HEARINGS:
1. Mayor Gruber opened the public hearing in connection
with the appeal of Roger S. Watson, et al. , from the
decision of the Planning Commission conditionally
granting Use Permit No. 1103 for the removal of
earthen materials in the area between the Upper Bay
and Irvine Avenue and the lines extended from the
prolongation of 22d and 23d Street in an unclassified
zone.
A letter of appeal from "Citizens for Back Bay
Beautification" bearing eight signatures dated March 4,
1965; a copy of a memorandum to the members of the
Newport Beach Planning Commission dated February
11, 1965 from said citizens; and the findings of the
Planning Commission, were presented.
Angus W. Potter and Roger S. Watson, representing
the appellants, James Ballinger of the Orange County
Harbor District, the applicant for the Use Permit,
and J. W. Drawdy, Planning Director, spoke from the
audience.
It appeared that arrangements could be agreed upon
between the appellants and the applicant for the conduct
of the removal of earthen materials. The hearing was

"Blue Line Route" that was studied in connection with
the adoption of the route for the Coastal Freeway did

concurred in this statement.

Beacon 1. A letter dated January 29, 1965, from Ira N. Frisbee
Bay & Co, submitting "Computation of Lease Rental from
Lease the property known as Beacon Bay for the years 1950
audit through 196411, and a memorandum from the Acting
City Manager dated March 22, 1965, regarding the
C °505 Beacon Bay Lease audit, were presented.
It was directed that the report of Frisbee & Co. be
received and filed, and the staff be instructed to
• proceed with the collections as shown that are due
the City; the City Attorney was instructed to research
the provision of our lease which calls for a readjust-
ment of rentals in connection with the cost of living
index and report back to the Council as to what date
we may invoke this right, which is in our contract,
C °38 and determine how far back it goes.

A letter from Mrs. Marguerite E. Mitchell, 1824 West
Ocean Front, dated March 15, 1965, opposing the road
to the Lifeguard Headquarters, and a letter dated
March 7, 1965, from R. S. and Marguerite E. Mitchell
opposing subject road, were presented.
Councilman Elder explained that the Acting City. Manager
had been instructed, on March 8, 1965, to submit
recommendations regarding the proposed road to the
Lifeguard station; that somehow a misunderstanding had
occurred, resulting in a belief that the development of the
road along Ocean Front was contemplated by the Council,
in addition to the road to the Lifeguard station, and that
someone had sent an anonymous letter to residents in the
area (not to the Council) making such an allegation.
Councilman Elder stated that the allegation was not correct
and also that the proposed access road to the Lifeguard
Headquarters was not the start of a parking lot. It was
stated that the report from the Acting City Manager would
be on the agenda for April 12, 4965.

2. A letter dated March 5, 1965, from James W. Berkshi3

requesting permission to have an egg hunt on Easter
Sunday, April 18, to be conducted bayward of Berk-
shire's restaurant and Arches' Marina, was presented.
A discussion was had. James Berkshire spoke from
the audience. An amended request, setting forth
the rules of the proposed contest, was submitted by
Mr. Berkshire at the Council Meeting. Councilman
Marshall commended the idea of the proponents but
felt the hazards were too great.

5. The Claim for Damages of Floyd Martinez for alleged
damage to his automobile when it was struck by a
truck owned by the City of Newport Beach, in the City
Yard on March 10, was presented.
The claim was denied, and the City Clerk's referral
of the matter to insurance carrier was confirmed.
6. The claim of Humble Oil & Refining Company for
refund of $704. 70 collected by County Tax Collector
as real property taxes "erroneously and /or illegally
assessed to and collected from said Company for the
year July 1, 1964 through June 30, 1965 under the
following described assessment:" Parcel 900 - 400 -60;
100% interest in mineral rights in AP 45- 000 -01; all
between City limits line and SW prolongation of SE
line of 53rd bounded N by high tide line, was denied.
7. A letter from Howard W. Crook, Secretary - Manager,
Orange County Water District, Santa Ana, regarding
a Senate Bill introduced by Senators Kuchel and Murp]
of California which proposes a solution to end the
dispute over the water of the Colorado River, was
ordered filed.
8. A letter from Roy O. Andersen, District Superintend
Newport Beach Elementary Schools, stating that the
District is desirous of having the Lincoln School site
adjacent to Big Canyon Reservoir annexed to the City
of Newport Beach as soon as possible, was referred
to the City Manager to contact Mr. Andersen and to
tie this in with the proposed Annexation No. 57.
9. A letter from Robert R. Hurwitz, Secretary of Marina
Dunes, regarding plans of Newport Dunes to construct
a motel on its premises leased from the County of
Orange and objecting to any construction which would
interfere with access to sub - leasedpremises or to the
parking for boat slip tenants of the Marina Dunes, was
referred to the Planning Commission.
BUDGET AMENDMENTS:
The following Budget Amendments were approved:
C -51, in the amount of $180 (decrease in Unappropri-
ated Surplus) being an increase in Budget Appropri-
ations for additional funds for Beacon Bay Lease
audit performed by Ira N. Frisbee & Company as a
result of additional man hours required over original

2. A letter from James Mussatti, Chairman of
Citizens Committee for Balances Legislative
Representation, urging support for "the ability
of the people of the several states to choose for
themselves the manner in which state legis-
latures shall be constituted in the future."
3. Copies of Agendas of meetings of the Board of
Supervisors held March 9, 10, 16 and 17.
4. A copy of a letter from Bradford M. Crittenden,
Commissioner of Department of California High-
way Patrol indicating to Chief Glavas that he will
be unable to assign officers to patrol within the
City of Newport Beach during Easter vacation,
but that should an emergency arise, assistance
would be provided. Letter bears notation from
the Acting City Manager that, "This apparently is
a new policy and will mean that our total personnel
complement will be reduced by six men, as this
was the number assigned in prior years by the
Highway Patrol."
5. A note from James 0. Bell, 878 West Wilson,
Costa Mesa, asking if the City wants all three
Freeways through Costa Mesa, all leading to
Newport Beach, and none in Newport Beach.
6. A letter from Lorraine Harris, Classified De-

(b) A copy of a petition to the Planning Commission
from Harbor View Hills Community Association
bearing 175 signatures opposing rezoning which
would allow buildings over 35 feet in height from
the average ground level of the 122 acres located
north of Pacific Coast Highway and west of
MacArthur Boulevard.
(c) A letter from Bernard C. Adams, Civil Engineer,
1265 Brookhurst, Garden Grove, commending the
Building Department for assistance, courtesy,
and expedient handling of special problems.
(d) A bulletin from the State Department of Justice,
Commission on Peace Officers Standards and
Training, dated March 1, 1965 indicating progress
of California Peace Officers Standards and
Training Program; stating that Newport Beach had
ten officers trained in basic course with reim-
bursement of $2,973. 07 and four officers trained
in the supervisory course with reimbursement of
$601.32.
