February 10, 1947 The City Council of the City Qf Newport Beach met in regular session in the City Council Chambers at-the City Hall at the hour of 4 o'clock p.m. on above date with Mayor Reed presiding. • The roll was called, the following Councilmen answering present: Allen, Isbell, Robertson, Reed, Siler., The Mayor asked if any of the Councilmen or anyone in the audience wished the minutes of the previous meeting, or any part thereof read; no one responded and the reading of the minutes was dispensed with. REPORTS OF HEADS OF DEPARTMENTS ' The report of the City Treasurer was read and on Councilman Isbell, motion of Councilman Allen, seconded by and carried, the report was ordered filed. The reading of the reports of other departmental heads was.dispensed with and all the reports ordered filed. REPORTS OF SPECIAL COMMITTEES: None ' REPORTS OF STANDING COMMITTEES: None COMMUNICATIONS The application of Lyle V. Finley for a license to run a delicatessen at 220 Marine Ave., Balboa Island was on motion of Councilman Allen, seconded by Councilman Siler and carried, granted, subject to the approval of the Health Officer. The application of Albert D. Winner for a license to sell war surplus goods in the 1000 Block Coast Highway 4uncilman within a fenced enclosure was on motion of Allen, seconded by Councilman Siler and carried, denied on a ruling by the City Attorney that the same was in violation of a City ordinance requiring business establishments to be conducted in a building. The applicant addressed the Council on the matter. Doris Powers presented a letter protesting the Issuance of an Electrical Contractor's license to Nelson Stafford at 424 Santa Ana Aveue contending that zoning restrictions prohibited business enterprises in a residential dis- tract. The City Attorney and members of the Council explained that a contractors license was not a business license and suggested that the matter be referred to the Police Department for investigation to . determine if an electrical business was being carried on at. the address given, whereupon it was moved ' by Councilman Isbell, seconded by.Councilman Siler and carried, that the matter be referred to the Police Department, The Council was addressed on the subject by Doris Powers, Kate McCann and Chief of Police Hodgkinson. The request of Clyde E. Sherwood on behalf of C. West for permission.to construct a bulkhead across a City owned lot In the Canal Section and a lease on said Lot 4, Block 434, Canal Section was presented and after some discussion of the question it was moved by Councilman Isbell, seconded by Council- man Allen and carried, that permission be granted to construct the bulkhead, the matter of a lease being denied. The request of Paul A. Palmer on behalf of the Griffith Company for a license to operate a bus service on Lido Isle for the convenience of residents of tint district was on motion of Councilman Allen, seconded by Councilman Isbell and carried, Laid on the Table for further consideration. The request of Paul A. Palmer for a ten year lease S on a certain City owned lot at the between dead end of Central Avenue and Lot 112b, Tract 907 for a parking area in conjuntion with a business district plan of the Griffith Company and enclosing a check for the first and last months rental on same was on moon of Councilman Isbell, seconded by Councilman Siler and carried, Laid on the Table pending further study of the matter. The request of the Fishermen's Cooperative Association urging the Council to procure a suitable fire boat equipment for the harbor to be placed under the control of the Fire Depart- ment was presented and after going into the matter in which Bert Mills addressed the Council in favor of protection for boats in the harbor, it was moved by Councilman Allen, seconded by Councilman Siler and carried, that the matter be referred to the Harbor Committee. The communication of Ralph S. Brooks announcing the opening of a consulting engineers office.in Monrovia, California Pnd setting forth in a brochure the various projects handled was on motion of Councilman Allen, seconded by Councilman Isbell and carried, ordered filed. The request of the Balboa Angling Club for permission to install a pier and small float together.with a club building at the bay end of Adams Street for the weighing of fish caught by sport fishermen, all of -said structures to be financed by . the Club was presented; whereupon, the City Attorney ruled that the City ordinance prohibited any structures over the water of Newport Harbor unless built by the City. Councilman Siler suggested that the building might be constructed on the land side of the pier and that a plan of same be submitted. Avenue to the existing alley in that block was presented, whereupon City Engineer Webb.explained the situation and approved the vacation of the alley and on motion of Councilman Allen, seconded by Councilman Isbell and carried, the matter was referred to the City Engineer. The Affidavit of Publication, together with the Affidavit of Posting was presented and'the Clerk stated that no written protests had been filed, then Mayor Reed asked if any one in the audience wished to protest the abandonment of the alley, no one responded, whereupon, Councilman Allen moved the adoption of a resolution, being a resolution ordering the vacation, abandonment and closing up of that certain alley in Block A -37, Ccr ona del Mar. The motion was duly seconded by Councilman Siler, the resolution designated Resolution No. 3434 and was adopted by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Robertson, Siler, Isbell, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Ord. No..556 The ordinance prohibiting the erection of buildings, Prohibiting erection of piers or other structures in, into or over the waters of Newport buildings in, into or over Harbor came up for final adoption. The ordinance was read in water. full, whereupon Councilman Allen, moved the adoption of the ordinance which was duly seconded by Councilman Isbell, the ordinance designated Ordiance No. 556, and was