Place of Meeting: Council Chambers Roll Call: The reading of the Minutes of the Adjourned Meeting of August 19, the Regular Meeting of August Z6 and the Ad- journed Meetings of August Z8 and Z9, 1968 was waived, and said Minutes were approved as written and ordered filed. HEARINGS: 1. Mayor Marshall opened the continued public hearing regarding the appeal of Mr. and Mrs. Phil Lansdale from the decision of the Planning Commission attaching four conditions to the granting of Variance No. 949 fora 516" front setback with balconies pro- jecting five feet, for balconies projecting Z16" into a three foot side yard, for three stories in height but within the overall height limit of thirty -five feet and for unenclosed balconies which makes floor area exceed the maximum allowable, at 815 E. Bay Avenue; Balboa, Zone C -1. Councilman Rogers stated that Mr. Lansdale was objecting to the Planning Commission's interpretation of Condition No. Z,only, in that "be provided" in fact means "be dedicated ". Said condition states that a standard corner cut -off be provided at 'A' Street and Bay Avenue as approved by the City Engineer and the balconies be adjusted accordingly. Planning Director Ernest Mayer, Jr, reported on the findings of the Planning Commission, Mr. Phil Lansdale spoke from the audience and ob- jected to dedicating the standard corner cut -off rather than providing a standard corner cut -off as stated in Condition No. Z. Herb Brownell, architect for Mr. Lansdale, spoke from the audience and stated that he considered the usage of the word "provided" poor terminology; how- ever dedication of the cut -off corner would not affect the building plans if an encroachment permit for the second and third story balconies was granted. Mayor Marshall closed the hearing with the unanimous consent of the Council. A report from the Civic Center Site Selection Com- mittee was presented with a letter from the Balboa Peninsula Point Association requesting more time for study of the consultant's report before a decision is made on the selection of a site. The City Clerk stated that additional letters were received from ElaineLinhoff and Mrs. Emory S. Moore, Jr. expressing views on the site selection study. The following people from the Harbor View area participated in a discussion of the 35 foot height zoning restrictions in the area of the proposed site "C ": Fred Bice, President of the Harbor View Hills Community Association; Dusty Reed, Legislative Chairman of the Broadmoor Community Association; Frank Legrand and Ed Cavanaugh, members of the Broadmoor Association. Planning Director Ernest Mayer, Jr, reported on the restrictions in the area. Jack Beardwood, Senior Vice President of Welton Becket and Associates, spoke from the audience. Harvey Pease spoke from the audience and stated that the final decision of selecting a site should be submitted to the people. A letter from Allan Beek was presented stating he believes most of the opposition to EPS stems from a distrust of the police and suggesting a committee to try to find the reason for this distrust so that it may be corrected.
