The reading in full of all ordinances and resolutions All Ayes under consideration was waived, and the City Clerk was directed to read by titles only. D. HEARINGS: 1. Mayor Ryckoff opened the continued public hearing Resub 624 regarding Resubdivision No. 624, a request of (32ta5) Virginia Dey to create one parcel of land to permit the conversion of an existing triplex into a three - unit residential condominium complex, located at 111 Via Lido Nord, on Lido Isle; referred to the City Council by the Planning Commission with no recommendations. A report was presented from the Community Development Department. Motion x The hearing was closed after it was determined that es no one desired to be heard. es Motion x Mayor Ryckoff made a motion to deny Resubdivision No. 624 without prejudice. Motion x Councilman McInnis made a substitute motion to reopen the hearing and continue the item to September 10. Mayor Ryckoff opened the public hearing regarding Rodrigues the appeal of Clodomiro J. Rodrigues and Betty Appeal/ Rodrigues from the decision of the Planning Resub 622 Commission on July 5, 1979 denying Resubdivision (3318) No. 622, a request to create one parcel of land to permit the conversion of two existing dwelling units on the site into a two -unit residential condominium complex; on property located at 518 -518K Poinsettia Avenue, on the southeasterly side of Poinsettia Avenue between Second Avenue and Third Avenue in Corona del Mar; zoned R -2. Christine Fason, representing some of her neighbors as well as herself, addressed the Council in opposition to Resubdivision No. 622. Motion x The hearing was closed after it was determined that All Ayes no one else desired to be heard. Motion x Councilman McInnis made a motion to reopen the Ayes x x x x x hearing and continue to September 10, which motion Noes x carried. 3. Mayor Ryckoff opened the public hearing regarding District Ordinance No. 1815, being, Map 21 0 -1815 AN ORDINANCE OF THE CITY OF (1768) NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 21 TO RECLASSIFY FROM THE R -3 DISTRICT TO THE R -2 DISTRICT CERTAIN PROPERTY LOCATED AT 300 THROUGH 424 ST. ANDREWS ROAD, AND ACCEPTING THE ENVIRONMENTAL DOCUMENT (AMEND- MENT No. 534), • a request initiated by the City of Newport Beach. A report was presented from the Community Development Department. The following people addressed the Council in opposition to the ordinance: Harry Bueter, Mike Steiner and Frank Jensen. Motion x The hearing was closed after it was determined that All Ayes no one else desired to be heard. Motion x The environmental document was accepted and All Ayes Ordinance No. 1815 was adopted. E. ORDINANCES FOR SECOND READING AND ADOPTION: None. F. CONTINUED BUSINESS: 1. A report was presented from the Community CurbCut Development Department regarding access to 2901 2901 Ocean Ocean Boulevard, on the southerly side of Ocean (3180) Boulevard at Heliotrope Avenue in Corona del Mar. Acting City Attorney Hugh Coffin reported to the Council Judge Todd's decision in the Superior Court case of Britvich v the City of Newport Beach . The Judge determined that the Council action on May 14 was improper since the property owners and Mr. • Britvich did not receive notice that the Council was going to consider the application once again and possibly rescind it. Since the matter of access to the property needs to be considered, the Acting City Attorney suggested the City Council set a public hearing, notifying the owner and all property owners in the vicinity. The following people addressed the Council regarding the curb cut and driveway: John Van Cleve, representing Mr. Britvich, asked for an additional condition to be added to the motion stating that a final decision would be made in two weeks; Mary Burton and James Parker, representing the residents on the inland side of Ocean Boulevard, requested that access be made from Heliotrope Avenue; and Dick Dodd, architect on the project, asked the Council to set the grade. Motion x Councilman Hart made a motion to set August 27, 1979 for a public hearing on access to the property located at 2901 Ocean Boulevard and express the intent to make a decision following the hearing. Councilman Strauss asked that the motion be amended to include the words "if possible” regarding the decision, which amendment was accepted by the maker of the motion. Oil Ayes A vote was taken on Councilman Hart's amended motion, and the hearing was set for August 27, 1979 regarding access to the property located at 2901 Ocean Boulevard and expressing the intent, if possible, to make a decision following the hearing. 2. Appointment to the City Arts Commission: City Arts Comsn Green x x x The Mayor assigned the green light to Betty (120F) Red x x x Tessman and the red light to Maudette Ball for voting purposes, and the voting resulted in a tie vote. Green x x x x A second vote was taken and Betty Tessman was Red x x appointed to complete the unexpired term ending June 30, 1982. Motion x 3. Councilman McInnis' appointment of a member to Trans Plan All Ayes the Transportation Plan Citizens Advisory CRC Committee to fill the unexpired term of R. H. (960) Clucas ending December 31, 1979 was postponed to August 27. Motion x 4. Councilman Hummel's appointment of a member to Trans Plan All Ayes. the Transportation Plan Citizens Advisory CAC Committee to fill the unexpired term of G. Letters dated July 30 and August 3, 1979 from Yellow Cab Orange Coast Yellow Cab, Inc. were presented (666) regarding a request for a 5% surcharge to offset increased fuel costs incurred by driving personnel. Motion x A public hearing for a rate increase for Orange All Ayes Coast Yellow Cab, Inc. was set for August 27, 1979. 