Mayor Dostal opened the continued public hearing Ackerman regarding the appeal by Dr. Carl Ackerman from the Appeal decision of the Planning Commission on May 5, 1977 (2703) which denied Dr. Ackerman's appeal and sustained the action of the Modifications Committee regarding a request for alterations to an existing dwelling in a Commercial District permitted by a previous variance (Modification No. 2058); property located at 106 -22nd Street, on the easterly side of 22nd Street, northerly of the west ocean front in McFadden Square; and the continued public hearing regarding the appeal by Dr. Carl Ackerman from the decision of the Planning Commission on May 5, 1977 which denied Site Plan Review No. 4, a request to permit con- struction of a 1,000 square foot commercial building in an area designated for a Specific Area Plan; property located at 108 -22nd Street, on the west ocean front in McFadden Square; zoned C -1. A report was presented from the Community Develop- ment Department. Dr. Ackerman addressed the Council and stated that he was willing to have the hearing continued until after the Wilbur Smith parking study is completed. The City Attorney stated for the record that any further continuance should be at the request of Dr. Ackerman with the understanding that the City is prepared to move ahead and act on the request at this time. Dr. Ackerman stated that it was his request that the matter be continued to the second meeting in January and that he waived any right he might have as a result of the delay in acting on his appeals. A report from the Chief of Police to the City Manager was presented, A synopsis of the G & W Towing Company's application prepared by their attorney, Stanley Feldsott, was presented. The following people addressed the Council in favor of the application: Gordon Miller, owner of G & W Towing Company; Dave Gunderson, manager of G & W Towing Company; Wayne Miller; and Stan Feldsott, attorney representing G & W Towing Company. Motion x Mr. Miller was granted three additional minutes for Ayes x x x x x x his presentation. Absent x Bill Rush, owner of Harbor Towing.Company, addressed the Council and stated that he would like to respond to statements regarding his company at a future date. CONTINUED BUSINESS: 1. A report was presented from the Traffic Affairs Transportation Committee regarding review of the Corona del May Plan Traffic Survey and the development of priorities. (960) The following people addressed the Council and opposed improvement of 5th Avenue: Ron Kennedy, Margaret Wilson, Jay Smith, Dick Succa and Val Morton. CURRENT BUSINESS: 1. A report from the Community Development Department County regarding the intention of the County of Orange to Triangle redesignate the zoning of that portion of the (673) County Triangle north of Hoag Drive between Mon- rovia Avenue and Placentia Avenue was presented with a copy of a proposed letter to the Board of Supervisors. Motion x Councilman Kuehn made a motion to direct the Mayor to sign the letter to the Orange County Board of Supervisors requesting reconsideration of the Board's General Plan action concerning the Triangle. Motion x Councilman Rogers made a substitute motion to make Ayes x x x changes in the last paragraph of the letter by x x x deleting the word, "understandable" in the seventh t x line, the word "respectfully" in the eleventh line and the phrase "more nearly" in the next to the last line, which motion failed to carry. Ayes x x x x x A vote was taken on Councilman Kuehn's motion, Noes x which motion carried. Absent x 2. A report was presented from the Marine Department Harbor regarding a request for an exception to the Harbor Permit Permit Policies by Andrew Glassell to allow the (430F) mooring of a 50 -foot sailboat at 1204 S. Bay Front, Balboa Island. Motion x Mr. Glassell's request was tabled. Ayes x x x x x x Absent x 3. A report was presented from the Marine Department Harbor regarding Harbor Permit Application 11105 -103 by Permit/ Ben Deane to revise a pier and float and requesting Deane an exception to the Harbor Permit Policies to allow (304F) the construction of a cantilevered deck over County tidelands at 103 Bayside Place. Mayor Pro Tem Barrett stepped down from the Council table due to a possible conflict of interest. • Ben Deane, applicant, addressed the Council. A report was presented from the Marine Department Harbor regarding Harbor Permit Application #134-38 by Eddy Permit/ Meredith requesting an exception to the Harbor Meredith Permit Policies to allow the construction of a (304F) cantilevered deck over County tidelands at #38 Linda Isle. Tom Fuentes, a member of Robert Bein and William Frost and Associates, and Richard Meredith, brother of the applicant, addressed the Council and urged approval of the cantilevered deck. SA River (2552) George Davidson, owner of the property at 5801 West Coast Highway, addressed the Council and protested the condemnation of his property. Resolution No. 9201, being a Resolution of the City R -9201 Council of the City of Newport Beach declaring the necessity of condemnation requiring the taking of property for the widening of West Coast Highway on the south side, between 57th Street and the Santa Ana River, as authorized pursuant to the Charter of the City of Newport Beach and Section 37350, of the California Government Code and finding that the public interest and necessity require the project, that the project is planned and located in the manner that will be most compatible with the greatest public good and least private injury, that the property described in the resolution is neces- sary for the proposed project, authorizing the City Attorney to institute condemnation proceedings; and authorizing the Finance Director to make a deposit in Court for possession of the subject property Motion x prior to judgment, was adopted; and the purchase of Ayes x x x x x x Lot 1 in Block 158 of River Secion, Newport Beach Absent x (5801 West Coast Highway) for its appraised fair market value was authorized. The following claims were denied and the City Claims Clerk's referral to the insurance carrier was confirmed: (a) Claim of Obera Lee Adler for damages and (2785) personal injuries as a result of a fall in Adler . the general location of the 4300 block of Birch Street on or about June 8, 1977, allegedly due to negligence on the part of the City due to an uneven, raised sidewalk. (b) Claim of Dorothy Danielle Johnson alleging (2786) personal injury, false arrest, false im- Johnson prisonment and loss of earnings on or before June 16, 1977 at her place of residence in Newport Beach. (c) Claim of Mr. and Mrs. Arthur V. Doble, 1109 (2787) E. Balboa Boulevard for damage to their main Doble sewer line which was caused by a City -owned tree necessitating service calls by plumbers. • (d) Claim of Jordeane Collins Harrod for damages (2788) and personal injuries as a result of an Harrod accident on June 15, 1977, on Westminster Avenue when she was stopped at a traffic signal and struck from the rear by a bus owned by the Orange County Transit District, which allegedly failed to stop at the red light. Claimant has not specified her reasons for claiming responsibility on the part of the City of Newport Beach. (e) Claim of Ron Harrod for loss of consortium as (2789) a result of an accident on June 15, 1977, on Harrod Westminster Avenue when his wife, Jordeane Collins Harrod, was stopped at a traffic signal and struck from the rear by a bus owned by the Orange County Transit District, which allegedly failed to stop at a red light. The claimant has not specified his reasons for claiming responsibility on the part of the City of Newport Beach. (f) Claim of Philip Jasieniecki for damages to (2790) his car on July 30 at the intersection of Jasieniecki Orange Street and Pacific Coast Highway, allegedly resulting from a two -car collision which was caused by the malfunction of the traffic signal at that intersection.
