Page 137 - Volume 12 ,1��tA' Minutes of SPECIAL MEETING OF THE CITY COUNCIL Date of Meeting: January 16, 1959 Time of Meeting: 3:45 P.M. _ Ince j Place of Meeting_- -- - - - - - -- Council .Chambers -------- °- °-- -1- --- I Mayor Stoddard stated that a special meeting was being held by the City Council of the City of , Newport Beach for the purpose of considering the request of George P. Carver, the bidder to whom the award of the lease was made on the County G.P. Carved Dock property, that the City join as plaintiff in; re County ; a Superior Court action to seek a court order Dock Proper - requiring the Chairman of the Board.of Super- ty Le visors to execute the lease on behalf of the CAM ; County. The City Clerk stated that all Council members , I 1 ; had signed a Consent and Waiver to the holding of: said meeting: ' The roll was called. :Present x; :x x;x;x s .Absent 1 , The Council considered a Lett r from Harry ix; Ashton of the law firm of Asht n, Drohan and Marchetti, wherein it is stated that Willis ; Warner, Chairman of the Board of Supervisors, has indicated an intention to refuse, o sign the 'Supervisors ' lease on behalf of the Board of with George P. Carver for the County Dock property, ; and that it is the opinion of Mr. Ashton that the' ; City of Newport Beach is a desirable party to an.: : action to obtain a Writ of Mandate in the 1 ' Superior Court seeking to require Mr. Warner to , sign said lease on behalf of the County Board of ' Supervisors. ' A discussion was had. Mr. Harry Ashtop, repre- senting Mr. Carver, spoke from the audience. The City Attorney was instructed to advise Messrs. Ashton, Drohan and Marchetti that the Motion ; x; City does not desire to become a plaintiff in the; Second ;x1 suit. ;All Ayes; ; The City Attorney was instructed to either inter -1 vene in the proposed lawsuit or to advise Mr. Ashton that the City is not going to intervene, I Motion 1 ; ; .x; ; { in time to give Mr. Ashton an opportunity to make: Second :x; the City a Defendant if he sees fit.
