic hazzard on Avocado Avenue, Corona del Mar and suggesting that a sign be installed as a safety measure was on motion of Councilman Allen, seconded by Councilman Siler and carried, referred to the Street Department. Edison The question of furnishing water outside the City met with some disfavor Company. but after some discussion of the matter in which it developed that a minimum amount of water would be consumed, Councilman Robertson moved the adoption of a resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City a contract with the Southern California Edison Company for furnishing water at the proposed sub - station. A delegation appeared before the Council regarding the Deligation addressing licensing of rooming houses and apartments, after considerable Council regarding the discussion on the subject City Attorney Thompson explained the situation licensing of rooming interpreting that section of the license ordinance pertaining to same houses. which appeared to satisfy the protestants.
