Gilstrap, Manager of the West Coast �Q Division of G. E. Kadane & Sons, dated January 18, 1965, AM OM regarding oil activity in Annexations No. 54 and No. 55, 54 & enclosing a copy of a letter from their attorneys, Rutan & 55 ®$l Tucker', dated January 13, 1965, addressed to G. E. Kadane ,Srtll° & Sons, setting forth an interpretation of the Charter of vitCgy Newport Beach and the Municipal Code sections pertaining to oil well drilling and the production of oil, had been continued on January 25 for consideration on January 28 at an adjourned Council meeting. The City Attorney, explained that there were questions re- garding the rights of Kadane & Sons to drill and produce oil in the territory involved in subject Annexations. He stated that Charter Section 1401 as it applies to the twenty acres would preclude the Kadane interests from exercising any surface drilling rights on any of the territory in said Annex- • ations, and that the Council could therefore deny the requesM1`' to so drill. A discussion was had. J. S. Gilstrap, Attorneys Fritz Stradling and Mike McCormick of the law firm of Rutan & Tucker, Mrs. John Hammond, and Mrs. T. Duncan Stewart, spoke from the audience. The Council accepted the City Attorney's interpretation of Motion x Charter Section 1401 as it applies to the twenty acres, and Ayes xx x x x x x further suggested that the City Attorney and the Mayor draw up whatever kind of document they would want to draw, whether it be a motion, a minute resolution, or a full resol- ution, clarifying, if necessary, the City's position, and the were empowered, if investigation determined the step desir able, to request the landowner of subject twenty acres to CA-67 initiate de- annexation procedures. ADDITIONAL BUSINESS: is Mayor Gruber stated that on February 4 at 9:30 a.m., in FWY the Municipal Auditorium of the City of Long Beach, a hear ing would be held by the State Highway Commission regard - CA-69 ing 11. 6 miles of Pacific Coast Freeway in Long Beach. George'Meinhardt commended the Council for its continued fight against the proposed location of the Freeway. RECESS for personnel session was declared by Mayor Grub r. The Council reconvened with all members present. The Council adjourned at 10 :00 P.M. to 9:00 A. M. on Frida r, Motion x February 5, 1965.
