On motion,, the following resolution, which was read by the City Clerk, was unanimously adopted: ttWHEREAS,, the members of the City Council are person,', ally and: deeply saddened by the death.on March 14, 1961, of Bill Beeler of the Globe- Herald and Pilot,. who.report- ed the news. with.energy,- Wit and accuracy who put life and .interest in his photography; who contributed features and editorials that were stimulating,, perceptive. and fair; who built friendships and respect for'himself and-for his profession; "NOW, THEREFORE, the City Council for .itself, the City staff, and the citizens of Newport Beach who knew him, by this means would.pay public ,tribute to the memory of Bill Beeler,; a.gifted reporter and a friend; and would extend deepest sympathy,:to Mrs. Beeler and the .family. " 2. NEWPORT BOULEVARD IMPROVEMENT PROJECT: (a).(Agenda Item 2(a)) A memorandum from the City At- torney,, dated March 10,.1961; regarding a resolution authorizing eminent domain proceedings, was pre- sented. Attorney Robert Hurwitz, representing the operator of the service - station and the purchaser of the parcel on .the. northwest corner of 30th - Street and Newport Boulevard,, requested that adoption of the resolution be postponed-one, week to. give the parties an oppor- tunity to try to reach an agreement. Resolution: No. 5385, being a .resolution of the City Council of the City of Newport Beach,. finding, and determining that the public interest and necessity re- quire -the acquisition of certain real property for a public improvement, to wit,; public streets, and authorizing and directing eminent domain proceedings therefor,, was. adopted. .;(b),(Agenda Item 2(4)) A memorandum from the City ,Manager and Public -Works Director, regarding the receipt of three bids, by the City Clerk on March 15, 1961,..for the improvement of Newport.Blvd. between 22nd. and 31st Streets, including. grading, paving, traffic. island, traffic. signals, safety lighting, addi- tions, to water and sewer systems, storm drain; rec- ommending the award_of contract to the low bidder, Griffith Company, at the contract price of $90, 007. 12 was presented. (f) ,(Agenda,Item 2(e)(2)) Resolution No. 5388,, accepting an. indenture,from.the Southern Pacific Company, granting, real property to the City (Parcel5 - ,trianguh portion southeasterly, corner 26th-and Newport Boule- vard), was adopted. ,(Agenda ;Item 3). A report was presented from the City Manager, numbered 60- 61 -20, dated March 17,, 1961, r garding "Hargrave Variance No. 628, 2411 East 16th Street," recommending that the Council file subject re- port and take no further action; .indicating that Ron Hargrave, William A. Hargrave,; the City Manager, and Building Director, had reached an agreement on steps required,to achieve compliance with the City's Zoning and Building Codes, assuming that the Council action on January 23,: 1961, . wasto approve a 10' encroachment _:into the front yard. setback in order to build a 4 -car garage.