passed by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Case of Robert M. Hixon City Attorney presented a written report of the Court vs City Council favored City. decision in the case of Robert M. Hixon vs the City Council and Building Inspector of Newport Beach; the decision being favorable to the City. NEW BUSINESS Gasoline bid awarded to The Clerk advised that this was the time for receiving Standard Oil Company. bids for the furnishing of gasoline for the ensuing year and advised that one bid had been submitted, being that of the Standard 011 Company of California. The bid was opened and read, and on motion of Councilman Allen, seconded by Councilman Robertson the bid was awarded to the Standard 011 Company and the Mayor and City Clerk authorized to execute the contract in connection with same by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Robertson, Siler, Isbell,Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None 0 El 0 s 0 Petition presented incorporate "Balboa into the City. r, to Bayshores Res. A petition to alter the boundaries of the City of Newport Beach and to incorporate and include therein certain new inhabited territory to be annexed thereto, said new territory to be designated and known as "aalboa Bayshores" was presented and on motion of Councilman Isbell, seconded by Councilman Allen and carried, the City Clerk was directed to check the names of the signers of the petition with the Great Register of Voters to determine the sufficiency of the petition. Resolution No. 251 of the Planning Commission . denying the application A. B. Haigh for a 50,% front and 50% side set back variance for Lot 5, Block 635, Canal ' Section was presented and after hearing the applicant, who addressed the Council on the matter, and who suggested that no action be taken by the Council pending making a new application to the Planning Commission for the variance, hence no action was taken by the ouncil. Resolution No. 252 of t1le Planning Commission denying the application of H, S. cGregor for a variance respecting Lot 4. Block 10, Tract 626, was presented and on motion of Councilman Allen, seconded by Councilman Isbell and carried, the action of the Planning Commmssion was approved. Resolution No. 253 of the Planning Commission approving the application of Ted Oliver for a 50% front yard set back for Lot 5, Block L, Seashore Colony Tract, was on motion of Councilman Allen, seconded by Councilman Siler and carried, approved. • The request of Chief of Police Hodgkinson for the conformation of William Larue Young as a Special Officer of the Beach City Merchant Patrol was on motion of Councilman Isbell, seconded by Councilman Allen and carried, granted. On motion of Councilman Allen, seconded by Council- man Siler, the appointment of Ralph Henry Coke as Harbor Patrolman was confirmed by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Robertson, Siler, Isbell Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None On motion of Councilman Allen, seconded by Council- man Siler the appointment of Richard C. Starkey as Harbor Patrolman was confirmed by the following roll call vote, AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None The monthly Demands having been duly audited by the Finance Committee were on motion of Councilman Allen, seconded by Councilman Isbell, were allowed and Warrants ordered drawn by the following roll call vote, to wit: AYES, COUNCILMEN: Allen, Isbell, Robertson, Siler, Reed NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None W. H. Fawcett addressed the Council on the matter of dredging the Grand Canal, Balboa Island, much discussion being had on the subject, the question of dredging in other portions of the Bay being considered as was the condition of the City's dredger. On motion of Councilman Allen, seconded by Councilman.Siler and carried, the City Engineer was instructed to ascertain the cost of putting the City dredger In condition; estimate the cost of the dredging to be done and to get an estimate from other firms doing dredging in order to determine which would be most economical method for doing the work. Councilman Siler suggested seeking County funds to assist in the dredging program. Councilman Siler left the meeting at 6 :15 P. M. asking to be excused due to pressing business. ' Mayor Reed brought up the matter..of the Central Avenue improvement, the widening of Coast Boulevard. Ralph Maskey brought up the plan of improving Central Avenue from McFadden Place to B Street as suggested by the Chamber of Commerce, the plan calling for the relocation of eletric poles of the Pacific Electric and Edison Company from McFadden Place to 16th Street. Councilman Robertson moved that the City Engineer contact the Pacific Electric in the matter of moving their poles, the motion was seconded by Councilman Isbell and carried by the following roll call vote, to wit: AYES, COUNCILMEN: Isbell, Robertson, Reed NOES, COUNCILMEN: Allen ABSENT, COUNCILMAN: Siler Petition presented incorporate "Balboa into the City. r, to Bayshores Res. A representative of the Southern Counties Gas Company addressed the Council with a request to install a rectifier on City owned property on the North Channel in the vicinity of the Sea Scout base. On motion of Councilman Robertson, seconded by Councilman Isbell, and carried, the request was referred to the City Engineer for Investigation. The application of Emily Bergey for a permit to construct a pier fronting on Lot 12, Block 219, Section A was on motion of Councilman Robertson, seconded by Council- man Isbell and carried, granted. The application of L. R. Morris for a permit to install a pier fronting on Lot 7, Block 238, Canal Section was on motion of Councilman Robertson, seconded by Councilman Isbell and carried, granted, subject to the approval of the War Department. The application of W. E. Woolever for a permit to install a pier fronting on Lot 3, Block 434, Canal Section was on motion of Councilman Robertson, seconded by Councilman Isbell and carried, granted, subject to the approval of the War Department.
