Mayor Hart requested a report from the Committee which had met with Ira N. Frisbee to study, the proposal of the Balboa Bay Club for approval of its leasehold assignments by Deeds of Trust. Vice Mayor Lorenz, Chairman of the Committee, stated that it was the unani- mous recommendation of the Committee that approval be given to said proposal. The City Attorney. read a draft of a letter proposed to be directed.to the City Council by Van LNuys Savings and Loan Association which would in effect qualify the approval of the proposal to the extent that after disbursement of net proceeds for all remain - ing indebtedness secured by;the Deeds of Trust recorded April 6, 1960 as documents numbered 60010, 60011, 60012, and 60013 in Orange County Official Records, the remainder of the net proceeds will be disbursed.only to pay for improvements .on,the leasehold, and none of the proceeds will be paid to the Balboa Bay Club, Inc. for the purpose of reducing its indebtedness,to..its share - holders or to Inwood Investment Company. Councilman Elder joined the meeting.at this time, and Mayor Hart summarized the Committee report for Cot man Elder. Resolution No. 5943, approving. assignments of a lease- hold estate by Deeds of Trust and authorizing the execu- tion of a .Consent to such assignments, was adopted, sub ject, to the condition that the documents not be signed until the City. Attorney advises that the letter, substan- tially in the form as prepared by the City Attorney, had been signed and received from the Van Nuys Savings and Loan Association. 2. The City Attorney stated that it will be necessary, to acquire Parcel E by eminent domain,in order that the improvement of Balboa Boulevard and 28th Street may proceed, since problems had developed in the escrow proceedings with Edker Pope which will delay the ac- quisition and may. delay, the construction unless author: ,is granted.to proceed with eminent domain. The City Attorney advised that resolutions had been pre- pared to start proceedings for the proposed abandonment Abd of a portion of Back Bay Drive as provided by the con- onmnt tract with Eastbluff- Newport, Inc., Jamboree Land Com porti m pany, and The Irvine Company, authorized by Resolution of Ba ck No. 5893. A discussion was. had. Back Bay Resolution No. 5945, adopting a map showing a portion of a certain street known as Back Bay Drive which is R =594 proposed to be vacated, closed,up, and abandoned, was M -ID adopted. - a_5946 Resolution No. 5946, being a Resolution of Intention of vacate s the City Council of the City of Newport Beach declaring Back its intention to order the closing,up,, vacation and aban- Bay donment of a portion of a certain street known as Back Dr. Bay Drive, setting a public hearing_ thereon for April 27, pb ',rg 1964, was adopted. 404— 27 -6: CA 14 The meeting was adjourned at 8:55 A.
