Mayor Heather opened the public hearing regarding Use Permit Use Permit No. 1930, referred to the City Council No. 1930 by the Planning Commission with no recommendation. (88) This is a request by Lee 6 Strock Architects, Inc. to permit the construction of a two -story office building exceeding 5,000 sq. ft. of floor area in a Specific Area Plan where a specific plan has not been adopted; and the acceptance of an Environment- al Document; on property located at 350 North Newport Boulevard, on the southerly corner of North Newport Boulevard and Beacon Street, adja- cent to Newport Heights; zoned C -1 -H. Reports dated April 9 and May 12, 1980 were pre- sented from the Planning Department. Arthur Strock, Lee and Strock Architects, 4220 Von Karmen Avenue, Newport Beach, reviewed . the current plans which included parking and sign- ing for the proposed project. Pat Strang, President of the Newport Heights 1— Association stated they were in favor of having the project proceed, after reviewing the revised plans with the architects. Motion x The hearing was closed after no one else desired All Ayes to be heard. Notion x Mayor Pro Tempore Hart made a motion to accept the All Ayes Environmental Document and approve Use Permit No. 1930 subject to the findings and conditions in the staff report. 2. Mayor Heather opened the public hearing regarding Use Permit Use Permit No. 1939, approved by the Planning No. 1939 Commission on April 24, 1980, a request to permit (88) the construction of a three -story office building that exceeds the basic height limit within the 32/50 Foot Height Limitation District, and the acceptance of an Environmental Document, on Parcel 1 of Parcel Map 142 -41 (Resubdivision No. 633), located at 3300 Irvine Avenue, on the southerly side of Irvine Avenue, northeasterly of Orchard Drive, across Irvine Avenue from the Newport Beach Golf Course facility, zones A-?-H. • Volume 34 - Page 106 f � COUNCILMEN MINUTES �� May 12, 1980 ROLL CALK �'' v i,.i„ew A report was presented from the Planning Depart- ment. • A letter was presented from the Upper Bay Home owners and Renters Association opposing the project. Albert J. Auer and Taylor'Grant, Newport -Irvine Associates, the applicants, spoke before the Council in.support of the use permit. Arthur Strock, Lee and Strock Architects, gave a presentation regarding the height of the building in relation to the open space and environment. Motion x Mr. Strock was granted two additional minutes for All Ayes his presentation. Richard G. Truofreh, Liaison Officer, Upper Bay Homeowners and Renters Association, addressed the Council in opposition to the project. Motion x Mr. Truofreh was granted two additional minutes All Ayes' to complete his summation. The following people addressed the Council in opposition to the project: Erma Batham, President of the Upper Bay Homeowners and Renters Associa- tion, Nancy Kaufman, Attorney, and the following residents from the Santa Ana Heights area: Linda Dalton, Bill Carpenter, Lee Scoggins and Michael Bourgeois. Lewis Akerman, Jr., Santa Ana builder, addressed the Council in rebuttal, and expressed his support for the applicant's project. Motion x The hearing was closed after it was determined All Ayes that no one else desired to be heard. Motion x Councilman Cox made a motion to accept the 'Ayes x x x x x Environmental Document, to sustain the decision Noes x x of the Planning Commission and to proceed with the project according to the Planning Commission's findings and conditions, with the stipulation that a right turn ingress from Irvine Avenue be provided if feasible, with staff's review, which motion carried. 3. Mayor Heather opened the public hearing regarding Zone Amend Ordinance No. 1842, being, 0 -1842 (94) AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 13 TO DESIGNATE A FRONT YARD SETBACK OF TEN FEET ON PORTIONS OF TWO LOTS LOCATED AT 109 AND 109'h PARK AVENUE, BALBOA ISLAND. (36) Motion x The attorney - client privilege was waived so that A]� Ayes Council could discuss the settlement. Leonard Hempel, special attorney for the City, addressed the Council with a presentation of the two actions filed as the result of the adoption of General Plan Amendment 79 -1. A letter was presented from the Harbor Council Drug Parapher- Parent- Teacher Association recommending approval nalia of a narcotics paraphernalia ordinance. 