2. A report was presented from the City Librarian to Library the City Manager regarding recommendations for (474) appointment of an Alternate Member to the Santiago Library System Lay Advisory Board to replace Richard McFarland. Green x x x The Mayor assigned the green light to Reg Jones Red x x x and the red light to Holly Wilkinson for voting purposes, and the voting resulted in a tie vote. Bicycle Trails Citizens Advisory Committee: Bicycle Trails CAC Motion x Dr. Sholkoff's resignation was accepted with regret; (205F) All Ayes the City Clerk was directed to prepare a Certificate of Appreciation; and Councilman Hummel's appointment of a member to fill the unexpired term ending December 31, 1979 was postponed to August 27. 5. A letter from the League of California Cities was League presented requesting that the City designate a Calif voting representative and an alternate to be present Cities at the Business Session at the Annual Conference in (2526) San Francisco on Tuesday morning, September 25 at 10:00 a.m. in the Hilton Hotel. A report from the Airport Aviation Committee OrCo requesting Council to oppose HR 3942 was Airport presented. (195) Motion x The staff was directed to present a proposed All Ayes resolution to the Orange County League of Cities for their submittal at the California League of Cities Conference in San Francisco opposing HR 3942 which would waive compliance with FAA Aircraft Noise Reduction Regulations. 7. A report was presented from the Marine Department Harbor regarding Harbor Permit Application $128 -3017 by Permits Harrison Sea Ray Boats to reconstruct an existing (304F) bulkhead and marina at 3107 West Coast Highway. Tidelands Administrator Glen Weldon gave a brief staff report. Ken Sampson, representing the applicant, and John Jakosky addressed the Council and asked that the Harbor Permit application be approved. Motion x Councilman Hart made a motion to approve the Harbor Permit application submitted by Harrison Sea Ray Boats, and an easement be granted to the City by the applicant of ten feet along the bulkhead for a possible walkway. 4botion x Councilman McInnis made a substitute motion to confirm the 1964 City Council action regarding access to the Towers marina based on the two letters submitted by David Young, and approve the Harbor Permit application submitted by Harrison Sea Ray Boats. Ayes x x x A vote was taken on Councilman McInnis' substitute Noes x x x motion, which motion failed. Bill Ficker, planner on the project, addressed the Council regarding the proposed easement. Motion x Councilman Strauss made a substitute motion to Ayes x x x x x confirm the 1964 City Council action regarding Noes x access to the Towers marina based on the two letters submitted by David Young and approve the Harbor Permit application submitted by Harrison Sea Ray Boats, with the condition that the area, or at least ten feet beyond the bulkhead, be reserved for open space and /or parking, which motion carried. (c) Claim of Eileen Connolly for personal injuries Connolly on June 24, 1979 allegedly sustained in the (3325) parking lot near the Newport Beach pier where she was falsely arrested and imprisoned, assaulted and battered. (d) Claim of Gregory Alan Myer for personal Myer injuries on May 27, 1979 when he slipped and (3326) fell at "The Wedge" in Newport Beach allegedly breaking his pelvis and was arrested by Police officers and placed in jail for six hours without medical attention. Steele Steele for personal injuries, Case No. 31 -70 -75 in (3289) the Orange County Superior Court. The original claim for personal injuries involved the tripping and falling of claimant on a sidewalk at 2407 Buckeye Street, Newport Beach on December 23, 1978. (b) Summons and Complaint of Pacific Telephone Pacific Tel and Telegraph Company for property (3160) damages, Case No. 36098 in the Orange County Superior Court. A report was presented from the Community Development Department regarding the residential development standards for old Corona del Mar. x A proposed ordinance, being, AN ORDINANCE OF THE CITY OF NEWPORT BEACH DELETING CHAPTER 20.11 TO RECODIFY AS CHAPTER 20.19, "RESIDENTIAL DEVELOPMENT STANDARDS;' AND ADDING CHAPTER 20.20 "RESIDENTIAL DEVELOPMENT STANDARDS, OLD CORONA DEL MAR," AND MAKING VARIOUS CONFORMING AMENDMENTS TO OTHER SECTIONS OF TITLE 20 OF THE NEWPORT BEACH MUNICIPAL CODE, Planning Commission Amendment No. 524, a request initiated by the City of Newport Beach to consider amending the Residential Development Standards for the R -1, R -2 and R -3 Districts in Old Corona del Mar, was deferred until such time as it has been acted upon by the Planning Commission. Councilman Hummel requested a straw vote be taken when the proposed ordinance is set for hearing before the City Council since it would require notifying 2000 homeowners by mail and by law the notification in the newspaper suffices. x x x Mayor Ryckoff assigned the green lights for those x x x voting for mailings, and the red lights for those opposed to the mailings, resulting in a tie vote, and there will be no notices mailed.
