A memorandum was presented from the Public Works Director dated February 1, 1966 regarding street improvements, Westcliff -Dover intersection, Fifth Avenue from Larkspur Avenue to Poppy Avenue (C -954). Robert Lynam, a partner in the firm of E. L. White Company, the low bidder, spoke from the audience. A discussion was had. Resolution No. 6284 awarding a contract for the street improvement, Westcliff -Dover intersection, Fifth Avenue from Larkspur Avenue to Poppy Avenue (Contract No. 954) with E. L. White Company at the contract price of $65, 300.81 (waiving the irregularity in the bid bond that was submitted with the low bid, Motion x and with the understanding that change orders be Roll Call: executed immediately), was adopted. Ayes xxxxxx x s A change order deleting the construction surveys from the contract, and a change order correcting the quantity of curb listed in the Proposal Item No. 12, incurring an additional cost of $2, 514. 76 based on a unit price of $2.42 per lineal foot, proposed by the contractor for the additional amount of curb which Motion x exceeds the original Proposal quantity, were approved. Ayes xxxxxx x The Public Works Department was authorized to retain the firm of Raub, Bein, Frost & Associates to perform the construction surveys for a total fee not to exceed Motion x $3,200. Ayes xxxxxx x The following Budget Amendment was approved: Motion x Ayes xxxxxx x C -55 in the amount of $15, 500 (decrease in Unappro- priated Surplus) being an increase in Budget Appropriations, for improvement of Westcliff -Dover — - intersection, Fifth Avenue from Larkspur Avenue to Poppy Avenue; $15, 500 from Unappropriated Surplus State Gas Tax 186. 1 Funds to General Services - Streets, Land Improvement. 2. Upon the recommendation of Mayor Gruber it was agreed to consider a Commission appointment later in the evening. 3. Committee, as submitted by Chairman Councilman Lindsley Parsons, Mayor Gruber and Councilman Marshall, was considered. Portions of the report were read, from time to time, by Mayor Gruber during the discussion of the proposed Charter Amendments. Section 402 was proposed for amendment to increase Motion x the monthly expense allowance of City Councilmen Ayes x x x x x x x from $100 to $200. Section 404 was proposed for amendment to increase Motion x the Mayor's extra expense allowance from an amount Ayes x x x x x x x not exceeding $50 to an amount not exceeding $100. A proposed amendment to Section 404 which would entitle the Mayor Pro Tempore to receive the Mayor's extra expense allowance if he serves in the Mayor's Motion place for more than 30 consecutive days was deleted Ayes x x x x from consideration. Noes x x Section 602 was proposed for amendment to direct Motion x that the City Attorney shall prosecute misdemeanor Ayes xxxxxxx offenses arising under State law if authorized and directed to do so by ordinance or resolution adopted by the City Council. Section 610 was proposed for amendment to be sub- Motion x mitted to the voters, as suggested by the Committee; Ayes x x x x x being the deletion of the following paragraph: "This Abstain x x section, however, shall not apply to the probationary or permanent appointment of any person to a position included in the Civil Service System. " Section 706 was proposed for amendment to decrease Motion x the number of members of the Planning Commission Ayes x x x x x x x from nine to seven, and to direct: "The Planning Director, the City Engineer and the City Attorney, or their assistants, shall meet with and participate in the discussions of the Planning Commission but shall not have a vote." RECESS for ten minutes was declared by Mayor Gruber. The. Council reconvened with all members present. Coleman. Attorney Robert Hurwitz, a former member of the Library Board, spoke from the audience in favor of the proposed amendments. The proposed amendments to Section 708 were tabled Motion x for consideration at the next Council meeting. Ayes x x x x x x x Section 709 was proposed for amendment to correct Motion x in Subparagraph C the title of the Recreation Director Ayes x x x x x x x to be the Parks, Beaches and Recreation Director. Section 1005 was proposed for amendment for the first Motion x paragraph to read as follows: "Districts. The City is Ayes x x x x x x x hereby divided into seven districts, the names and respective boundaries of which shall be established by ordinance." The proposed amendments to Section 1107, Tax Limits Motion x were tabled. Ayes x x x x x x x Section 1110,as proposed for amendment by the Committee,was approved so that the first paragraph Motion x w o u l d r e a d: "Contracts on Public Works. Projects for the maintenance or repair of streets, drains or sewers are excepted from the requirements of this paragraph if the City Council determines that such work can be performed more economically by a City department than by contracting for the doing of such work." Section 1116 was proposed for deletion entirely. Motion x Ayes xxx xxx x Section 1402 ;(d) was proposed for addition to the Motion Charter which would enable the City Council to sell Ayes x x x x x x x and convey a certain triangular parcel of City -owned real waterfront property which is located southerly of the westerly 30 feet of Lot 8, Block 22, East Side Addition to the Balboa Tract, adjoining the property of Mr. John A. Blaich between E and F Streets on East Balboa Boulevard. Mayor Gruber recessed the meeting for an executive session at 11 :10 P.M. to consider an appointment to the Planning Commission. The Council reconvened at 11:34 P. M. with all members present. The Council agreed not to fill the vacancy on the Planning Motion x Commission at this time in view of the recommendations Ayes x x x x x x x of the Charter Amendment Committee to reduce the number of members of the Planning Commission from nine to seven.