0 -1843 (70) Linda McGavran, President of the Harbor Council PTA, addressed the Council in favor of the adop- tion of the ordinance. The regular order of the agenda was resumed. F. CONTINUED BUSINESS: 2. A report was presented dated April 14 from the Small Boat City Manager regarding small boat launching at Launching 18th and Bay. 18th /Bay R -9775 A report was presented from the Parks, Beaches (51) and Recreation Director. Marine Department Director Dave Harshbarger ad- dressed the Council with a report, stating that there was a definite need for small boat launch- ing for the Lower Bay, and that a problem also exists with regard to the continued safety of the swimmers. Mike Wagner, Costa Mesa, addressed the Council and gave a slide presentation of the existing streets for legally launching small boats. He stated that 18th and Bay.was the only accessible area available for this purpose. The following people addressed the Council in support of keeping 18th and Bay open for small boat launching year - round: Ray Warren, Dale Teschler, Ed Dillon, Bob Davis and Mike Stevens. Russ Murphy, Harry Dalby and Fletcher Olson, also spoke in favor of small boat launching at 18th and Bay, and expressed their concerns regarding the heavy traffic congestion. (73) A Letter of Agreement from the California State Department of Transportation was presented. Donald McInnis addressed the Council in favor of accepting the proposal. Motion x Councilwoman Plummer made a motion to authorize All Ayes the acceptance of the proposal for the acquisi- tion of the P.E. Right -of -Way in West Newport Beach at the negotiated price of $689,150.00, which motion carried. 4. A report was presented dated April 28 from the Encroachment Public Works Department regarding the application Permit /Jack- of Robert Jackson to construct a 2- foot -high brick son planter wall encroaching one foot into the park- (65) way at 437 Fernleaf Avenue. A report dated May 12 from the Public Works • Department was presented. Robert Jackson, the applicant, addressed the Council requesting that his application be approved. A report dated April 14 from the Public Works Department regarding the request of Mr. and Mrs. Encroachment John Valentine to construct retaining walls, permit /Valen- planters, sidewalk, steps and landscaping in tine public right -of -way adjacent to 3709 Ocean Boule- (65) vard, Corona del Mar was presented. John Valentine, the applicant, addressed the Council and gave a slide presentation regarding his request for approval of the encroachment, stating that there were two areas of concern; the front yard and the rear yard. The City Manager reported that staff was not prepared to comment on the rear yard approval at tonight's meeting, as this request was not sched- uled for this meeting. Motion x Mayor Heather made a, motion to continue the request to May 27. Motion x Councilman Hummel made a substitute motion to All Ayes, approve the application for the front yard in con- currence with staff's recommendation, which motion carried. G. CURRENT BUSINESS: 1. A report was presented from the Public Works Superior/ Department regarding the installation of traffic Hosp. Rd. signal and safety lighting at the intersection of (C -2155) Superior Avenue and Hospital Road (C- 2155). R -9776 (38) Margot Skilling, President of the West Newport • Beach Improvement Association, addressed the Council in favor of the signal at Hospital Road. Motion x The informality in the bid of Grissom and Johnson, All Ayes Inc., was waived, and Resolution No. 9776, award ing a contract to Grisson and Johnson in connec- tion with the installation of a traffic signal and safety lighting at the intersection of Superior Avenue and Hospital Road (C- 2155); in the amount of $61,633.00, was adopted. 2. Dick Sweet, 2nd Vice President, Oasis, spoke in favor of the proposal. Motion x Mayor Pro Tempore Hart made a motion to (a) author- ize the staff to explore the feasibility of the proposed land exchange; (b) initiate negotiations with The Irvine Company; and (c) report back to the City Council.
