Said vending will be performed during the summer months and during warm periods in the spring and fall and will be conducted from tricycles equipped for that purpose. A report was presented from the Marine Department. A report was presented from the Litter Control Citizens Advisory Committee stating they have no objection to approval of the request. The following people addressed the Council and presented letters and lists of names of residents who oppose vending along the beach: Bud Van Ornum, Charlene Fannon, Albert Irwin, and Jack McCarthy. Ed Siebel and Joe Casala addressed the Council opposing vending along the beach. Phelps, Mrs. R. W. Gerard and C. Harrington to the Daily Pilot regarding the school lease. Documentation on the Need and Support for the Senior Citizen Center on 5th and Marguerite - • Newport Beach was received from Friends of Oasis. The City Manager, Robert Wynn, announced to Council that a letter from HUD had'been received late that day requesting additional information regarding the cooperative use plan for the 5th and Marguerite property. The following people addressed the Council in favor of the Carden School lease and joint use of the property by the Senior Citizens: Pat Harkless, Jerry Williams, Robert Perkins and Jack Wassall. The following people addressed the Council opposing the lease of the 5th and Marguerite property to the Carden School: Joe Mariscal, Frank Reimer, Glenn Anderson, James Harrington, Janet Mariscal, Grant Howald, James Sawyer, Barney Larks, Greg Bishop, Julianna Schmidt and Jeanne Wanlass. Barney Larks was granted one more minute by Mayor Pro Tem Barrett. George Perlin addressed the Council stating that the Senior Citizens should try and make the best use of both the Carden School and the church facility on Cliff Drive. Mayor Dostal arrived and took his seat at the Council table. Motion x Councilman Ryckoff made a motion to postpone the matter to May 23. Motion x Councilman Williams made a substitute motion for Ayes x x x x x a five minute recess so Council could read the Noes x letter which had been received from HUD, which x motion carried. The Council reconvened with all members present. Ayes x x x x x A vote was taken on Councilman Ryckoff's motion, Noes x x which motion carried. Councilman Barrett was excused from the meeting due to illness. CURRENT BUSINESS: 1. A report was presented from the Public Works PCHwy Director regarding street improvements on Pacific St Impry Coast Highway - 1000 feet easterly of Balboa Boulevard, Contract No. 1896. Motion x Hardy & Harper, Inc. were allowed to rescind their Ayes x x x x x x low bid of $16,163.75; and Resolution No. 9063, R -9063 Absent x awarding a contract to T. J. Crosby Company in connection with street improvements - Pacific • Coast Highway - 1000 feet easterly of Balboa Boulevard, Contract No. 1896, was adopted. 2. Pier Concession Wolfgang Merting addressed the Council stating • that he felt he would be able to handle the pier concession more effectively than the recommended awardee. Ronald Verbs, one -of.'t e bidders, addressed the Council. Fran Unsini addressed the Council regarding the pier profits. Steve Greyshock, supplier of live bait, addressed the Council stating the project should get under way immediately. The following claim was denied: (a) Claim of John L. Meek Construction Co., Inc. for an increase in their Workmen's Compensation costs due to an unexpected increase in the rate per $100.00 of gross payroll. The contract is for the work on the Timber Pile Replacement for the Newport and Balboa Piers (C- 1827). 8. The City Clerk's referral of the Summons and Complaints to the insurance carrier was confirmed: (a) Summons and Complaint of Deneeze Copley for indemnity, Case No. 243346 in the Orange County Superior Court. An original claim was not filed. (b) Summons and Complaint of Norma G. Dill, I Case No. 26 -56 -85 in Orange County Superior Court. The original claim was for personal injuries allegedly sustained when she tripped over a defective sidewalk at 1541 Ocean Boulevard on October 6, 1976. • (c) Summons and Complaint for personal injuries of William J. The original claim involved Maurine Witcher and the City of Irvine in connection with traffic accident at the intersection of Campus and Von Karman, which intersection is allegedly mutually maintained by both cities. (e) Summons and Complaint of Ginger Ann Stomp Stomp for false imprisonment, infliction of emotional distress and abuse of process, Case No. 26 -38 -22 in Orange County Superior Court.
