Mayor Heather opened the continued public hearing Zoning Amend regarding Ordinance No. 1842, being, 0 -1842 (94) AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 13 TO DESIGNATE A FRONT YARD SETBACK OF TEN FEET ON PORTIONS OF TWO LOTS LOCATED AT 109 AND 10911 PARK AVENUE, BALBOA ISLAND, Planning Commission Amendment No. 543, a request of John L. and Barbara B. A letter received after the agenda was printed from John Bettingen was presented opposing a change in the building standards. A report was presented from the Planning Depart- ment. Robert Stoessel, Chairman of the Corona del Mar Study Committee, addressed the Council and pre- sented slides to illustrate how the Committee had made its determinations. The following people addressed the Council and opposed, or opposed in its present form, the adop- tion of the ordinance: Lars de Jounge, John Bettingen, Allan Beek, Virginia Fouts, Clyde Brenner, Al Binder, Marjorie Nielsen, Bob Anderson and Jamie White. Motion x Mr. Beek was granted three additional minutes for All Ayes his presentation. The following people addressed the Council in • favor of the proposed ordinance; Ron Malouf, speaking for the Board of the Corona del Mar Civic Association; Luvena Hayton and Ron Covington. Dan Emory addressed the Council and asked that they give the matter careful thought. Mayor Heather closed the public hearing after it was determined that no one else desired to be heard. Mayor Heather reopened the public hearing. Motion X Mayor Pro Tem Hart made a motion to reintroduce the ordinance as modified to eliminate the third floor area, and continue the public hearing. Motion x Councilman Hummel asked that the motion be amended Ayes x x x to state in Section 20.20.040(b) that in the R -2 Noes x x x District, the buildable site will not exceed 1.6 x buildable on site, which amendment failed. Mayor Heather opened[ the public hearing regarding Use Permit the appeal of Muldoon's Irish Pub in connection No. 1931 with the Planning Commission's approval of Use (88) Permit 1931 by Robert Lorenzetti /Zetti's Place, • Inc. to establish a restaurant facility with on- sale beer and wine in an existing building in Design Plaza in the 0 -0 -H 'District on property located at 240 Newport Center Drive. A letter was presented from Muldoon's Irish Pub asking that their appeal be withdrawn. Motion x The request was granted, and the appeal regarding All Ayes Use Permit 1931 was withdrawn. E. Ordinance No. 1843, being, Drug Para- phernalia AN ORDINANCE OF THE CITY OF NEWPORT BEACH 0 -1843 ADDING CHAPTER 10.56 TO THE NEWPORT BEACH (70) MUNICIPAL CODE TO REQUIRE PROPRIETORS OF BUSINESSES TO EXCLUDE MINORS FROM ANY ROOM OR PLACE WHERE DEVICES, CONTRIVANCES, INSTRU- MENTS OR PARAPHERNALIA, FOR THE SMOKING OR INJECTION OF MARIJUANA, HASHISH, PCP, OR ANY CONTROLLED SUBSTANCE IS DISPLAYED OR OFFERED FOR SALE, AND PROHIBITING THE GIFT, SALE OR DELIVERY OF SUCH DEVICES TO MINORS, was presented. • The following people addressed the Council and opposed the ordinance: Bruch Hopping, Ken O'Shay and Russel Evans, Manager of Pier Records. CURRENT BUSINESS: 1. The City Clerk announced that two proposals, from Legal Adver • the Daily Pilot and from the Sutton News Group, Bid Proposals had been received by her before the hour of (20) 7:30 p.m., May 27, 1980 in connection with a contract covering the publication and printing of all legal notices or other material required to be published in a newspaper of general circulation published and circulated in the City of Newport Beach for the fiscal year ending June 30, 1981. Mayor Heather asked the City Clerk to open and announce the bids. City Clerk Doris George announced the bids as follows: Ensign $3.50 per column inch for first insertion $3.00 per column inch for second or subsequent insertions Daily Pilot $3.91 minimum per column inch $3.12 per inch for subsequent insertions Motion x The two bids were referred to staff for analysis All Ayes and a report back. 2. A letter from Preston Johns was presented stating CEQUAC Appmt that he has been transferred out of the City and Dunzer . resigning from the Environmental Quality Citizens (24) • Advisory Committee. Motion (District 3) Mayor Pro Tem Hart's appointment of All Ayes John Bernard Dunzer as a member of the Environ- mental Quality Citizens Advisory Committee to fill the unexpired term ending December 31, 1980 was confirmed. 3. A report was presented from the Marine Department 18th 6 Bay regarding a reduction in the size of the "Protect Swimming Area ed Swimming Area" at 18th Street and Bay. (51) Mrs. Stetson addressed the Council and asked for the location of the swimming area.. Marine Director Dave Harshbarger responded with a brief staff report. Eli Elman and Bruce Hopping addressed the Council and opposed the reduced swimming area. Motion x The staff was directed to implement the following Ayes x x x x x recommendations: Noes x 1. Relocate the lifeguard tower in front of the Marina Trailer Park to just west of the Small Boat Launching Lane at 18th • Street. 3. Sign the area to designate that the beach west of the Small Boat Launching Lane be used for swimmers only and east of the Small Boat Launching Lane for boat launching and day use. 4. Monitor the changes and report back to the City Council at the end of the summer. 4. A report was presented from the Public Works Public Works Department regarding proposal C -1 of the Grading Maint /Dredg. and Siltation Committee Report. (C -2183) (74) Motion x The general policy that maintenance dredging for All Ayes the benefit of privately -owned piers and slips is the responsibility of those deriving the benefit, regardless of the source of material to be dredged was reaffirmed, the staff was directed to prepare a formal policy for Council consideration regard- ing maintenance dredging responsibilities, and the staff was authorized to retain the consulting coastal engineering firm of Moffat 6 Nichol Engineers to prepare a report on storm drain impacts and sand distribution in Carnation Cove for a maximum fee of $7,500. A letter from the Upper Bay Homeowners and Renters Use Permit Association was presented regarding Use Permit No. 1939 No. 1939, considered by Council on May 12, 1980, (88) and asking that the item be reheard. A report was presented from the Public Works De- partment regarding the application of Gordon Hunter to construct a'fence 90 feet long, 6 feet high, encroaching 3 feet into the public right -o way at 717 St. James Place. x The application was postponed to June 9, 1980. 3. A letter from Bruce S. Hopping was presented regarding the City's animal control. Bruce Hopping addressed the Council and suggests that some of the wild cats that inhabit the City's bluffs be sent to Laguna Beach to decimat their large squirrel population. x The 'staff was directed to check into the problem and to reply. J. ADDITIONAL BUSINESS: x 1. The Mayor was authorized to write a letter to Supervisor Riley opposing the proposed runway extension at John Wayne Airport. x 2.
