He.stated, that the District'is willing to accept an easement ft flood. control purposes- and,not require fee. ownership, and th Court pleadings' have been amended indicating this change. Mayor Stoddard reported regarding, the. hearing held by the Board..of Supervisors in. connection. with protests against the high.increase in assessed valuation .. of properties : in- Newport Beach. He. stated that the. matter had resolved down to the question of determining what authority the Board has, and what the Assessor may do. aw a result of the protests. Ben Reddick spoke. from, the audience. The City, Attorney was tinstructed,to represent the City and its citizens before the Board of Supervisors, in the, assessment appeal actions. Ordinance No. 969,: being AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADOPTING DISTRICT MAP NO. 37, REZONING PRO- PERTY, AND AMENDING DISTRICT MAPS,NOS.. 23, 24, AND 30, creating precise zoning for which.specific.uses have already been established. Use Permit procedure; property being rezoned from. Unclassified; Planning Com mission- Amendment No. 109, was introduced, passed to second. reading and set for public hearing on August 14, 1.961. Gene Schulte of the Planning Department spoke from the audience and, indicated on a map the areas proposed for rezoning. CONTINUED BUSINESS: Resolution. No. 5455, authorizing -the Mayor and City Clerk to execute. an agreement between the City and Southern California Edison,Company, Pacific Telephone and Telegraph - Company, to permit the use of the under- ground utility system on Lido Isle and vicinity for a new term of ten .years, was adopted. Resolution, No. 5459, authorizing, the execution of an amendment to a contract with Orange County to perform soil tests for the City, extending the term thereof throu! June 30, .1962, was 'adopted. 3. Resolution, No. 5460, authorizing. the Mayor and City Clerk to execute a contract to serve water outside the City to The Newporter Hotel Corporation, was adopted. Resolution. No. 5461, authorizing the Mayor and City Clerk: to execute. an agreement, with. the Newport Harbor Lawn Bowling. Association for the maintenance. of the green at 15th Street and Balboa. Boulevard, under sub - stantially the same terms and conditions as the previous agreement, at the cost to the City of $75 per month for the period July 1,, 1961,,.through June 30, 1962,. was .adopted.
