CA -100 Mr. King testified in detail concerning the con- ditions existing in each unit which would render the building unsafe and be detrimental to the health, safety and welfare of occupants of said units. He testified that he had observed dry rot exposed and unsafe wiring, unsanitary conditions, sagging floors; roofs, exterior walls and flooring which were badly deteriorated; doors that would not swing freely; poor ventilation; ceiling heights which were too low; debris and flammable material wedged under floor space; and he stated that in Unit 2 a Murphy bed was in a closet in a kitchen wall. Mr. King submitted and entered into evidence, photographs on five sheets of Manila paper picturing some of the conditions al- leged, there being one picture for Units 1 and 2, two pictures for Unit 2, six pictures for Unit 3, five pictures for Unit 4, eleven pictures for Unit 5, and sixteen pictures for Unit 6. Mr. Van Pelt asked Mr. King where he ob- tained his information as to the dates of the con- struction of the buildings. Mr. King stated that he had received his information from the County Assessor's records, and that a County Assessor by the name of Hartnett had given him information. Mr. Van Pelt stated that the information was er- roneous, that Units 1 and 2 were constructed in 1914; Units 5 and 6 were constructed in 1905; Unit 4 was being lived in, in 1921; Unit 3 was built a little later than 1905. Mr. Van Pelt stated he was willing to repair and rehabilitate the buildings but he had been prevented from doing so by the Building Department by reason of the fact that he was unable to obtain a building permit an was told to tear down his buildings. The City At- torney stated that he believed that the Building Department had explained to Mr. Van Pelt that, in order to repair buildings in the condition of sub- ject buildings, he should start by obtaining a Use Permit from the Planning Commission. Mr. Van Pelt stated that a Use Permit was not necessary. Mr. Van Pelt contradicted the number of windows that,, Mr. King had stated existed in Unit 6. Mr. Van Pelt stated that Mr. King had only been on the premises five minutes, so he could not have learned too much about the property.
