A report was presented from the Community Develop- Newp ment Department dated April 10 regarding Plan Check Cente No. 42452 of Smyth Construction Company on height Bldg and configuration of building located on Parcel 2, Sector 200, 200 Newport Center Drive, total building height forty feet. • Tully Seymour, attorney for Smyth Construction Company, spoke from the audience and presented a record of economic expenditures and a copy of the current lease for the record. Chuck Smyth of Smyth Construction Company spoke from the audience and asked that Council grant the permit in question. The following people spoke from the audience in op- position to the granting of subject permit and /or asking for postponement of any action for two weeks: Ed Cavanaugh, representing Broadmoor Home Owners Dave Gambill, 1239 Surfline Way and Bob Orman of Broadmoor homes. John Hooten stated he had a vested interest in the 200 block and was in favor of granting the building permit. Motion x Councilman Kymla moved that the building permit be issued to Smyth Construction Company. The Council reconvened with all members present except Councilman Dostal. 2. The staff was authorized to obtain additional proposal= for consulting services in connection with the coastal element of the General Plan. 3. Federal Aids TOPICS project, Contract No. 1403, was considered, for installation of traffic signal at the intersection of Newport Center Drive, Newport Center Drive East and West; and for the installation of traffic signals at the intersection of Bayside Drive, Jamboree Road and Marine Avenue and at the inter- section of Placentia Avenue and Superior Avenue. . Traffic Engineer Robert Jaffe gave a staff report on the need for the Newport Center signal and the methods used for establishing needs. Bill Whitman, President of the Newport Center Association, re- quested that there be no delay in installing the signal. Mrs. Barbara Cox, Balboa Island resident, opposed the installation of the signal at Jamboree at Bayside and Marine Avenue. Plans and specifications were approved for subject signals, and the City Clerk was authorized to adverti for bids to be opened at 11:00 a. m. on May 16, 1972. 4. A report was presented from the Public Works Director regarding request of Curtis A. Herberts for an encroachment permit, or some other alterna- tive arrangement, for use of the City -owned property adjacent to 2949 Cliff Drive in connection with the proposed construction of a new garage, driveway and landscaping. Curtis Herberts, applicant, stated that what he actually wanted was to buy the property from the City. Subject request was denied, without prejudice. 5. A report was presented from the City Attorney re- garding a proposed ordinance of the City of Newport Beach adding Section 20. 08.290 to the Newport Beach Municipal Code limiting the heights of buildings in Volume 26 - Page 92 INDEX General Plan Traffic Signals Cliff Dr Encroach- ment Height Limits COUNCILMEN '�. �� ROLL CALL CITY OF NEWPORT BEACH April 24, 1972 MINUTES INDEX Newport Beach, providing for public hearings in con- nection with any structure exceeding twenty -eight feet in height and providing for appeal procedure, A resolution of the Newport Harbor -Costa Mesa Board of Realtors opposing the proposed building height limitation was distributed to the Council. David Klages, President of the Orange County Chapter of the American Institute of Architects, read a letter from the chapter opposing the proposed ordinance- The following people spoke from the audience opposing the proposed height restrictions: Stewart Woodard, Raymond Watson of The Irvine Company, Henry LeFebvre, James Parker, John Macnab, Roy Woolsey, Frances Horvath, Jane Joy, Barbara Owney and Harvey Pease. Allan Beek, Chairman of the Newport Residents United, spoke in favor of the proposed twenty -eight foot height limit. Councilman Croul made a motion to refer the matter to the Planning Commission and to substitute thirty- five foot height limit for the proposed twenty -eight foot height limit. Councilman Kymla made a substitute motion to limit the height to twenty -eight feet in R -1 and R -2 zones only. Motion x Mayor Pro Tem Rogers made a substitute motion to Ayes x x x x x x refer the matter to the Planning Commission, with no Absent x reference being made to specified height limits, for public hearing and for recommendation to the Council. Alexander Golanda and John Gilganon, adjacent pro- perty owners, spoke in opposition to the proposed development. Don Beckley, a resident of Newport Shores, expressed concern about drainage and traffic in the area. Mike Johnson, Lido Sands resident and President of the West Newport Beach Association, suggested 15th Street as a back access to the property and urged that number one priority be put on the Superior Avenue widening. A letter from Walter Koch, Chairman of the Citizens Pacific Coordinating Committee of Newport Beach, stating Coast that Assemblyman Burke's AB 1837 is a delaying Freeway tactic and would cost the City of Newport Beach lost. tax revenues due to State land holdings, urging the Council to vigorously support Assemblyman Badham's AB 1322, and recommending that the City engage the services of a legislative advocate in Sacramento to represent the City's official position in support of the Badham Bill. Resolution No. 7686, opposing the passage of AB 1837 R -7686 introduced by Assemblyman Burke, regarding the creation of a Coastal Corridor Review Board, was adopted. 2. Wright, 217 Via Jucar, read a letter to Lido Isle the Council requesting consideration of the petition Tennis submitted to the Council in November, 1971 urging Courts prohibition of the installation of flood lights on tennis courts within the City of Newport Beach, and requeste that no permits be issued for the installation of tennis court lights until such time as the City has completed its study and made a decision. The staff was directed to withhold issuing an electri- cal permit to the Lido Isle Tennis Club until after completion of the study. The meeting was adjourned at 1:10 A.M., April 25, 1972.
